Appellate court denies contempt raps vs de Lima, others

wTHE Court of Appeals (CA) has denied due course to a petition seeking to cite for indirect contempt two Cabinet officials and other police officers for supposed defiance of the court’s order enjoining them from clearing out a gaming company’s off-fronton betting operations.
The petition was filed by Meriedien Vista Gaming Corp., a gaming outfit allegedly owned by Atong Ang, which has been granted a franchise by the Games and Amusement Board (GAB) to operate in the province of Cagayan Valley.
The company is questioning the legality of the Department of Justice-Department of Interior and Local Government joint memorandum circular 0001-2011 dated June 27, 2011, which ordered the crackdown on the its betting stations.

The assailed circular also said that applications for business permits filed by Meridien with local government units, as well as those already issued to the firm should be denied or cancelled pursuant to Sections 5 and 7 of Republic Act 954, which prohibits certain activities in connection with horse races and jai alai and prescribed penalties for its violation.

The two line departments issued the joint memorandum after receiving reports about the resurgence of illegal gambling activities in some Luzon provinces based on a complaint of the DILG in the involvement of Meridien.

In a 10-page resolution penned by Associate Justice Juan Enriquez Jr., the CA’s Former Special Sixth Division found no merit in the contention of Meridien that the indiscriminate arrest of its employees and seizure of items used in its business operations pursuant to respondents’ joint circular.

The CA gave weight to the arguments of the Office of the Solicitor General, representing Justice Secretary Leila de Lima and Local Government Jesse Robredo that they were merely discharging their mandated duty when they arrested Meridien’s employees who were caught operating an illegal numbers’ game in Barangay Cainging, Maragondon, Cavite on September 30, 2011, which is outside its coverage of franchise.

“In the present case, the assailed acts of respondents do not constitute disobedience to, or defiance of the writ of preliminary injunction, a lawful writ issued by this Court, since their act of apprehending Meridien’s employees who were then involved in illegal jueteng operations and the consequent seizure of the jueteng paraphernalia is not the acts enjoined by said writ. Respondents thus, did not commit any act amounting to indirect contempt,” the Court ruled.

The appellate court held that petitioner failed to prove that the respondents signified its willful disregard of the court and the administration of law by impeding the due administration of justice.

“We need to remind that the power to punish for contempt of court is exercised on the preservative and not on the vindictive principle, and only occasionally should a court invoke its inherent power in order to retain that respect without which the administration of justice must falter or fail,” said the Court.
