MANILA, Philippines – An overflowed creek which caused floods in parts of Fairview and the threats of La Mesa Dam in Quezon City reaching its spilling level prompted the evacuation of over 1,000 persons near the area since Sunday night, the Office of Civil Defense said Monday.
In Masambong village, 60 families were evacuated in the nearby covered court; 15 families or 60 individuals in Sta. Lucia were evacuated in the covered court, parish church and barangay hall; and 424 families or 1,259 persons in Bagong Silangan were moved to the covered court and Brookside Elementary School, said OCD Director Susana Cruz.
Cruz said five families in Payatas were moved to Lourdes Chapel; four families from Damayan village and 20 families from Fairview village were moved to the barangay hall; and 90 families in Gulod and 19 individuals from Dona Imelda villages were also evacuated.
La Mesa Dam is on red alert status after reached its spilling level of 80.15 meters at 3a.m. As of 8a.m., it was at 80.14 meters.

ZAMBOANGA CITY—A Catholic-run school here has caused a controversy by banning Muslim students from wearing the hijab headscarf.
Mehol Sadain, who heads the National Commission on Muslim Affairs, said Sunday he had written to Pilar College in this mixed Muslim-Christian port city to demand that it reverse its policy.
While the school was right to claim it could exercise academic freedom, Sadain said it should do so with “justice and fair play.”
“Pilar College should realize that while educational institutions can formulate their own policies, the same should not run counter to existing laws and state policies,” Sadain said.
The complaint has reached the local city council, which asked the school to reply to the allegations.
Pilar College is believed to be the first in the Philippines to enforce an outright ban on wearing the hijab.
Sadain noted that a Department of Education (DepEd) policy states that Muslim girls should be allowed to wear head coverings in school and may be exempted from non-Muslim religious rites.
Education Undersecretary for Programs and Projects Yolanda Quijano confirmed the DepEd’s policy that allows Muslim girls to wear their traditional headscarves in school regardless of what school they attend.
“She (Quijano) confirmed that that is indeed the policy and it still exists,” DepEd communications officer Tina Ganzon said in a text message Sunday.
Western Mindanao State University professor Alih Aiyub, secretary general of the National Ulama Conference of the Philippines, said the problem caught the public’s attention when a parent brought the matter to City Councilor Melchor Sadain, who then authored a resolution asking the city government to verify with Pilar College if it had such a policy.
Avoiding conflict
“It turned out that they had such a policy. But still we don’t want to make it a big issue at this time because… we are still conducting an internal, low-level dialogue with the school administration,” Aiyub, coordinator of the peace group Salam, said.
Aiyub admitted that they were the ones who advised the parents not to speak to the media “because we don’t want the issue to end up like it’s a conflict between Muslims and Christians.”
But Aiyub said that they advocated religious freedom.
“It is not just about Christian schools imposing such a policy, but also Muslim schools (madrasah) that offer special classes on Arabic for non-Muslims and may have been imposing such a policy,” he said.
“If there are Muslims who don’t want to wear the hijab, it is their right. If there are Christians taking Arabic classes who are not comfortable using the hijab inside the Madaris, it is also their right. What we are opposing is the imposition of a policy where a student is banned if she goes to school wearing a hijab,” he said.
But the school, run by the Congregation of the Religious of the Virgin Mary, who incidentally wears veils, said in its letter to the council that it could not “deviate” from its Catholic leanings.
It said that students from other religions were welcome to enroll but must strictly follow the school’s no-hijab policy.
“Rules and regulations are explained to them, particularly the non-wearing of the hijab or veil,” the school said.
Academic freedom
“This is part of academic freedom in connection with which the school has the right to choose whom to teach,” it said.
It was not clear what percentage of students were Muslim but it is fairly common that children from different denominations or religions mix at school in the country, particularly in the provinces.
More than 80 percent of the Philippines’ nearly 100 million population are Catholic, while Muslims form a large minority in the south of the country.

ASIDE from broken families and marital problems, the Migrante International said Sunday that having children lured into fraternities is one of the social costs of migration.
In a statement, Migrante lamented how the absence of parents working abroad could make children vulnerable to join fraternities and sororities, which also exposes them to hazing.
“It certainly falls within the so-called social cost of migration where parents being away from their sons and daughters could not properly exercise parental guidance,” said Migrante.
Specifically for law students, the group said it is expected that parents would not think twice of seeking higher-paying jobs abroad.
“Poor and not so rich parents, who wanted their sons and daughters to become lawyers, are forced to work overseas to support the latter’s law studies noting that a four-year law education is expensive,” the group added.
The group’s statement came on the heels of the death of San Beda law student Marc Andre Marcos allegedly due to hazing.
He was reportedly undergoing initiation rites for the Lex Leonum Fraternitas.
Migrante said this is the reason they are asking President Benigno Aquino III to ensure the strict implementation of the Anti-Hazing Law in a bid to protect vulnerable students especially children of OFWs.
They said it is the least that Aquino can do for the sake of the OFW parents that cannot attend to their children since they are forced to work abroad.
“PNoy as the country’s chief executive is vested with executive power to strictly implement the law. Enough of ‘Noynoying’!” said Migrante.

THE Department of Justice (DOJ) has recommended the filing of criminal charges for violation of the Intellectual Property Code against officers of Bangkok-based manufacturer of energy drink Red Bull and its local product distributor for unfair trade competition and conspiracy to commit fraud through misbranding.
In a nine-page resolution, Justice Undersecretary Jose Vicente Salazar found probable cause to indict the officers of Thai company TC Pharmaceutical Industries Co. Ltd, makers of the popular energy drink, and Maryland Distributors Inc. for violation of Section 168 in relation to Section 170 of RA 8293 (Intellectual Property Code) and Sections 11(g) and 15(a) of RA 3720 (Food, Drug and Cosmetic Act).
Charged were Thai nationals Pavana Langthara, Suthirat Yoovidhya, Supreeya Yoovidhya, Nucharee Yoovidhya, and Visuit Chiemkitchavarote, who are all officers of TCP. Also named respondents were MDI officers Gino Baltao, Gina Tolentino, Ramoncito Abad, Benjamin Ros, and Nelson Escobar.
The complaint was filed by Energy Food and Drinks Inc., a local company originally appointed by TCP in March 2003 as its exclusive distributor of Red Bull Supreme Energy Drink. EFDI obtained a Certificate of Product Registration for Red Bull with the BFAD, which was to expire on March 31, 2013.
The case reached the DOJ after complainant appealed the findings of the city prosecutor of Legazpi, Albay that dismissed the charges it filed against its Thai partners and Maryland despite the evidence culled by the National Bureau of Investigation (NBI).
In its complaint, EFDI claimed that in 2009, it discovered the proliferation in the market of Red Bull bearing labels it registered with the Bureau of Food and Drugs but tampered with by Maryland, thus, prompting it to file a complaint with the NBI.
The NBI then conducted a series of test buys where Red Bull bottles with tampered labels of complainant were recovered. It found out that the bottles’ logo stating that EFDI is the authorized Philippine importer of Red Bull was covered or superimposed with stickers that stated that it was manufactured by TCP and imported by Maryland, which is based in Taytay, Rizal.
The complainant said it only learned after TCP published an advertisement that the latter already terminated the appointment of EFDI as its Philippine distributor for Red Bull since October 2008, and that it had already filed with BFAD a notice to cancel the Certificate of Product Registration previously issued to EFDI.
This prompted EFDI to file a case before the Legazpi city prosecutor’s office, which ruled to dismiss it on the ground that the issues raised in the case is not alleged violations of RA 8293 and RA 3720, but “a civil dispute over a product distributorship agreement.”
The unfavorable ruling of the city prosecutor prompted it to file the case before the DOJ.
Ruling on the case, Salazar said there is sufficient evidence showing that respondent TCP and Maryland officers conspired “when they acted in unison in violating the property rights of EFDI.”
“Complainant was able to adduce sufficient evidence that respondents, in conspiracy with one another, engaged in unfair competition. The importation of Red Bull products, the tampering of the product label and the proliferation thereof in the market constitute ‘underground sales and marketing’ of red Bull products, which undermined the property rights of herein complainant EFP,” the resolution stated.
The DOJ added that a food shall be deemed misbranded if its labeling is false or misleading in any particular.
Salazar said that since complainant EFD was the exclusive distributor, its name must be indicated in the label of Red Bull products.
Citing a Supreme Court case, he said the right to perform an exclusive distributorship agreement and to reap profits resulting from such performance is a proprietary right that a party may protect.
“In the instant case, however, the bottles of Red Bull bore tampered stickers/label,” the DOJ said in the resolution.
The DOJ noted that EFDI had established a trade or business in which it had acquired good will from 1993 up to the discovery in the market of Red Bull with tampered labels in 2009, or for a period of 16 years.
“In the course of its operation, EFDI’s business has certainly acquired value beyond its assets, arising from the reputation complainant EFDI established with its retailers and clients. This goodwill, which results from being the exclusive distributor of Red Bull, is entitled to be protected from any illegal use by an person,” the DOJ added.

THE Supreme Court (SC) has dismissed a petition questioning the constitutionality of an order that abolished the Presidential Anti-Graft Commission (PAGC), noting it is within the President’s power to reorganize the Executive department to attain efficiency in governance.
The functions of PAGC were transferred to the Office of the Deputy Executive Secretary for Legal Affairs (Odesla) under Executive Order 13, which was opposed by Prospero Pichay Jr. last year.
Pichay, former chairperson of the Local Water Utilities Administration (LWUA), was once a subject of an investigation in connection with alleged anomalous acquisition of shares of stock in cash-strapped Express Savings Bank in Laguna in 2009.
As a result, the Department of Justice early this year found probable cause to indict Pichay and acting LWUA administrator Daniel Landingin for graft, malversation and violation of the New Central Bank Act.
In a 22-page decision, the Court ruled it is within the prerogative of the President as Section 31 of the Administrative Code of 1987 (EO 292) expressly “vests in the President the authority to reorganize the offices under him in order to achieve simplicity, economy and efficiency.”
The Court, in a decision written by Associate Justice Estela Perlas-Bernabe, said that both offices, PAGC and Odesla, belong to the Office of the President.
The Court held the reorganization only ordered the establishment of an investigative and adjudicatory division through which Odesla could take on the additional functions it has been tasked to discharge under EO 13.
Moreover, EO 13 will not usurp legislative power to appropriate funds even if it does not allocate a specific amount for Odesla in the annual budget of the Office of the President since the Constitution allows the Chief Executive to use savings for its respective offices.
Neither does EO 13 encroach upon the jurisdiction of the Office of the Ombudsman since the graftbuster’s task is to investigate and prosecute criminal cases to be taken up by the Sandiganbayan while Odesla only deals with administrative cases, the decision stated.
The Court said the authority of the Ombudsman to investigate elective and appointive officials in the government is not exclusive, which paved the way for Malacañang and the DOJ to probe Pichay.
Moreover, it said that along with the President’s power to remove and/or discipline presidential appointees comes the authority to investigate such public officials.

Over 1,000 persons near La Mesa Dam evacuated
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesMANILA, Philippines – An overflowed creek which caused floods in parts of Fairview and the threats of La Mesa Dam in Quezon City reaching its spilling level prompted the evacuation of over 1,000 persons near the area since Sunday night, the Office of Civil Defense said Monday.
In Masambong village, 60 families were evacuated in the nearby covered court; 15 families or 60 individuals in Sta. Lucia were evacuated in the covered court, parish church and barangay hall; and 424 families or 1,259 persons in Bagong Silangan were moved to the covered court and Brookside Elementary School, said OCD Director Susana Cruz.
Cruz said five families in Payatas were moved to Lourdes Chapel; four families from Damayan village and 20 families from Fairview village were moved to the barangay hall; and 90 families in Gulod and 19 individuals from Dona Imelda villages were also evacuated.
La Mesa Dam is on red alert status after reached its spilling level of 80.15 meters at 3a.m. As of 8a.m., it was at 80.14 meters.

Catholic school bans scarves for Muslim students
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesZAMBOANGA CITY—A Catholic-run school here has caused a controversy by banning Muslim students from wearing the hijab headscarf.
Mehol Sadain, who heads the National Commission on Muslim Affairs, said Sunday he had written to Pilar College in this mixed Muslim-Christian port city to demand that it reverse its policy.
While the school was right to claim it could exercise academic freedom, Sadain said it should do so with “justice and fair play.”
“Pilar College should realize that while educational institutions can formulate their own policies, the same should not run counter to existing laws and state policies,” Sadain said.
The complaint has reached the local city council, which asked the school to reply to the allegations.
Pilar College is believed to be the first in the Philippines to enforce an outright ban on wearing the hijab.
Sadain noted that a Department of Education (DepEd) policy states that Muslim girls should be allowed to wear head coverings in school and may be exempted from non-Muslim religious rites.
Education Undersecretary for Programs and Projects Yolanda Quijano confirmed the DepEd’s policy that allows Muslim girls to wear their traditional headscarves in school regardless of what school they attend.
“She (Quijano) confirmed that that is indeed the policy and it still exists,” DepEd communications officer Tina Ganzon said in a text message Sunday.
Western Mindanao State University professor Alih Aiyub, secretary general of the National Ulama Conference of the Philippines, said the problem caught the public’s attention when a parent brought the matter to City Councilor Melchor Sadain, who then authored a resolution asking the city government to verify with Pilar College if it had such a policy.
Avoiding conflict
“It turned out that they had such a policy. But still we don’t want to make it a big issue at this time because… we are still conducting an internal, low-level dialogue with the school administration,” Aiyub, coordinator of the peace group Salam, said.
Aiyub admitted that they were the ones who advised the parents not to speak to the media “because we don’t want the issue to end up like it’s a conflict between Muslims and Christians.”
But Aiyub said that they advocated religious freedom.
“It is not just about Christian schools imposing such a policy, but also Muslim schools (madrasah) that offer special classes on Arabic for non-Muslims and may have been imposing such a policy,” he said.
“If there are Muslims who don’t want to wear the hijab, it is their right. If there are Christians taking Arabic classes who are not comfortable using the hijab inside the Madaris, it is also their right. What we are opposing is the imposition of a policy where a student is banned if she goes to school wearing a hijab,” he said.
But the school, run by the Congregation of the Religious of the Virgin Mary, who incidentally wears veils, said in its letter to the council that it could not “deviate” from its Catholic leanings.
It said that students from other religions were welcome to enroll but must strictly follow the school’s no-hijab policy.
“Rules and regulations are explained to them, particularly the non-wearing of the hijab or veil,” the school said.
Academic freedom
“This is part of academic freedom in connection with which the school has the right to choose whom to teach,” it said.
It was not clear what percentage of students were Muslim but it is fairly common that children from different denominations or religions mix at school in the country, particularly in the provinces.
More than 80 percent of the Philippines’ nearly 100 million population are Catholic, while Muslims form a large minority in the south of the country.

In a statement, Migrante lamented how the absence of parents working abroad could make children vulnerable to join fraternities and sororities, which also exposes them to hazing.
“It certainly falls within the so-called social cost of migration where parents being away from their sons and daughters could not properly exercise parental guidance,” said Migrante.
Specifically for law students, the group said it is expected that parents would not think twice of seeking higher-paying jobs abroad.
“Poor and not so rich parents, who wanted their sons and daughters to become lawyers, are forced to work overseas to support the latter’s law studies noting that a four-year law education is expensive,” the group added.
The group’s statement came on the heels of the death of San Beda law student Marc Andre Marcos allegedly due to hazing.
He was reportedly undergoing initiation rites for the Lex Leonum Fraternitas.
Migrante said this is the reason they are asking President Benigno Aquino III to ensure the strict implementation of the Anti-Hazing Law in a bid to protect vulnerable students especially children of OFWs.
They said it is the least that Aquino can do for the sake of the OFW parents that cannot attend to their children since they are forced to work abroad.
“PNoy as the country’s chief executive is vested with executive power to strictly implement the law. Enough of ‘Noynoying’!” said Migrante.

Justice office recommends filing of charges vs Red Bull
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesTHE Department of Justice (DOJ) has recommended the filing of criminal charges for violation of the Intellectual Property Code against officers of Bangkok-based manufacturer of energy drink Red Bull and its local product distributor for unfair trade competition and conspiracy to commit fraud through misbranding.
In a nine-page resolution, Justice Undersecretary Jose Vicente Salazar found probable cause to indict the officers of Thai company TC Pharmaceutical Industries Co. Ltd, makers of the popular energy drink, and Maryland Distributors Inc. for violation of Section 168 in relation to Section 170 of RA 8293 (Intellectual Property Code) and Sections 11(g) and 15(a) of RA 3720 (Food, Drug and Cosmetic Act).
Charged were Thai nationals Pavana Langthara, Suthirat Yoovidhya, Supreeya Yoovidhya, Nucharee Yoovidhya, and Visuit Chiemkitchavarote, who are all officers of TCP. Also named respondents were MDI officers Gino Baltao, Gina Tolentino, Ramoncito Abad, Benjamin Ros, and Nelson Escobar.
The complaint was filed by Energy Food and Drinks Inc., a local company originally appointed by TCP in March 2003 as its exclusive distributor of Red Bull Supreme Energy Drink. EFDI obtained a Certificate of Product Registration for Red Bull with the BFAD, which was to expire on March 31, 2013.
The case reached the DOJ after complainant appealed the findings of the city prosecutor of Legazpi, Albay that dismissed the charges it filed against its Thai partners and Maryland despite the evidence culled by the National Bureau of Investigation (NBI).
In its complaint, EFDI claimed that in 2009, it discovered the proliferation in the market of Red Bull bearing labels it registered with the Bureau of Food and Drugs but tampered with by Maryland, thus, prompting it to file a complaint with the NBI.
The NBI then conducted a series of test buys where Red Bull bottles with tampered labels of complainant were recovered. It found out that the bottles’ logo stating that EFDI is the authorized Philippine importer of Red Bull was covered or superimposed with stickers that stated that it was manufactured by TCP and imported by Maryland, which is based in Taytay, Rizal.
The complainant said it only learned after TCP published an advertisement that the latter already terminated the appointment of EFDI as its Philippine distributor for Red Bull since October 2008, and that it had already filed with BFAD a notice to cancel the Certificate of Product Registration previously issued to EFDI.
This prompted EFDI to file a case before the Legazpi city prosecutor’s office, which ruled to dismiss it on the ground that the issues raised in the case is not alleged violations of RA 8293 and RA 3720, but “a civil dispute over a product distributorship agreement.”
The unfavorable ruling of the city prosecutor prompted it to file the case before the DOJ.
Ruling on the case, Salazar said there is sufficient evidence showing that respondent TCP and Maryland officers conspired “when they acted in unison in violating the property rights of EFDI.”
“Complainant was able to adduce sufficient evidence that respondents, in conspiracy with one another, engaged in unfair competition. The importation of Red Bull products, the tampering of the product label and the proliferation thereof in the market constitute ‘underground sales and marketing’ of red Bull products, which undermined the property rights of herein complainant EFP,” the resolution stated.
The DOJ added that a food shall be deemed misbranded if its labeling is false or misleading in any particular.
Salazar said that since complainant EFD was the exclusive distributor, its name must be indicated in the label of Red Bull products.
Citing a Supreme Court case, he said the right to perform an exclusive distributorship agreement and to reap profits resulting from such performance is a proprietary right that a party may protect.
“In the instant case, however, the bottles of Red Bull bore tampered stickers/label,” the DOJ said in the resolution.
The DOJ noted that EFDI had established a trade or business in which it had acquired good will from 1993 up to the discovery in the market of Red Bull with tampered labels in 2009, or for a period of 16 years.
“In the course of its operation, EFDI’s business has certainly acquired value beyond its assets, arising from the reputation complainant EFDI established with its retailers and clients. This goodwill, which results from being the exclusive distributor of Red Bull, is entitled to be protected from any illegal use by an person,” the DOJ added.

SC upholds abolition of anti-graft office
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesTHE Supreme Court (SC) has dismissed a petition questioning the constitutionality of an order that abolished the Presidential Anti-Graft Commission (PAGC), noting it is within the President’s power to reorganize the Executive department to attain efficiency in governance.
The functions of PAGC were transferred to the Office of the Deputy Executive Secretary for Legal Affairs (Odesla) under Executive Order 13, which was opposed by Prospero Pichay Jr. last year.
Pichay, former chairperson of the Local Water Utilities Administration (LWUA), was once a subject of an investigation in connection with alleged anomalous acquisition of shares of stock in cash-strapped Express Savings Bank in Laguna in 2009.
As a result, the Department of Justice early this year found probable cause to indict Pichay and acting LWUA administrator Daniel Landingin for graft, malversation and violation of the New Central Bank Act.
In a 22-page decision, the Court ruled it is within the prerogative of the President as Section 31 of the Administrative Code of 1987 (EO 292) expressly “vests in the President the authority to reorganize the offices under him in order to achieve simplicity, economy and efficiency.”
The Court, in a decision written by Associate Justice Estela Perlas-Bernabe, said that both offices, PAGC and Odesla, belong to the Office of the President.
The Court held the reorganization only ordered the establishment of an investigative and adjudicatory division through which Odesla could take on the additional functions it has been tasked to discharge under EO 13.
Moreover, EO 13 will not usurp legislative power to appropriate funds even if it does not allocate a specific amount for Odesla in the annual budget of the Office of the President since the Constitution allows the Chief Executive to use savings for its respective offices.
Neither does EO 13 encroach upon the jurisdiction of the Office of the Ombudsman since the graftbuster’s task is to investigate and prosecute criminal cases to be taken up by the Sandiganbayan while Odesla only deals with administrative cases, the decision stated.
The Court said the authority of the Ombudsman to investigate elective and appointive officials in the government is not exclusive, which paved the way for Malacañang and the DOJ to probe Pichay.
Moreover, it said that along with the President’s power to remove and/or discipline presidential appointees comes the authority to investigate such public officials.
