MANILA, Philippines – The Office of the Ombudsman has affirmed the dismissal of a plunder case filed against former President Gloria Macapagal Arroyo in connection with the alleged questionable sale of a 54.5-hectare property near the Iloilo Airport in 2007.
In a 19-page resolution, Ombudsman Conchita Carpio Morales approved the resolution of the Office of the Prosecutor General on Jan. 20, 2011 dismissing the plunder case against the former President, former foreign affairs secretary Alberto Romulo, former executive secretary Eduardo Ermita, former finance secretary Margarito Teves, former Finance Privatization Council head John Philip Sevilla and Andrew Tan of Megaworld Corp. for “utter lack of merit.”
Overall Deputy Ombudsman Orlando Casimiro, Preliminary Investigation Administrative Adjudication and Review Bureau Director Mary Antonette Yalao and Graft Investigation and Prosecution Officer 1 Francis Euston Acero also signed the ruling.
The ruling was issued after reviewing the findings of the Department of Justice, which also recommended the junking of the complaint filed by one Danilo Lihaylihay for the sale of the property to Megaworld Corp.
In dismissing the complaint, Morales said the complainant failed to present proof of the second element of plunder, which is the acquisition of ill-gotten wealth.
“A cursory look at the allegations made by complainant Lihaylihay shows that he did not allege, much less present any evidence, that either respondent Arroyo, Romulo, Ermita, Teves or Sevilla acquired ill-gotten wealth in the manner described under Section 1(d) of the Anti-Plunder Law,” the anti-graft agency said.
Morales added that complainant’s allegation that there was conspiracy among the respondents in the acquisition of ill-gotten wealth, “is an act of sophistry that the law does not support.”
“At the end of the day, there is absolutely nothing on record that supports a finding that a public officer was the ultimate beneficiary of the sale of the Iloilo Airport,” she said.
Lihaylihay filed the complaint for the alleged failure to assess, levy and collect the capital gains tax from the sale of the Iloilo Airport to Megaworld Corp. which the complainant said constitutes theft of public funds and should be considered plunder.

TRO on gov’t takeover of Camp John Hay extended

MANILA, Philippines – A Baguio City court has extended indefinitely its temporary restraining order (TRO) preventing the Bases Conversion and Development Authority (BCDA) from taking over the establishments, facilities and administrative offices of Camp John Hay Development Corp. (CJHDevCo).
Baguio City Regional Trial Court Branch 7 Judge Mona Lisa Tiongson-Tabora granted the motion of CJHDevCo for the extension of the TRO.
The TRO compels BCDA to observe the status quo of CJHDevCo’s rights as a lessee of Camp John Hay and ensures the continuity of operations of various locators and businesses in the former American rest and recreation center.
CJHDevCo welcomed the ruling, saying it would assure tourists and residents of Baguio City that they could continue to enjoy the amenities at Camp John Hay.
CJHDevCo said they sought a court injunction after receiving reports that BCDA is preparing to the take over of Camp John Hay.
The Baguio City court earlier granted the appeal of CJHDevCo for the extension of the 72-hour TRO issued by Executive Judge Iluminada Cabato for another 17 days starting Jan. 28.
The court restrained the BCDA from forcible occupation or ejectment of CJHDevCo from its management of Camp John Hay Golf Club, the Manor Hotel, Camp John Hay Suites Hotel and its administrative offices, as well as key utilities and facilities, including its water source. It also stopped the government agency from taking over the leased property or award rights in the property to a new entity or developer.
Meanwhile, CJHDevCo denied the charges filed by BCDA with the Department of Justice that it had illegally occupied a portion of the former US recreational facility.
CJHDevCo said the criminal case filed against its officials by BCDA was part of the “strong-arm tactics, including continued harassment and intimidation being employed by the state-run firm to justify the illegal takeover of the contested property.”
CJHDevCo, which has poured in close to P3 billion in development projects, including the Manor Hotel, denied BCDA’s allegations that it illegally occupied some 600 square meters of prime land near a sewage treatment plant within the John Hay Special Economic Zone.
“As far as we are concerned, there is no squatting here,” CJHDevCo chief operating officer AlfredoYniguez said.
Yniguez said the facilities BCDA claimed to have been illegally constructed are within the 247-hectare area that CJHDevCo has been developing.
BCDA filed a criminal complaint against CJHDevco and Warbird Security and Investigation Agency for “professional squatting” and required them to dismantle their structures at Camp John Hay.
BCDA alleged that CJHDevco built housing units for their guards and K-9 units without BCDA’s consent.
Yniguez,however, said that what Warbird Security and Investigation Agency erected were outposts and other temporary security facilities to protect Manor Hotel and other vital facilities in the CJHDevCo area.

Soon, Land Transportation Office (LTO) enforcers will spray soapy water on “colorum” public utility vehicles or those that are unregistered or operating out of their designated route.
“We will clean the streets of Metro Manila even if it takes soaping violators down to remind them that commuters deserve services that are ‘clean,’ meaning they are legitimate and roadworthy,” said LTO-National Capital Region director Teofilo Guadiz III.
Recently, Guadiz reconstituted the Regional Law Enforcement Group and augmented their numbers by tapping people from the LTO’s district offices.
He has ordered the RLEG members to intensify their operations against colorum vehicles.
“These illegal practices do not only make a mockery of our laws but also cause the congestion of our thoroughfares and dilute the income of legitimate public utility operators and drivers,” he said.
Guadiz said the LTO was able to apprehend a total of 382 colorum vehicles during the second half of 2011, and 30 colorum vehicles for this month alone.
“Four were physically impounded for violation of illegal transfer of plates and one for (car theft) charges,” he said.
The LTO-NCR also launched hotline numbers 438-8688 and 0915-5832662, through which concerned citizens can report illegal terminals and colorum operations.

Defense’s turn to present evidence, witnesses

MANILA, Philippines – It is now the turn of the defense lawyers of Chief Justice Renato Corona to present their own evidence to convince 23 senators, sitting as impeachment court judges, to absolve the embattled magistrate.
Defense spokesman, lawyer Tranquil Salvador III, said they will now be given the chance to contest the pieces of evidence presented by the prosecution on Articles 2, 3, and 7 of the impeachment complaint against Corona.
“The defense will also be given an opportunity to file our objections or comments to such exhibits. The (Senate impeachment) Court will have to then rule on whether or not some or all of those exhibits are admissible,” Salvador said.
Iloilo Rep. Niel Tupas Jr. formally manifested before the end of the 25th day of the impeachment trial yesterday that they are withdrawing Articles 1, 4, 5, 6 and 8. The prosecution will not rely on only the three charges to convict Corona.
Tupas said the prosecution has presented 17 witnesses for Article 2, one witness for Article 3 and seven witnesses for Article 7 for a total of 25 witnesses.
The prosecution has marked 166 documents for Article 2, another 16 for Article 3 and 65 for Article 7 for a total of 397.
Tupas said their presentation for Articles 3 and 7 already proved Corona was guilty of betrayal of public trust.
For Article 2, Tupas said they have shown the chief magistrate was guilty of both betrayal of public trust and culpable violation of the Constitution.
One of the allegations in the articles of impeachment submitted to the Senate impeachment court is Corona’s alleged dishonesty in filing his Statements of Assets, Liabilities and Net worth.
The prosecution presented to the court peso bank accounts of Corona, which indicated that the magistrate failed to fully disclose his wealth in his SALN.
Salvador said they would have 10 days to go over the pieces of documentary evidence submitted by the prosecution.
“A period of 10 days may be needed for this aspect of the trial and then we, the defense, will start presenting our evidence,” he said.
For his part, lawyer Rico Quicho, another defense spokesperson, claimed that the termination by the prosecution panel of its presentation of evidence and witnesses only proves that it has a weak complaint against the Chief Justice.
“It further strengthened our view that the prosecution actually had no evidence from the start which they only gathered during the trial itself to cover only 3 articles,” Quicho said.
16 guilty votes
Senate President Juan Ponce Enrile, acting as presiding judge of the impeachment court, said in a radio interview that all 23 senators will vote on each of the three articles of impeachment right after the presentation of the defense and the rebuttal evidence of the prosecution have been concluded.
He said that after the Defense’s presentation of their own witnesses and evidence, the prosecution will be given another chance for rebuttal.
He said that the senators will vote on the three articles of impeachment once “the case is already submitted.”
“Ibig sabihin tapos na ‘yung depensa na magpresenta ng ebidensiya at wala nang maipepresentang rebuttal evidence ‘yung prosecution,” Enrile said.
On the day of the voting, Enrile said that the defense and the prosecution may be given one hour each to reiterate their arguments on the case.
“Pagkatapos noon, botohan. Wala nang isusulat na desisyon,” he said. “Bawat isa ay huhusgahan ‘yung nasasakdal. Bawat isang senador. Bibilangin kung ilan ‘yung boboto ng guilty sa nasasakdal at ilan ang boboto ng not guilty.”
Enrile said that the prosecution needs to get 16 guilty votes from the impeachment court to convict Corona.
“Kahit may bakante, 16 pa rin. Hindi mababago ‘yun,” Enrile said.

Sereno likely to defy Supreme Court, says Palace

Palace officials on Tuesday said it was likely Associate Justice Lourdes Sereno would defy the Supreme Court and testify against Chief Justice Renato Corona, saying she has a firm sense of right and wrong.
A day after the Senate impeachment court rejected a prosecution motion to subpoena Sereno in a bid to avert a confrontation with the high tribunal, the House panel on Tuesday sent Sereno a formal invitation to appear in today’s trial.
“We understand the difficult position that you are in and we will strive to do our best to protect your right and dignity during the presentation,” Representative Neri Colmenares said in a letter to Sereno.
A member of Sereno’s staff, Zaldy Trespeses, said the justice had been on medical leave but was due back today. “She has given no indication if she’s going to attend or not,” he said.
“I trust and expect Justice Sereno to act as her conscience and understanding of the Constitution dictates,” Ronald Llamas, presidential adviser on political affairs, said in a text message to the Inquirer.
Truth, accountability
“I think it should be apparent from her written opinions that she is a person with a very firm personal sense of what is right and wrong,” Llamas said.
Budget Secretary Florencio Abad added in a text message to the Philippine Daily Inquirer: “Sereno can assert that, in the hierarchy of values, truth and accountability are supreme over institutional prerogatives.”
The prosecution wants Sereno to elaborate on her dissenting opinion on the court’s majority decision in issuing a temporary restraining order (TRO) on Nov. 15, 2011, against a government ban on travel abroad imposed on former President and now Pampanga Representative Gloria Macapagal-Arroyo. Sereno said that the TRO was evidence of Corona’s partiality toward Arroyo.
The prosecution’s invitation to Sereno coincided with a court order prohibiting two employees from testifying before the Senate tribunal. The employees were tasked to deliver the November 15 TRO.
Judicial privilege
“The court will be issuing a resolution expressing its sense that it is not waiving its judicial privilege on this matter,” said its spokesperson, Midas Marquez.
“The court issued a resolution on February 14 saying that the court has judicial privilege, especially in so far as pending cases are concerned,” he added.
Senators Francis Pangilinan and Franklin Drilon, stalwarts of the ruling Liberal Party, urged Senate President Juan Ponce Enrile to secure compliance of the two employees to the subpoena, which Enrile agreed to discuss in a caucus on Monday.
Drilon also moved to discuss in the caucus a defense motion to exclude illegally acquired bank evidence against Corona.
“Unless we assert the primacy and supremacy of the impeachment proceedings,” Pangilinan said, “the sole power to try and decide impeachment cases becomes fiction.”
Justice Secretary Leila De Lima has filed a motion in the Supreme Court to set aside its TRO, which she had ignored. She testified last week on Sereno’s dissenting opinion.
Enrile, the presiding officer, has ruled De Lima’s testimony was hearsay because she was not a member of the high tribunal, but nevertheless agreed to put her statement on the record.
The impeachment court ruled that the Sereno dissenting opinion was a matter of public record and was the best evidence on the issue.
Asked if he thought Sereno’s nonappearance in the impeachment court would be fatal to the prosecution case, Abad said, “No, not necessarily.”
“The dissenting opinion of Justice Sereno and Justice (Antonio) Carpio, including Sereno’s exposé of the irregular issuance and premature public declaration of the effectivity of the TRO are matters of judicial notice,” Abad said. “As evidence, they can be referred to.”
Context of anomalies
Abad said Sereno’s personal testimony “would have made these more emphatic and would have afforded the public more details about context and circumstances of these anomalous acts of the Supreme Court and the Chief Justice.”
“That would have dramatized vividly the connection between the Chief Justice’s illegal appointment and the Chief Justice-led majority’s frustrated attempt to enable Arroyo to escape prosecution via the TRO,” Abad said.
President Benigno Aquino III on Tuesday voiced hope that court employees would at least be allowed to testify.
“In the case of Supreme Court justices, I think they will be treated as a coequal and that has been the tradition and practice. A subpoena says you have power over somebody and if you are coequals, it would indeed be difficult to summon your coequal. You may invite,” the President told reporters.
“If what we’re trying to prove could be culled from others, who are not on a coequal basis, like the employees, I hope this could be allowed,” Mr. Aquino said.
Enough proof
Mr. Aquino declined comment when asked whether he hoped that Sereno, his first appointee to the Supreme Court, would testify against Corona.
“If she goes there, it could be said that I ordered her to go…. I don’t think there is a correct answer to that question. I hope you understand,” he said.
“I believe a good amount of evidence has already been presented,” the President said.
“Much has been proven when we talk about culpable violation of the Constitution or betrayal of public trust or even the issues about wealth,” he added.
“So any of the eight articles—any and all—any of them is at least enough to achieve the necessary objective.”
