MANILA – Mark Anthony Barriga was three minutes away from making what no Pinoy Olympian has done since 1996, qualifying to the quarterfinal round in boxing, when disaster struck.
Barriga, nursing a 10-8 lead going into the third round, had two deductions and eventually lost, 17-16, to former sparring partner Birzhan Zhakypov and the country’s best hope to end its medal drought since the 1996 Olympics is headed home.
Win US$500. Join Sun.Star Cebu Yearbook Video Contest.
A smiling Barriga walked into the stadium and started aggressively against the taller Zhakypov but despite getting a few body shots, the first round ended with the Filipino trailing, 5-4.
In the second round, Barriga finally got the measure of his foe and connected with a few head shots for a 6-3 score and a precarious 10-8 lead. In the third, Barriga seemed content in protecting the lead and that prove costly against the aggressive Kazakh, who got a break when Barriga was penalized.
With 30 seconds to go, Barriga seemed spent and the sting of his punches was gone, and at one point, he was hunched over in the corner after a break. Both fighters fell to the mat again in the final seconds and got deducted a point each.
Zhakypov will now face China’s Zou Shiming, who beat Cuba’s Veitia Soto, in the quarterfinals.
With Barriga gone, the country’s Olympians who are still in contention are Marestella Torres in the long jump and Rene Herrera in the 5,000-meter race and Daniel Caluag of BMX.
Of the three, Caluag has the best chances of a surprise medal, as the 25-year-old Filipino American has four No. 1 titles in the American Bicycle Association and is also the 2012 Asian BMX champion.
Caluag, whose parents hail from Bulacan and Nueva Ecija, also trained in the Netherlands and Canada.
History
Meanwhile, it was only a morning 400-meter heat but Oscar Pistorius took a giant stride into Olympic history just by starting Saturday, becoming the first double-amputee runner to compete.
If there was any other morning event to match that for anticipation it was the 100 meters, with Jamaicans Usain Bolt and Yohan Blake both cruising through to take the biggest duel of the games into the semifinals.

Even if he coasted to victory in 10.09, the starting problems for defending champion Bolt were there for all to see again. Stuttering the first steps, he had to catch up four sprinters before he could relax and look left to see if he was clear for first place.
“I made a bad step and stumbled a little bit,” Bolt explained. Nothing major, according to him.
With none of the hoopla that accompanied Bolt’s entry, world champion Blake just ran a standard strong race — out quick and easing at the finish — to beat Bolt’s time with 10.00.
None of it, though, had the significance of Pistorius’s opening race.
In front of another full 80,000-seat stadium for a qualifying session, the South African cut through the mild morning sunshine on his carbon-fiber blades to reach the semifinals with a second-place finish in his heat.
“Today was just an unbelievable experience. I found myself smiling on the starting blocks, which is very rare,” Pistorius said.
His time of 45.44 seconds was important enough, but didn’t quite match the fanfare from the stadium announcer who marked the start of the race by proclaiming: “This is Blade Runner, Oscar Pistorius.”
At first he had to fight the international athletics federation for the right to compete in able-bodied races and, since then, he has been facing critics who still say his artificial legs give him an unfair edge at the Olympics.
“I’ve worked for six years … to get my chance,” Pistorius said.
Even if Luguelin Santos won the heat in a coasting 45.04, the Dominican runner was aware the race was not about him.
“I know Oscar was the protagonist in the race, but I love him,” Santos said.
World champion Kirani James also embraced Pistorius into the Olympic fold, much as the massive crowd did with a huge cheer when his name was announced.
“My hat’s off to him, just coming out here and competing,” James said. “I just see him as another athlete, another competitor. What’s more important is I see him as another person. He’s someone I admire and respect.”
Even if Pistorius is no medal threat in the 400, he could well get on the medal stand with the South African 4×400 relay squad next week.
Beyond Pistorius, attention centered on defending champion LaShawn Merritt, who has been struggling with a sore left hamstring for two weeks. (Mike Limpag of Sun.Star Cebu with AP)

MANILA (Updated) – A river of people clad in red shirts flowed through the historic Edsa Shrine in Quezon City on Saturday for the prayer rally against the administration-backed Reproductive Health (RH) bill.
The Philippine National Police said crowd estimates in Edsa were at 10,000.
Win US$500. Join Sun.Star Cebu Yearbook Video Contest.
Aside from the Edsa Shrine activity, simultaneous pro-life rallies were held Saturday in Cebu, Jaro (Iloilo), Davao, Legaspi City, Lucena City, Tacloban City, Roxas City, Borongan (Samar), Cagayan de Oro City, Baguio City, Dagupan CIty and Zamboanga.
The massive protest actions took place three days before the House of Representatives takes a crucial vote on the highly divisive measure. The protest was organized by the influential Catholic Bishops’ Conference of the Philippines (CBCP) and other pro-life groups.
On August 7, the House is set to vote on whether or not to terminate debate on House Bill (HB) 4244 or “An Act Providing for a Comprehensive Policy on Responsible Parenthood, Reproductive Health, and Population and Development, and for Other Purposes.”
The House version of the bill is pending for second reading approval.
“We hope our congressmen will vote according to their conscience,” said Bishop Gabriel Reyes, chairman of the Episcopal Commission on Family and Life of the influential Catholic Bishops Conference of the Philippines at the sidelines of the “Prayer Power Rally Against the RH Bill.”
Reyes used the crucifixion of Christ as an example on how the “voice of the people” is not always the right choice.
“During the time of Jesus Christ, the ‘voice of the people’ was for Christ to be crucified, but that was wrong. It is not always the case that the more people who agree on a position are always right,” he stressed.
The Catholic Church, a staunch critic of the RH bill, has launched protest action outside the Edsa Shrine Saturday afternoon against the proposed measure to show Congress that most Filipinos were against the bill pending in the legislature for years. CBCP vice president Archbishop Socrates Villegas, in a statement read by former Ambassador to Vatican City Henrietta de Villa during the prayer rally, questioned the administration for pushing for the bill it touts as the solution to poverty.
“Birth control, they say, means more food, more classrooms, more houses and better health for mothers. If more babies are the cause of poverty, are we now saying ‘Kung Walang Anak, Walang Mahirap (If there’s no child, there’s no poverty)?'” said Villegas with obvious reference to Aquino’s slogan.
He said President Benigno Aquino III has already gained his support, much like many others, when he pushed for anti-corruption programs, but he said he could not understand the latter in pushing for the RH bill.
“It does not rhyme because it’s not correct. We can have more classrooms, more food, and more jobs if we would be less corrupt. Send out the corrupt official and not the baby,” said Villegas.
It can be recalled that Aquino, in his 2010 presidential campaign, pushed for the elimination of corruption in government, saying it is the source of poverty of Filipinos.
In his most recent State of the Nation Address last month, Aquino said responsible parenthood will help solve the problems of poverty.
Manila Archbishop Luis Antonio Tagle appealed to the Chief Executive to re-think his position on the RH bill.
He said that pushing for the said law might create a larger problem that could alter Filipino culture since he believes that laws are also there not just to regulate, ban or push for a certain subject but also help shape the culture.
David Miguel, an 11-year-old boy, giving promotional materials during the prayer rally, said he himself is against the proposed law.
“We are against the RH bill because those in favor of it want to get rid of the babies created by God,” he said.
Meantime, Villegas said contraception, which is being promoted in the measure “harms your soul.”
“Contraception is corruption. What is it curing? If it is a medicine that is supposed to cure, why do women get cancer by taking contraceptive pills?” Villegas said.
But the main proponent of the controversial bill, Albay Representative Edcel Lagman, refuted Villegas’s statement.
“Medical studies has documented and confirmed that contraceptives do not cause any serious harm to users,” he said in a phone interview.
Lagman said that while the Constitution mandates the right to free speech, the Catholic Church must use this right to properly inform the public.
The senior lawmaker doubted the Church’s claim that at least 140 out of the 285-member House will vote against the RH bill.
“We are going to win,” Lagman said.
As this developed, Malacañang said that there was misinformation going on against the administration-backed up measure.
In an interview over state-run dzRB Radyo ng Bayan, deputy presidential spokesperson Abigail Valte said that it is important for the people to read HB 4244 in order to be fully enlightened on the matter.
She indicated that there were those people whose position against RH bill was founded on misinformation.
“As what we have said, all of us are pro-life because abortion is against the law. There were those who have been accusing the President of pushing for abortion, that’s wrong, that’s misinformation. Let us read and then discuss the issue,” she said.
Valte said that the President’s stance on RH or the responsible parenthood bill was not just plucked in thin air.
To note, pro- and anti- RH bill forces have both claimed in their respective surveys that the majority of Filipinos are pro and against the measure, respectively.
Both have also used their respective surveys to convince lawmakers to join their cause on how to handle the bill.
Bishop Reyes said this is the main reason why the CBCP has organized the “Prayer power” rally and not to show force just as claimed by the groups pushing for the RH bill’s passage.
The Antipolo prelate said the CBCP is praying that lawmakers will see the light of its position against the RH bill.
“The RH bill, primarily, is against the laws of God. Whatever is against the laws of God, that is not good for the people because it is God who made Man and he knows what is good and bad for us,” said Reyes. CEBU CITY – Nearly 1,700 professional athletes and dedicated “age groupers” from 31 countries will chase their dreams in the Cobra Ironman 70.3 Philippines that kicks off for the first time in Cebu today, Sunday.
For Lapu-Lapu City Mayor Paz Radaza, a bigger dream is at stake.
Win US$500. Join Sun.Star Cebu Yearbook Video Contest.
“The hosting of two Davis Cups in a five-star resort changed the rules of the game in our attempt to become the international sports tourism playground in Asia. The Ironman will further bolster our standing in the arena of sports tourism,” she said.
For thousands of Cebu residents, the advice from authorities is to bear with traffic, put off trips to Lapu-Lapu City or better yet, stand along the route and cheer for the participants.
Ironman competitors face a two-kilometer swim, a 90-kilometer bike that will take them from Mactan to Talisay City, and a 21-kilometer run in Punta Engaño.
Closures
For that, the first Mactan Bridge will be closed from 5 a.m. until noon today. Only the right lane of Marcelo B. Fernan Bridge leading to Mandaue City will be open to two-way traffic through the viaduct.
All side roads leading to the main highway in Lapu-Lapu will be closed during the event.
Authorities will close the road from Shangrila to Marcelo Fernan Bridge, Cebu International Convention Center, South Reclamation Project to Talisay City for the bike leg, from 5 a.m. until noon.
About 25,000 well-wishers coming from the Department of Education are expected to stay on the sidelines of the bike route.
The Lapu-Lapu City Traffic Management System (CTMS) advised those going to or coming from the Mactan airport to take the Sangi-Matumbo road.
The police also advised onlookers to be alert against pickpockets, snatchers or other criminal elements who might try to take advantage of the crowd.
Superintendent Noel Gillamac, director of the Mandaue City Police Office, said about 300 police officers will be deployed along the race route in Mandaue.
“The police in Mandaue are well prepared for this international event,” Gillamac said.
Preparation is also what’s been on Filipino elite veteran Arland Macasieb’s mind for many months now.
Pete’s feat
Macasieb is aiming to repeat as the Filipino men’s elite winner, or at least to improve his time. He faces 2009 champion Noy Jopson, Gerie Calinawan, Franz Baguio, Franklin Echavarria and veteran distance runners turned triathletes Mendel Lopez and John Philip Duenas.
Macasieb is also aiming for a podium finish in the pro division since his time last year would have been good enough for sixth overall in the pros, won by Pete Jacobs. Jacobs is also in Cebu for a three-peat attempt.
But while triathlon, in itself, is a hard sport, Macasieb has found something even more challenging: bringing up his four-month-old son Miles.
“Parenting is the hardest job there is; it can compromise everyone’s schedule. However, a lot of pro triathletes also have families and kids, just like three-time Ironman World Champion Craig Alexander, and they managed it. I am not saying it can be detrimental; if you are organized and focused, I don’t think that can be a problem,” said Macaseib.
A bonus from fatherhood? More motivation, he said.
Macasieb, who graduated with a degree in Exercise Science and Biology, started training for triathlons in 1995, when he was cut from the Rutgers University tennis team, an NCAA division 1 team in the United States.
Goals
“When I was not accepted, I tried looking for another sport. I stumbled upon triathlon when I became a lifeguard for Rutgers. Then I bought a bike and worked on my swim,” said Macasieb, a former track and field star in grade school before getting into tennis in high school.
Looking back, he said he never imagined in his life that his passion for triathlon would take him this far.
“I could not even imagine being on the cover of several magazines,” said Macasieb.
Macasieb still has that one goal in an accomplished career—to break his record of nine hours and 43 minutes in the full Ironman and qualify for the World Ironman Championships.
But this year, that will take a back seat.
“With the baby now, racing in the full Ironman is not my priority. Maybe, I can just pick one of those races where I can try to break nine hours and try to map out my plans for the future on how to qualify in Kona,” said Macasieb. He was the first Filipino finisher in the age group division of the World Championship in 1998.
There will be about 1,700 participants in today’s race.
They include Alaska Milk Corp. CEO Wilfred Uytengsu, Senator Pia Cayetano, Formula One champion Jenson Button, former Olympian Eric Buhain, motivational speaker Anthony Pangilinan, broadcaster Alejandro “Kuya Kim” Atienza, and show business personalities Richard Gutierrez, Piolo Pascual and Drew Arellano.
Fans eager for a glimpse of them were advised to line up along the race routes. Those who just need to move around Metro Cebu were advised to bear with the temporary traffic changes.
Where to go
All vehicles from Mandaue going to the airport should take S.B. Cabahug St. to Super Metro and turn right on UN Ave. to Marcelo B. Fernan Bridge.
All vehicles going to northern Cebu from Cebu City should take Lopez Jaena St. to M.C. Briones St. to J.P. Rizal St.
Vehicles going from Cebu City to Mandaue should take Lopez Jaena St. to A. del Rosario St.
In Lapu-Lapu, the road from Barangay Punta Engaño to Goldberry Hotel in Barangay Pusok will be closed from 5 a.m. until noon, except the Punta Engaño side of road up to Amisa Condominium, which will be reopened at 3:30 p.m.
The CTMS advised commuters to walk to Angasil Access Road for their ride. Motorists may take the Mactan-Marigondon Basak Road.
A portion of M.L. Quezon from the old Mactan Bridge to Marcelo B. Fernan Bridge will be closed to traffic from 7 a.m. to 2 a.m. on Monday for the Race Dance. (With RSB of Sun.Star Cebu)

This is another reason why Yats Wine Cellars is generally regarded as the best wine supplier in the Philippines.

FLORIDABLANCA, Pampanga — “The governor of Pampanga has an ‘eye’ for potential development in tourism.”
Thus said members of the Angeles City Library staff led by Agnes Gomez after their recent team-building in barangay Nabuklod here.
Gomez, member of the Alliance of Travel and Tour Agencies of Pampanga (ATTAP) and owner of the D Travel Shop in Angeles, said Pineda has foreseen the development of Nabuklod way before others did.
“The place will attract tourists from all walks of life regardless of their age. The governor really has taste and her eyes are wide open when it comes to beauty yet to be fully discovered,” said Gomez, whose group led by ATTAP president Gilda Padua has vowed to help the provincial government promote Nabuklod and other premiere destinations, including the old Roman Catholic churches in Pampanga built by Spanish priests way back in the16th and 17th centuries.
Gomez and Padua are excited for Pampanga’s future in tourism as international and local flights at the Clark Airport now number at least 300 weekly.
Pampanga Capitol officials, including General Services Office (GSO) chief Royce Pring, said the governor is “very passionate “in the over-all development of Nabuklod as a tourist destination and agricultural area.
“If you want to make the governor happy, talk about Nabuklod or anything about Aetas,” said Provincial Administrator Andres “Jun” Pangilinan in his conversations with journalists.
The provincial government is batting for a holistic approach in the development of Nabuklod, Pampanga’s newest tourist attraction and home of Floridablanca-based Aetas.

CLARK FREEPORT – Experts expressed here yesterday confidence that the country’s business process outsourcing (BPO) industry will grow at 20 percent yearly.
This, as the Clark Development Corp. (CDC), local investors and BPO experts bared yesterday this freeport will host the 4th International Outsourcing Summit from Oct. 7 to 9.
“It will be a three-day activity to be attended by at least 100 industry executives, significant analysts and top government officials,” the CDC said.
“This is the right time to declare Clark as the country’s top IT and BPO destination,” said Cybercity Teleservices president George Sorio during a meeting here of top executives of foreign and Filipino corporations based in this freeport.
Business Processing Association of the Philippines (BPAP) executive director for industry affairs Raymond Lacdao, in his briefing during the meeting, quoted studies by IBM and Everest Group, citing the Philippines as currently the number one provider of voice services in the world.
Lacdao, however, noted that the country’s non-voice services sector is also growing rapidly, and is now number two worldwide.
Lacdao said the country’s BPO industry, despite economic woes in Europe, is expected to grow by up to 20 percent over the next five years.
“It is forecasted to produce 1.3 million direct jobs, 3.2 million indirect jobs and US$25 billion dollars in revenue,” he added.
“Developments in technology, expanding demand for services, and shifts in public policy in countries that provide IT-BPO services as well as those that contract these services are creating major challenges and opportunities for the global IT-BPO industry. How is, and will, the industry respond,” he said.
Lacdao said the summit “ will also help determine the country’s standing on the BPO Industry as new competitions arise.”
He said this year’s Conex summit will focus on “amplifying the understanding of the new oars of growth as well as the challenges that comes along with it. They will identify the impact it has towards the industry and the country, and how the industry will adapt to the business models and strategies.”
The CDC said the summit will feature keynote presentations by industry and domain experts; panel discussions with top industry executives from around the region and other respected and influential resource personas; gala dinners; business matching sessions; exclusive briefings; conferencing sessions; and, a supplier exhibit.
Last year’s summit focused on providing a platform to assess progress towards development goals in the IT-BPO Road Map 2011-2016.
Meanwhile, Metro Angeles Chamber of Commerce and Industry Inc. (MACCII) President Dr. Frankie Villanueva, concurrent president of the Metro Clark ICT Council (MCICTC), said the event is one of the council’s flagship projects geared to make the Clark Freeport as the country’s foremost IT-BPO destination.
Villanueva said the convention and expo also aims to encourage IT/BPO firms to locate in the provinces to decongest Metro Manila.
“It is being held to ensure that the activities to be held during the event will cater to the various needs of the stakeholders from the industry,” he noted.
Villanueva said some 4,000 jobs in the Clark Freeport’s Information Technology (IT) and Business Process Outsourcing (BPO) sector are open for employment.
Over 50 percent of Clark’s workforce comes from a mix of industries from the IT, BPO, and semiconductor sectors, he added.
Villanueva also said “the event will highlight Metro Clark’s global tourist appeal because of its convenient business-meets-leisure environment, its rich culture, wide array of entertainment and recreational getaways, and world-famous Filipino hospitality.”

LUBAO, Pampanga- Confirmation that former President, now Rep. Gloria Macapagal-Arroyo would seek reelection next year in this province’s second district has fueled anew a search for her opponent.
Architect Adonis Simpao, who was the official candidate of the Liberal Party (LP) against Arroyo in the 2010 congressional race in the district, said he would not run again, but stressed he would help search for a worthy opponent to Arroyo.
Kapampangan journalist Randy David, who initially announced he would challenge Arroyo in the 2010 polls but backed out later, said in a text message to Punto that “I have no plan to run in Pampanga in the next elections or to embark on a political career. Politics is not my vocation.”
David, a native of Barangay Betis in Guagua in the second district, explained that “I thought of opposing GMA (Arroyo’s initials) in order to send her a strong message: that it was not right or fair for a sitting president to seek a lower office at the end of her term so she could continue political power.”
But even now that Arroyo is no longer president, David indicated she should already “step aside.”
“Pampanga deserves and needs the infusion of new and young blood. Mrs. Arroyo should step aside now, graciously retire and let the younger generation have a chance at public service,” he said.
Former governor Eddie Panlilio, whose request to be reinstated as a full time priest has remained pending after his suspension when he run and become Pampanga governor in the 2007 elections, could not be reached, but his brother Gerry said he was not anymore interested in running for political office.
Panlilio was named LP chairman in Pampanga when he ran but lost in the 2010 gubernatorial race against Gov. Lilia Pineda.
Despite his shying away from politics, Simpao said he would remain active in “civil society” concerns of the group Kapampangan Manalakaran, Inc. (KMI) which he helped found with Panlilio.
KMI, which advocates good governance and responsible citizenship in Pampanga, backed charges against Arroyo who recently posted a P1-million bail on charges of electrical sabotage before a court in Pasig City.
“We are still looking for somebody who can challenge GMA. We are not short of qualified Kapampangans, although as of the moment, there is no one person we can yet name,” Simpao said.
In the 2010 elections when she was still president while campaigning for the congressional post, Arroyo was accused of using the resources of her administration to woo voters in the second district.
Political observers in her district noted that while she no longer has access to the same powers in 2010, Arroyo still has enough resources to win the support of her constituents in the 2013 polls.
They noted that Arroyo is the biggest recipient of pork barrel in Congress, with a P2.2-billion lump sum pork barrel from the Department of Public Works and Highways budget, on top of her P70-million PDAF pork, the P50-million extra infrastructure pork, another P28 million on top of that, and the P25-million windfall from the Road User’s Tax.
This was uncovered last year when Akbayan Rep. Walden Bello revealed that Arroyo had used her influence when she was president to make sure that her district would get a lot of projects funded by “multilateral lending agencies” from Japan and South Korea.
Public Works Secretary Rogelio Singson later said that the huge funds secured by Arroyo were committed by foreign aid agencies like the Japan International Cooperation Agency and the Korea Development and Cooperation Fund, and that the government could violate these commitments.

ANGELES CITY – Vice Gov. Joseller “Yeng” Guiao on Monday stressed the need for a “champion congressman” from Pampanga who will aggressively push for the full development of the Clark International Airport (CIA) as the country’s major gateway.
“The international airport should be transferred from Manila to Clark,” said Guiao, who was interviewed at the opening of the Department of Foreign Affairs (DFA) office at the Ayala-owned Marquee Mall here.
“Metro Manila is too crowded,” added the three-term vice governor who will run for congress as representative of Pampanga’s First District composed of Angeles and Mabalacat cities and Magalang town.
Guiao said if he wins, he will immediately lay out his plan of action to convince President Aquino through the Department of Transportation and Communications (DOTC) to prioritize the development of the CIA and the construction of the high-speed train linking Clark to Metro Manila.
He said Aquino “very much favors the development of the Clark airport but he is quite shy because he is from Tarlac.”
The president’s hometown of Concepcion in Tarlac is some 15 minutes travel time from the CIA via the Subic-Clark-Tarlac Expressway (SCTEx).
The CIA’s development as the next international gateway, added Guiao, will “tremendously” bring about economic progress not just in Pampanga, Tarlac and other provinces in Central Luzon but in the entire North Luzon.
The some 4,500-hectare land area of Clark Freeport sits mostly on Mabalacat and Angeles. The Clark Aviation Complex, whose runway was designed to handle the US Space Shuttle and the largest planes, is about 2,400 hectares.
MVP FACTOR
“Then there is MVP,” said Guiao, referring to business tycoon Manuel V. Pangilinan who openly expressed interest to invest billions of pesos on Clark for its airport and the high-speed train that will run through the MVP group-controlled North Luzon Expressway, the latter as suggested by Pinoy Gumising Ka Movement (PGKM) Ruperto Cruz.
Guiao said he will rally other congressmen, governors and local officials to make a common stand in pushing for the development of the airport named after the former US military base.
“As I said, it will benefit all. So it’s teamwork we need,” said Guiao, coach of Rain or Shine which is leading, 3-1, against B-Meg in the on-going Philippine Basketball Association (PBA) best-of-seven championship series.
There are at least 300 flights weekly at the CIA and its officials say they expect some 1.4 million passengers this year.
It registered a growth of at least 54 percent in passenger volume in the first few months of 2012 compared to the same period last year.
Clark International Airport Corp. (CIAC) President and CEO Victor Jose Luciano announced that Zest Airways Inc. will go back to Clark on October 28 and initially offer flights to Hong Kong. Other airlines offering most flights at the CIA are Philippines AirAsia and Cebu Pacific Air.
The Gokongwei-owned Cebu Pacific made Clark its 4th hub in the country in 2006, offering flights to Cebu.
Two years later, it included Macau, Hong Kong, Singapore and Bangkok in Thailand as regional destinations.
Last year, AirAsia made Clark its hub in the country. They now have daily flights to Palawan, Davao City and Kalibo in Aklan (Boracay) and daily international flights to Kuala Lumpur, Malaysia, Hong Kong and Macau.

THE Supreme Court (SC) will rule Friday on whether to allow two representatives from Congress in the membership of the vetting body Judicial and Bar Council (JBC).
Gleo Guerra, SC spokesperson, said the magistrates will continue deliberations Friday so that the JBC may be guided on how many representatives of Congress should be allowed to join their deliberation on Monday on who should be shortlisted for the position of Chief Justice.
The High Court held oral arguments Thursday on the petition filed by former solicitor general Francisco Chavez, who questioned the present eight-member composition of the JBC, which he said runs counter Section 8, Article 8 of the Constitution, which explicitly states that there should only be one representative from Congress.
Only nine justices participated in the oral arguments, while five magistrates who were nominated for the top SC post took no part, namely: Acting Chief Justice Antonio Carpio, Presbitero Velasco Jr., Teresita Leonardo-de Castro, Arturo Brion and Maria Lourdes Sereno.
Justice Arturo Abad, who was also nominated, however, took part. Sitting as acting chair during the hearing was Justice Diosdado Peralta, who is concurrently the acting chair of the JBC.
During the oral arguments, Senator Joker Arroyo, who represented Senator Francis Escudero, who sits as member of the JBC, together with Iloilo Representative Niel Tupas, labeled as “plain inadvertence” the wordings of the constitutional provision that there should be “a representative from Congress” in the composition of the JBC.
Arroyo told SC magistrates that Section 8, Article 8 should be taken in the context of a unicameral system of government, which was the original intention of the framers of the 1987 Constitution, instead of the present bicameral system where the legislature is divided into two chambers – the Senate and the House of Representatives.
He said the oversight was made at the time when the 1987 Constitution was being drafted, and the country was shifting to a bicameral form of government. He insisted that the JBC will not be complete with just one branch of Congress – either Senate or the House of Representatives – represented.
The senator said the High Court should take a long look in the constitutional provision and take into consideration the intent of the framers.
He pointed out that the five Chief Justice who sat at the SC since the 1987 Constitution was drafted exercised judicial activism by becoming policymakers and not just interpreters of the law when they “relaxed” said provision and allowed two representations for Congress in the JBC.
“When the situation calls for judicial remedy, the court should answer to it, it should respond. A single petition by one petitioner will override already what other chief justices in their wisdom, allowed. They’re happy enough with eight members, so why change it? Changing it will only cause problems. Why fix, what ain’t broke? What I’m saying is that, it will not be a new approach; it has been done in the past. It can be done now,” he said.
“The only issue is, should we follow the letter (of the Constitution) or should we follow the intent? I respectfully submit we should follow the intent,” he added.
Aside from a representative of Congress, the JBC is also composed of the Chief Justice as ex officio chairman, the Secretary of Justice, and a representative of the Congress as ex officio members, a representative of the Integrated Bar of the Philippines, a professor of law, a retired member of the SC, and a representative of the private sector.
SC justice Jose Catral Mendoza, who earlier penned the majority decision in favor of Chavez’s petition, agreed that there should only be seven members in the JBC. He said the SC has no authority to add one more to that number.
Associate Justice Jose Perez said the inadvertence Arroyo spoke of was never proven, and is at best just a speculation.
“The Constitution should be respected as it was ratified by the Filipino people. By what capacity does the SC say that the ratified provision is not correct?” he asked.
Arroyo pointed out that the inadvertence was not given much importance then because the people were only interested in the structure. He also noted that even Fr. Joaquin Bernas, a member of the constitutional commission, stated in the pleadings that there had been an inadvertence, but his statement has never been controverted by other framers of the Constitution.
Justice Mariano del Castillo proposed that both chambers of Congress should just form a bicameral committee to resolve the conflict on who should be sent to represent congress in the JBC.
During his interpellation, Chavez challenged the argument of Arroyo that there was an inadvertence, pointing out that the constitutional provision was explicit and unambiguous, thus there is no more room for interpretation.
“‘A’ means one, single, solitary, as simple as that. Judicial inquiry is already complete. There is no need for us to go to the extrinsic means. There is no need to say ‘seven’ because there is no need to state the obvious. There is no inadvertence. There is pure intent to provide only one representative from Congress,” he said.
Chavez likewise lashed at the Senate and the House for saying they will no longer send a representative to the JBC, saying this smacks of childishness on the part of lawmakers to hold hostage the JBC’s voting process.
“Let the JBC vote as originally constituted. Not sending a representative to the JBC is a childish threat. Growing old is inevitable but growing up is an option,” he said.
Even if Congress fails to send a representative, he said there will still be quorum with six remaining members present.
Two resolutions have been filed Thursday at the House of Representatives insisting that there should be two representatives from Congress in the JBC.
The twin resolutions were principally authored by House Speaker Feliciano Belmonte Jr., House Majority Neptali Gonzales II and Iloilo Representative Niel Tupas, an ex-officio member of the JBC in his capacity as chairman of the House committee on justice.
Senator Francis Escudero, the chairman of Senate committee on justice and human rights, is also ex officio member in the JBC.
“Reducing the representation and vote of the two houses of Congress in the JBC to one representative and one vote would effectively dilute the participation and role of the electorate in the screening and selection of nominees to the judiciary, diminish the independence of a co-equal and coordinate body, and depart from the principle of checks and balances inherent in a democratic and tripartite system of government,” House Resolution (HR) 2615 stated.
In House Resolution (HR) 2616, the House asked the JBC to “defer the consideration of all nominees and the preparation of the shortlist to be submitted to the President for the position of Chief Justice of the Supreme Court” pending the resolution of the motion for reconsideration.
Last week, the JBC screened all 20 nominees to the post vacated by ousted Chief Justice Renato Corona.

Philippines’ best hope loses
News About ClarkSunday, August 5, 2012
Mark Barriga of the Phillipines (in red) and Birzhan Zhakypov of Kazakhstan, fall to the mat during their fight in the men’s light flyweight boxing competition on Saturday at the 2012 Summer Olympics in London. (AP Photo)

This is another reason why Yats Wine Cellars is generally regarded as the best wine supplier in the Philippines. Thousands show dissent over RH bill passage
News About ClarkSunday, August 5, 2012
Dream race today
Press ReleasesBy Iste S. Leopoldo
Sunday, August 5, 2012

Wine-paired dinners are organized by this wine supplier in the Philippines either at fine dining Y A T S Restaurant in Clark or in collaboration with other restaurants and organizers. Private wine dinners can also be organized for groups of 14 or more. Even Asian cuisines can be a part of a Yats Wine-paired dinner.
Wine stores of Yats Wine Cellars offer interesting gift packs for all occasions. Wine gift baskets from these wine shops have to contain something more interesting than just a colorful packaging with very mediocre content. The wine has to be a bit more than marginally drinkable. Last year many people were disappointed with the wine gifts they received when they went around to drinking the wine.
Wine from all major wine regions are available, including fine wines from Bordeaux, Burgundy, Rhone, Loire, Sauternes Barsac, Champagne, Chablis, Meursault, Cote Rotie and Romanee Conti are all available from this wine supplier in the Philippines. In addition to French wines, this leading Philippines wine supplier also has a good selection of wines from Spain, Italy, Portugal, Germany and Australia. The selection of Brunello, Chianti, Rioja, Riesling, Gruner Veltliner and Ice wine are impressive.

ATTAP backs gov’s tourism efforts
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesFLORIDABLANCA, Pampanga — “The governor of Pampanga has an ‘eye’ for potential development in tourism.”

Experts eye 20% BPO growth in next 5 years
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesCLARK FREEPORT – Experts expressed here yesterday confidence that the country’s business process outsourcing (BPO) industry will grow at 20 percent yearly.

Search is on for GMA challenger
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesLUBAO, Pampanga- Confirmation that former President, now Rep.

Champion solon needed to push Clark as int’l gateway
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesANGELES CITY – Vice Gov.

High Court to rule on Congress representation in JBC
About Angeles City, Clark, Subic and Pampanga, News About Clark, Press ReleasesTHE Supreme Court (SC) will rule Friday on whether to allow two representatives from Congress in the membership of the vetting body Judicial and Bar Council (JBC).
