Government orders in-depth probe on illegal tunnel

INTERIOR and Local Government Secretary Jesse Robredo ordered Wednesday an investigation on the possible culpability and liability of a lawyer who allegedly intervened on the case of a tunnel that was discovered near the Lumbia City Jail in November 2011.
During his visit in Cagayan de Oro on Wednesday, Robredo said lawyer Robert Raypon of the Public Attorney’s Office (PAO) in El Salvador City, Misamis Oriental, must be investigated on why he took custody of the three persons who were earlier held for questioning by operatives of the Lumbia Police Station.
“We are now investigating why a PAO lawyer of El Salvador intervened on a case in Cagayan de Oro,” Robredo said.
He said he also asked the explanation of authorities in Cagayan de Oro, particularly the Bureau of Jail Management and Penology (BJMP) and the Lumbia Police Station, why they could no longer locate those allegedly involved in the case.
“Sabi ko nga na magsampa na rin ng pormal na reklamo because this is a very serious offense dahil kung nagkataon ay nakatakas ‘yung mga bilanggo na may malaking kasalanan sa bayan,” Robredo said.
City Jail Warden Superintendent Clint Russel Tangeres said they have yet to file an administrative case against Raypon after their investigation, as ordered by Robredo.
On November 15, 2011, jail officers noticed a ridged cable sticking out from the ground near a building inside the city jail and when checked, they discovered an 86-meter tunnel underneath the jail compound.
The two-meter-wide tunnel was almost completed; and if had it reached the jail compound, it would have led directly to the cells of Batang Mindanao, Batman gang and the Reception and Diagnostic Center (RDC) that holds high profile convicts, including two Swedes serving life imprisonment for human trafficking, two Chinese nationals also serving life imprisonment for drug trafficking, and a police officer arrested for rape.
After the illegal digging was discovered, the Lumbia Police City Jail held for questioning at least three persons believed to be involved in the digging.
However, Police Inspector Joel Nacua, station commander of Lumbia Police Station, was forced to release the three after Raypon worked for their release, citing that no case has yet been filed against them.
When asked for comment, Raypon told Sun.Star Cagayan de Oro that he was just contacted by the family of the three apprehended persons to check on their status and why they were arrested.
“They were released since there was no case filed yet at that time. That was only my participation. That’s all I can say,” Raypon said.
Related to this, charges for violation of the National Building Code were filed against Christopher Moreno, the renter of the lot, where the digging was discovered.
Moreno is a resident of Vamenta Subdivision in Barra, Opol, Misamis Oriental, and Consuelo Aberasturi, owner of the lot.
Based on initial investigation, Moreno also uses the name Jewateddy Alforque Alpeche, with address at 4th Street Mega Road Heights in Tubod, Iligan City.
Police said Moreno/Alpeche is a hired contractor and is a known miner in Iligan City.
However, Tangeres said Moreno might be using a fictitious name.
“Ang problema namin ngayon kung lalabas na ang warrant of arrest ay saan namin hahanapin si Moreno dahil fictitious yata yung name at address niya,” he said.

Group threatens boycott of SM mall

OCCUPY and boycott.
This is the battle cry of protesters against the planned earth-balling of 172 trees in Luneta Hill as their numbers continue to grow and are on the brink of occupying and staging a protest rally against retail giant SM.
A group of local artists are now calling to occupy the road going to the mall starting tomorrow, Saturday, until the mass rally called for by Cordillera Ecological Center Director Michael Bengwayan, the lead petitioner, on January 20.
Local artist Florenda Pedro said they have been calling students and concerned citizens to join them in their cause in occupying the mall entrance in protest of the mall chain’s plan to earth-ball trees to give way for its expansion.
She said their preliminary plan involves the group staging peaceful protests in the road surrounding the mall by playing of gongs, performance poetry, dance and music jam convincing consumers to rethink their decision to patronize the mall.
The protest stemmed from the petition of Bengwayan accusing the Department of Environment and Natural Resources and city officials from failing to protect the pine and alnus trees inside the mall premises.
Since the online petition started Monday, some 2,000 concerned individuals affixed their support to the cause which Bengwayan claimed will be sent to President Benigno Aquino III, Presidential Adviser for Environmental Protection Nereus Acosta and Environment Secretary Ramon Paje calling to stop the mall’s expansion.
The area where the Department of Environment and Natural Resources (DENR) issued a tree cutting and earth-balling permit October 27 last year and eventually issued an Environmental Compliance Certificate will be the site for the proposed mall expansion.
Bengwayan claimed this move by the mall, city and environment officials is unacceptable, and callously insensitive to the importance of trees to the environment and ecology.
“This only shows the DENR does not appreciate and is insensitive to the contributions of these trees which have grown in view of the global warming and environmental threats. By issuing a tree cutting permit, DENR is not worthy of its existence by ruling in favor of tree cutting against trees already established,” his petition said.
DENR Regional Executive Director Clarence Baguilat, meanwhile, defended his agency claiming the tree cutting is allowed even with Executive Order 23 or the national log ban in effect as the pine trees involved were planted inside the private property of the mall and thus exempted from the log ban.
The environment official also stressed they have also obliged SM to plant at least 30 trees for every earth-balled tree as replacement.
However, Bengwayan, who organized the Cordillera Pine Tree Festival last month, said uprooted or earth-balled pine trees above 10 years old have a very low survival rate when transplanted as exemplified in previous earth-balling activities inside Camp John Hay.
The mayor, denying involvement in the tree cutting, said Environment Secretary Ramon Paje allowed the tree cutting while the sale of the Luneta Hill property was signed by President Benigno Aquino III.
Meanwhile, in an interview with SM Baguio PR Manager Karren Padilla Nobres last Wednesday, she claimed protesters are misled by wrong information being spread over social networking sites.
Nobres said there is no truth to reports the mall expansion will include the Governor Pack Road terminal as this is still thoroughly being studied.
This is despite earlier pronouncements of Mayor Mauricio Domogan, saying the development will include the construction of more parking spaces and a centralized bus terminal for the city.
She said SM will expand and renovate the current mall consisting of seven levels, open-air retail, dining and entertainment destination relying exclusively on natural ventilation.
The expansion involves an additional 76,000-square-meter floor area in addition to the existing mall of 106,000 square meters, aiming to be the first mall in the country to be certified Leadership in Energy and Environmental Design, the internationally recognized standard for green building design and construction developed by the United States Green Building Council.
She also emphasized there will be no trees cut during the expansion as the 172 trees will be earth-balled.
Aside from the environment-friendly architecture SM will utilize for the project, she said this will also add income to the city and provide additional employment opportunities for Baguio residents.
The 42 Alnus japonica trees will be transferred carefully in other vacant lots inside mall property, while the pine trees will be earth-balled and transferred to the DENR compound in Pacdal.
The PR manager also claimed the management knows the survival rate of earth-balled trees which is why they have also exceeded the national standard for replacing pine trees by planting 30 pine trees for every affected tree and as part of their aid to the National Greening Program of the country vows to seriously participate in more tree planting activities which they have already done in the past.
The national standard of replacing cut or earth-balled trees is 20 planted seedlings for every affected tree.
The mall representative said they have been trying to reach Bengwayan through his mobile phone but her calls were dropped. Over at social networking site Facebook, she was blocked by the latter when she tried to communicate SM’s side.
She added mall authorities are willing to have a dialogue with petitioners to clarify things and explain their mall expansion project which she said have passed through the scrutiny of environment authorities, acquired proper permits and planned to be environment-friendly.

Labor office, organization partner for employment of storm victims

THE Department of Labor and Employment (Dole) partners with the International Labor Organization (ILO) in assisting for the immediate humanitarian needs of the flash flood victims in Cagayan de Oro and Iligan cities.
In line with the rehabilitation, Dole, through its regional office in Northern Mindanao, deployed its staff to the different evacuation centers in the two cities last January 5 to 7, to ensure the skills profiling of the victims for livelihood assistance.
Affected victims or displaced workers and those with totally damaged livelihood are considered as priority beneficiaries for the said assistance.
Among the projects that Dole proposed to ILO are emergency employment for the displaced workers in the cleaning of debris, such as de-clogging of canals and water ways and road cleaning, and the provision of livelihood starter kits amounting to P10,000 for small businesses washed out by the flood such as trisikad driving, sari-sari store, dress shop, repair shop and other livelihood projects.
Also proposed are the inclusion of affected dependents between the ages 15 to 25 under the Special Program for the Employment of Students (Spes) and the restoration of some Dole-assisted livelihood projects in the region that were damaged.
At present, a series of consultation and coordination meetings are being done between Dole, ILO and other concerned agencies for the said proposals.
ILO, a specialized agency of the United Nations founded in 1919 as part of the Treaty of Versailles that ended First World War, has a mission in advancing opportunities for women and men to obtain decent and productive work in conditions of freedom, equity, security and human dignity.
Under its Office for the Coordination of Humanitarian Affairs through the Emergency Revision of the Philippines (Mindanao) Humanitarian Action Plan 2012, its main priority is to provide clean water for drinking and bathing, food, emergency shelter and essential household items to worst-affected people in Cagayan de Oro and Iligan for the duration of three months since the incident.
Debris cleaning to reduce health risks and logistics services that ensure uninterrupted delivery of life-saving programs is also a priority.
Other priorities include medical supplies and assistance, psychosocial and livelihood support in cooperation with Dole.

NHA to build 30,000 houses for storm victims

ABOUT 30,000 houses are set to be constructed, through the National Housing Authority (NHA), for the residents displaced by Tropical Storm Sendong in Iligan and Cagayan de Oro cities.
Vice President Jejomar Binay, who is also the chairperson of the Housing and Urban Development Coordinating Council, said Wednesday that the housing project also covers those living in danger zones, based on the directive of President Benigno Aquino.
Binay said the local government units should identify those who will only be given houses or both house and lot.

“Those affected with their houses damaged but are living in non-danger areas will be given houses only while a house-and-lot package will be provided to those living in danger areas,” he said during his visit in Cagayan de Oro on Wednesday.
Considered as high risk areas or danger zones, according to the NHA, is 20 meters away from waterways, while beyond 20 meters is considered non-danger zone or low to medium risk areas.
Binay said Secretary Jesse Robredo of the Department of Interior and Local Government (DILG) will lead the coordination with local government officials and the Philippine National Police (PNP) “for proper and orderly relocation.”
According to NHA Assistant General Manager Froilan Kampitan, the identified permanent relocation sites in Cagayan de Oro are Sitio Calaanan in Barangay Canitoan and barangays Lumbia, Gusa and Indahag.
The NHA said it targets to identify the beneficiaries by January, while site identification and project implementation would be from January to June. It said relocation will start in April while “Estate Management and Community Development” will be from April onwards.
Based on the data from NHA, there were at least 11,100 damaged houses in Iligan City and 18,436 in Cagayan de Oro.
The NHA said the resettlement program with housing components and facilities will be within 20-meter danger areas and housing material assistance and site upgrading (subject to geo-hazard clearance) for non-danger zones.
Related to this, Iligan City Mayor Lawrence Cruz is urging the public who have properties to donate land to be used as resettlement area for “Sendong” victims.
This came after the relocation sites in Iligan City is not enough for the huge number of families to be relocated.
Cruz said there are still 20,000 flood victims staying in evacuation centers; and the City Government needs at least 35 to 40 hectares of land.
“The relocation areas we have are not enough to accommodate them. We only have 18 hectares. We are still looking for lands while we take care of the evacuees’ basic needs like food, sanitation and potable water,” he said.
The identified 18-hectare relocation sites in Iligan City are located in Sta. Elena Village and Kapuso Village in Barangay Mandulog.
Cruz said they target to build 5,000 houses, while the Mines and Geo-sciences Bureau (MGB) hastens the geo-hazard mapping in the identified relocation sites.
“We will start construction of the initial 300 houses on January 25,” he said, adding that three geologists are now in Iligan to identify danger zones and “buildable” areas in the city.
The City Government of Iligan has reportedly received a total of P367 million as donation both from government and private sectors.

Police: There are 3 big jai alai operators in NegOcc

NEGROS Occidental Provincial Police Director Allan Guisihan said there are big three jail alai operators – a businessman and two prominent gambling personalities – in the province.
Guisihan said that these personalities operate jai alai that use the tipsters Cancha, Pointers and Computer that operate in Northern Negros and Target, Speed and Meridien in southern Negros.
The big three jai alai operators are reportedly based in Bacolod City.
However, Guisihan stressed that although they have the names of the jai alai operators, they could not divulge their identities because of the lack of evidence.
Guisihan reiterated his order to the chiefs of police of the different cities and municipalities in the province to intensify the campaign against jai alai in their respective areas.
Guisihan’s directive came after Negros Occidental Governor Alfredo Marañon Jr. ordered him to increase police efforts in putting a stop to the said illegal activity.
However, Guisihan also revealed that jai alai is not as rampant as before.
“They are engaged in a guerilla type operation,” Guisihan pointed out.
He said this kind of operation is making it difficult for police forces to apprehend them, especially the financier of jai alai in the province.
Per records of Noppo, the police throughout the province were able to conduct 153 operations against jai alai, arrested 245 persons with 153 cases filed. The PNP also seized P102,793,793.60 bet money and recovered 25 motorcycles used to collect bets, 36 cellphones and 44 calculators.
Guisihan added that based on reports, the financiers keep on changing the names of their jai alai outfit after their bet collectors are apprehended.
“But compared to last year, the illegal gambling activity in the province has been reduced,” he stressed.
He further stressed to the police chiefs that the one strike policy of the PNP national leadership is still in effect. (TED)

Senate to tighten security during impeachment trial

THE Senate, which will convene as an impeachment court on Monday, will have tighter security during the trial, including around 40 anti-riot police to keep rallyists from disrupting proceedings.
According to Manuel Parlade, director of the Security Enforcement Service of the Office of the Senate Sergeant-at-Arms (Ossaa) that will handle secure the Senate building, anti-riot police will be deployed near the Film Center of the Philippines. The film center is at the mouth of a side road that leads into the Government Service Insurance System building where the Senate is.
“Rallyists will come from both sides. That’s why we asked for back up from the police,” Senate Sergeant-at-Arms Jose Balajadia Jr. said.

The Senate will also have sniffer dogs from the Philippine Air Force to screen for explosives. The Philippine National Police unit detailed to the Senate will also guard the restricted-access parking lot and the perimeter of the Senate.
“CCTV (closed-circuit television) cameras will be installed in strategic locations such as the police outposts near the Senate, the parking lots, and inside the building. A paging system for vehicles parked outside the Senate premises will also be installed,” Parlade said.
Vehicles entering the Senate will need pre-issued gate passes. Balajadia said around 900 gate passes were issued but those vehicles will have to contend for 274 available parking slots. Parking spaces have been reserved for television vans and for the prosecution and defense panels but everybody else will be allowed to park on a first come-first served basis.
“Guests will also be restricted to designated areas and will not be allowed to roam around. Those in the Plenary Hall will not be allowed to take pictures or videos of the proceedings so as not to disrupt the trial. All cellular phones, beepers or other communication devices must be turned off once the guests enter the Plenary Hall,” Anthony Samonte, also with the Office of the Senate Sergeant-at-Arms, said.
Balajadia said the Ossaa and police will watch out for terrorist threats, but made clear that there are no known threats. Earlier this week, police were on alert against terrorists during the Feast of the Black Nazarene, a local religious festival in Manila.
Senate Secretary Emma Lirio-Reyes has also ordered strict enforcement of a No ID, No Entry policy during the trial.
Only those with IDs made especially for the trial will be allowed to enter the Plenary Hall. The Senate will distribute 175 guest passes a day, with 25 of those reserved for senior citizens. Those will be given out at 11 a.m. on trial days. The trial is scheduled from 2 p.m. onwards on Mondays through Thursdays. (Jonathan de Santos/Sunnex)

State-owned corporation: John Hay only avoiding paying debt

BASES Conversion and Development Authority (BCDA) tagged the move made by Camp John Hay Development Corporation (CJHDevCo) as a form of evasion.
Dean Santiago, vice president of the BCDA said, “The delinquent lessee of Camp John Hay cannot scot-free from paying its P3.024-billion arrears.”
CJHDevco served its notice to “rescind” the 2008 Restructured Memorandum of Agreement (RMOA) between the BCDA and CJHDevco.
“This is an ill-disguised ploy,” Santiago pointed out, adding: “This is another attempt at evading payment by unilaterally rescinding their contractual obligations to the Philippine government after benefiting from the John Hay property.”
He also pointed out “the lessee reportedly has grossed double-digit figures in billions of pesos.”
“It must be asked by the public where the money went,” said Santiago, adding the lessee cannot escape its obligation of paying its mounting debts.
The Sobrepena-led lessee has been delinquent in paying its arrears beginning the third year of the memorandum of agreement. The 25-year lease agreement between BCDA and CJHDevco was signed in 1996. In 1999, there was a request for the deferment of payments for 1997 and 1998. This was granted on August 5, 1999.
In 2000, CJHDevco asked for a restructuring agreement for failure to pay its lease obligations. It was signed in July 14, 2000.
Again in year 2003, CJHDevco asked for another restructuring, and the agreement was signed on July 18, 2003.
In 2008, another restructuring agreement was signed making it the third. All in all, CJHDevco requested and was granted one deferment and three restructuring agreements in a span of 12 years since the start of the original contract in 1996.
The major issues are all against CJHDevco – notably, the non-payment of the arrears that have ballooned to P3.024 billion. In contrast, the issue raised by the lessee on the non-operation of the One-Stop Action Center comes across as a convenient excuse to escape their debt obligation and to “turn the tables” against BCDA, Santiago said.

Getting to this beach resort in Pampanga Angeles City Clark Philippines
After entering Clark Freeport from Dau and Angeles City, proceed straight along the main highway MA Roxas, passing the stand-along wine shop called Clark Wine Center on the right, continue to bear right making no turns at all, go past Mimosa Leisure Estate on the opposite side of the road, one will hit a major intersection. Go straight and the road becomes Creekside Road. YATS Clearwater Resort and Country Club is on the right just 200m down.

This year there are several packages that make it easier and more comfortable for everyone to enjoy this year’s Clark Hot Air Balloon Fiesta.
