MANILA, Philippines – The 120-day temporary restraining order (TRO) issued by the Supreme Court (SC) on the implementation of the Cybercrime Prevention Act of 2012 is an opportunity for Congress to change the law that has drawn much criticism, Malacañang said yesterday.
“I think those 120 days (is an) opportunity for the legislature to discuss and finalize whatever amendments that they have already voiced out in public,” presidential spokesman Edwin Lacierda said.
“The Senate has already – or some senators have already – mentioned that they intend to push for some amendments. Likewise in the House. So this would be perhaps a good time and also an opportunity for the legislature itself to amend the law,” he said.
Lacierda described the 120-day period specified in the TRO as a “signal” from the SC for Congress to amend the controversial law.
At the Senate, two lawmakers have already initiated moves to have the law amended.
Senators Alan Cayetano and Loren Legarda filed proposals seeking to repeal some of the controversial provisions of Republic Act 10175.
Cayetano also filed a bill to decriminalize libel and defamation under the Revised Penal Code.
“There is a need to repeal the criminal defamation laws in the country since the present laws create a chilling effect on the community. We need to balance the need to promote the right of freedom of expression and the government’s duty to hold accountable those who abuse it,” he said.
Cayetano considers the move to amend the anti-cybercrime law as a catalyst for the decriminalization of libel in the country.
He added legislators should pass laws that further promote the positive use of technology, not curtail people’s freedom of expression and creativity.
Legarda cited the need to strike a balance between the government’s role to protect its citizenry and uphold freedom of expression.
“The vulnerability of cyberspace to pollutants such as pornography, cybersex, fraudulent practices and promotion of human trafficking (was) precisely the reason for the passage of the Cybercrime Prevention Act of 2012,” Legarda said.
“However, adopting such policy to prevent pollutants from spoiling the minds of our people must not be done at the expense of our valued right to free speech,” she said.
A ranking official of the Catholic Bishops’ Conference of the Philippines (CBCP), however, said the 120 days under the TRO would give the SC the opportunity to discern the law.
The TRO would “give time for the SC to weigh the pros and cons regarding the law and to calm down emotions and to let us be guided by reasons,” CBCP-Episcopal Commission on Bioethics chairman Bulacan Bishop Jose Oliveros said.
Oliveros though cited the need for the law to regulate the use of cyberspace.
He said several countries have already formulated their own cyber law. But he said the cyber law should ensure that a person’s right of expression must be safeguarded.
“The public should also continue to uphold the truth and the right to privacy of an individual,” Oliveros said.
In the meantime, the petitioners against RA 10175 in the SC issued a statement appealing to Congress to expedite the passage of bills that would repeal several contentious provisions in RA 10175.
They also criticized the Senate’s declaration that amendatory bills on RA 10175 will have to take a backseat.
“Why should we wait for the Supreme Court’s final decision before we act? Legislators committed a mistake in passing RA 10175, and the TRO issued by the Supreme Court is a cue for Congress to amend the law,” Kabataan party-list Rep. Raymond Palatino said.
“Before the high court released the TRO, senators and congressmen alike were very active in calling for amendments and repeals. But why is the Senate now dilly-dallying on amendatory bills? It just goes to show that senators are not really sincere in repealing the law,” said Terry Ridon, Kabataan party-list national president and general counsel.
“The TRO just delays the implementation of the law. The TRO is a cue for the Congress leadership to expedite the processing of repeal bills now filed in both chambers of Congress,” Palatino added.
“The TRO released by the high tribunal is effective for 120 days, enough time for Congress to repeal RA 10175,” he said.
There are other ways
In a press briefing yesterday, Lacierda said he did not discuss the TRO with President Aquino and that the executive department would respect the SC order.
The fact that the SC has issued a TRO showed that the country is operating normally and “that there is no such thing as e-martial law, even prior to the issuance of the TRO,”he said.
“Because this is the first time we have or a very rare time when the Supreme Court has issued a TRO which is definite in date, in scope. So they issued that TRO for 120 days. Normally, when the Supreme Court issues a TRO, it is indefinite. So perhaps this is a signal to the legislature to finalize whatever amendments,” he said.
Other laws, meanwhile, could be used to prosecute Internet-related crimes not covered by the Cybercrime Prevention Act, he said.
“The TRO is for the whole cybercrime law so you cannot cut and paste or decide which provisions of the TRO will apply. It’s a TRO on the entire law itself, so we cannot implement TRO as a law itself. But with respect to cybercrimes, for instance, pornography, maybe the other laws can… I would leave it to the DOJ (Department of Justice) if they can apply other laws in the meantime,” Lacierda said.
“For instance, hacking is a crime punishable under the E-Commerce Law. Some laws may be able to address those cybercrimes for now but, as to what extent, we will leave it with the DOJ. But insofar as the controversial provisions are concerned, the TRO has been issued and therefore it will be respected,” he said.
Asked if the TRO was a setback to the government’s fight against Internet-related crimes, Lacierda said there would be effects obviously, but there were different applicable laws.
At this point, Lacierda said the Presidential Legislative Liaison Office (PLLO) would cooperate with Congress to provide inputs on the amendments to the cybercrime law.
“From the very start, even the President had said… the President is open to lower the penalties for cyber libel, isn’t it? So we are open. This is a legislative act and no law is cast in stone so, it’s always subject to amendments,” he said.
Lacierda said Congress could work on the amendments while the case was ongoing in the SC.
“There are two tracks… and both are independent of each other. There’s a case in the Supreme Court which can proceed on its own. The Supreme Court chose not to proceed for 120 days, allow the discussions to happen after the 120 days. The legislature, on the other hand, has the power to make laws and to amend the laws… Perhaps, the legislature can move forward and do the amendments since there have been already some voices that already made known the intentions to amend the cyber crime law. We welcome both tracks,” he said.
Asked if there would be a need to augment the legal team of Malacañang to address cases, Lacierda said they have a good legal team and there was only a difference on emphasis of the various provisions of the contentious law.
“We recognize the importance of addressing those cybercrimes and that’s why that was emphasized,” Lacierda said.
While the government was “stymied” in pursuing cyber criminals, Lacierda said the TRO against the law was only “a temporary setback.”
He said amendments would be done on the law so that “what made it controversial will be cured.”
He said finer crafting of the law could be done.

Manila mayor orders arrest of gov’t news team maulers
Press ReleasesMANILA Mayor Alfredo Lim has ordered the city police to pursue a group of young men who allegedly ganged up and mauled news crew members of the state-run People’s Television Network (PTV) on Friday.
“[Y]esterday I ordered Col. [Amante] Daro to round up and arrest the suspects on the beating of a Channel 4 reporter the [o]ther day,” Lim said Saturday.
The PTV earlier said that its reporter Bernard Tan and cameraman Dante Morada were driving along Sta. Mesa, Manila, when three to four young men appeared at the corner of Valenzuela and V. Mapa Streets.
The young men, believed to be under the influence of either alcohol or illegal drugs, initially hit the news crew’s vehicle.
When the victims alighted from their car, they were physically attacked by the young men who also stoned them and the car.
In a PTV report, Lim condemned the alleged attack and said the suspects should be held liable for stoning the victims and damaging the government vehicle used by them.
Meanwhile, Daro said an investigation has been launched to identify the suspects and determine the motives of their actions.

Napolcom Vice Chairman and Executive Officer Eduardo Escueta said anyone who would cheat in the Philippine National Police (PNP) entrance examination will meet the necessary punitive actions including the invalidation of the test results and service eligibility.
“[A]nyone who commits any form of examination irregularity, such as cheating, impersonation, perjury, or violation of examination rules shall be dealt with administratively and/or criminally,” Escueta said.
He added that 14,988 will take the exams while 17,542 are distributed to the various promotional test categories.
Sunday’s tests will cover the qualifying examinations for Police Officer I and the promotional examinations for Police Officers 2 and 3; Senior Police Officer (for SPO1 to SPO4); Police Inspector (for Inspector and Senior Inspector); and Police Superintendent (for Chief Inspector and Superintendent).
Escueta issued the warning to the examinees days after the Napolcom invalidated the test results of 387 individuals who were found guilty of cheating in the April 17, 2011 exams.
He said the Napolcom analyzed the answer patterns of all successful takers and discovered that 387 examinees “were found to have a high percentage, ranging from 50 to 100 percent, of homogenous wrong answers.”
Examinees involved in the irregularities shall be nullified pursuant to the provisions of Napolcom Memorandum Circular 2000-007.
Based also on the same document, Escueta added that the examinees who were proven of committing cheating shall be barred from taking the PNP entrance exams for a period of three years.
He added that the Napolcom is committed in weeding out those who undermine “the sanctity and integrity” of the police exams. (Emmanuel Louis Bacani/Sunnex)

House to oppose Recto’s version of sin tax bill
Press ReleasesTHE House of Representatives vowed to oppose the “watered down” version of the sin tax bill proposed by Senate ways and means committee chairman Senator Ralph Recto.
Recto received criticism from his colleagues and several health advocates for recommending a sin tax measure that would raise only P15 billion to P20 billion in government revenues. The amount is half of the expected P31 billion from the House version.
“Recto’s proposal is watered down. We will stick to the House version,” Western Samar Representative Mel Senen Sarmiento, one of the authors, said in a text message.
“The campaign of the government for good health and universal health care will fail if we adopt the Senate version. We should not back down on our position,” Eastern Samar Representative Ben Evardone, chairman of the House committee on public information, added.
Recto’s proposal uses a three-tier tax rate for tobacco and alcohol products while Malacanang is pushing for a uniform tax rate. The government’s original proposal seeks to increase revenues to P60 billion. The revenue will be used for healthcare projects.
Recto said his committee’s version of the bill is “realistic.” He said high taxes on sin products could lead to smuggling.
Davao City Representative Isidro Ungab, chairman of the House committee on ways and means, said that although his colleagues reject Recto version of the sin tax bill, he would rather wait for the final version of the Senate.
“The committee report will still undergo debates and perhaps amendments at the plenary,” Ungab said.
House Deputy Speaker Lorenzo Tañada III also urged senators to scrutinize the Recto version of the bill.
“Health of the majority of the poor trumps revenue anytime. It is not a question of revenues, it is a question of health,” he said.
The House of Representatives has already found an ally in Senator Miriam Defensor-Santiago who earlier called on university students and social media netizens to join the war against the committee version of the sin tax bill, which she calls “the death star bill.”
“I am gobsmacked – speechless with amazement – at the committee report. It bears no recognizable resemblance to my bill. It is an abject surrender to the very rich and very powerful tobacco and alcohol lobby,” Santiago, whose proposal aims to raise revenues to P60 billion, said earlier. (Kathrina Alvarez/Sunnex)

Halili to continue lawmaking in City Council
About Angeles City, Clark, Subic and PampangaCITY OF SAN FERNANDO — Three-termer Board Member Tarcicio Halili recently revealed he wants to continue lawmaking in the City Council of Mabalacat, if given the mandate by the Mabalaqueños.
Halili, incumbent chairman of the Provincial Board Members League of the Philippines (PBMLP) and chairman of the Provincial Board’s Committee on Human Resource, told Sun.Star Pampanga he will seek the council seat as an independent candidate.
“I will run in 2013 as an independent candidate although I am part of the group…together with aspirants Noel Castro and Christian Halili…we call ‘Miblas Ka Mabalacat’ or MKM where we plan to institute reforms and changes especially Mabalacat is now a city,” he said.
Halili said he will implement projects for senior citizens, education particularly in scholarships for indigents at the community college, livelihood, entrepreneurship, and skills training linked with the Rotary Club of Dau Training Center, and investments and jobs generation, among others.
“If I can, I would finish other acts like the creation of bicycle lanes and condonation of fees for indigents who expire in our government-run hospitals before I leave the Provincial Board. Pampanga Police Director R’win Pagkalinawan said he is happy with the recent achievement of Candaba on peace and order.
“There is no more report on the existence of armed groups here. Mula ng maging Mayor si Jerry Pelayo ay nawala na rin ang mga NPA, naging tahimik na po itong bayan ninyo,” Pagkalinawan said in a meeting with chiefs of police in various municipalities where the current peace and order situation of the province was assessed.
Candaba and San Luis towns were named as among the peaceful communities in Pampanga.
Henry Flores, Candaba chief of police, said the recognition should be attributed on the partnership of the local police and barangay officials.
Flores stated that barangay officials played a vital role particularly in giving prior information needed in preventing criminal activities.

1,200 farmers get aid
Press ReleasesCANDABA – Some 1,200 farmers in this town benefited from the financial assistance of the Provincial Government, an official said.
Maria David, newly designated officer-in-charge of the provincial agriculture office, said Governor Lilia Pineda on Thursday visited the farmers at the Kapampangan and Tagalog regions and town proper.
David added there were only 590 farmers who are set to receive the benefit.
However, the governor decided to increase the beneficiaries after a large number of farmers flanked to the area, she said.
The beneficiaries were given P850 each, P650 came from the Provincial Government and the remaining P150 came from Pineda’s personal funds. (Herbert P. Mapiles)

Palace open to changes in anti-cybercrime law
News About ClarkMANILA, Philippines – The 120-day temporary restraining order (TRO) issued by the Supreme Court (SC) on the implementation of the Cybercrime Prevention Act of 2012 is an opportunity for Congress to change the law that has drawn much criticism, Malacañang said yesterday.
“I think those 120 days (is an) opportunity for the legislature to discuss and finalize whatever amendments that they have already voiced out in public,” presidential spokesman Edwin Lacierda said.
“The Senate has already – or some senators have already – mentioned that they intend to push for some amendments. Likewise in the House. So this would be perhaps a good time and also an opportunity for the legislature itself to amend the law,” he said.
Lacierda described the 120-day period specified in the TRO as a “signal” from the SC for Congress to amend the controversial law.
At the Senate, two lawmakers have already initiated moves to have the law amended.
Senators Alan Cayetano and Loren Legarda filed proposals seeking to repeal some of the controversial provisions of Republic Act 10175.
Cayetano also filed a bill to decriminalize libel and defamation under the Revised Penal Code.
“There is a need to repeal the criminal defamation laws in the country since the present laws create a chilling effect on the community. We need to balance the need to promote the right of freedom of expression and the government’s duty to hold accountable those who abuse it,” he said.
Cayetano considers the move to amend the anti-cybercrime law as a catalyst for the decriminalization of libel in the country.
He added legislators should pass laws that further promote the positive use of technology, not curtail people’s freedom of expression and creativity.
Legarda cited the need to strike a balance between the government’s role to protect its citizenry and uphold freedom of expression.
“The vulnerability of cyberspace to pollutants such as pornography, cybersex, fraudulent practices and promotion of human trafficking (was) precisely the reason for the passage of the Cybercrime Prevention Act of 2012,” Legarda said.
“However, adopting such policy to prevent pollutants from spoiling the minds of our people must not be done at the expense of our valued right to free speech,” she said.
A ranking official of the Catholic Bishops’ Conference of the Philippines (CBCP), however, said the 120 days under the TRO would give the SC the opportunity to discern the law.
The TRO would “give time for the SC to weigh the pros and cons regarding the law and to calm down emotions and to let us be guided by reasons,” CBCP-Episcopal Commission on Bioethics chairman Bulacan Bishop Jose Oliveros said.
Oliveros though cited the need for the law to regulate the use of cyberspace.
He said several countries have already formulated their own cyber law. But he said the cyber law should ensure that a person’s right of expression must be safeguarded.
“The public should also continue to uphold the truth and the right to privacy of an individual,” Oliveros said.
In the meantime, the petitioners against RA 10175 in the SC issued a statement appealing to Congress to expedite the passage of bills that would repeal several contentious provisions in RA 10175.
They also criticized the Senate’s declaration that amendatory bills on RA 10175 will have to take a backseat.
“Why should we wait for the Supreme Court’s final decision before we act? Legislators committed a mistake in passing RA 10175, and the TRO issued by the Supreme Court is a cue for Congress to amend the law,” Kabataan party-list Rep. Raymond Palatino said.
“Before the high court released the TRO, senators and congressmen alike were very active in calling for amendments and repeals. But why is the Senate now dilly-dallying on amendatory bills? It just goes to show that senators are not really sincere in repealing the law,” said Terry Ridon, Kabataan party-list national president and general counsel.
“The TRO just delays the implementation of the law. The TRO is a cue for the Congress leadership to expedite the processing of repeal bills now filed in both chambers of Congress,” Palatino added.
“The TRO released by the high tribunal is effective for 120 days, enough time for Congress to repeal RA 10175,” he said.
There are other ways
In a press briefing yesterday, Lacierda said he did not discuss the TRO with President Aquino and that the executive department would respect the SC order.
The fact that the SC has issued a TRO showed that the country is operating normally and “that there is no such thing as e-martial law, even prior to the issuance of the TRO,”he said.
“Because this is the first time we have or a very rare time when the Supreme Court has issued a TRO which is definite in date, in scope. So they issued that TRO for 120 days. Normally, when the Supreme Court issues a TRO, it is indefinite. So perhaps this is a signal to the legislature to finalize whatever amendments,” he said.
Other laws, meanwhile, could be used to prosecute Internet-related crimes not covered by the Cybercrime Prevention Act, he said.
“The TRO is for the whole cybercrime law so you cannot cut and paste or decide which provisions of the TRO will apply. It’s a TRO on the entire law itself, so we cannot implement TRO as a law itself. But with respect to cybercrimes, for instance, pornography, maybe the other laws can… I would leave it to the DOJ (Department of Justice) if they can apply other laws in the meantime,” Lacierda said.
“For instance, hacking is a crime punishable under the E-Commerce Law. Some laws may be able to address those cybercrimes for now but, as to what extent, we will leave it with the DOJ. But insofar as the controversial provisions are concerned, the TRO has been issued and therefore it will be respected,” he said.
Asked if the TRO was a setback to the government’s fight against Internet-related crimes, Lacierda said there would be effects obviously, but there were different applicable laws.
At this point, Lacierda said the Presidential Legislative Liaison Office (PLLO) would cooperate with Congress to provide inputs on the amendments to the cybercrime law.
“From the very start, even the President had said… the President is open to lower the penalties for cyber libel, isn’t it? So we are open. This is a legislative act and no law is cast in stone so, it’s always subject to amendments,” he said.
Lacierda said Congress could work on the amendments while the case was ongoing in the SC.
“There are two tracks… and both are independent of each other. There’s a case in the Supreme Court which can proceed on its own. The Supreme Court chose not to proceed for 120 days, allow the discussions to happen after the 120 days. The legislature, on the other hand, has the power to make laws and to amend the laws… Perhaps, the legislature can move forward and do the amendments since there have been already some voices that already made known the intentions to amend the cyber crime law. We welcome both tracks,” he said.
Asked if there would be a need to augment the legal team of Malacañang to address cases, Lacierda said they have a good legal team and there was only a difference on emphasis of the various provisions of the contentious law.
“We recognize the importance of addressing those cybercrimes and that’s why that was emphasized,” Lacierda said.
While the government was “stymied” in pursuing cyber criminals, Lacierda said the TRO against the law was only “a temporary setback.”
He said amendments would be done on the law so that “what made it controversial will be cured.”
He said finer crafting of the law could be done.

Despite a surge in mobile phone broadband, “prices for ICT services remain very high in many low-income countries,” said Brahima Sanou, director of the ITU’s Telecommunication Development Bureau.
Income from the telecommunication sector reached $1.5 trillion (1.2 trillion euros) in 2010, around 2.4 percent of the world’s gross domestic product, the report said.

That’s the conclusion of a study from the University of Warwick in the UK, which found that the more servings of fruits and vegetables people ate, the better their mental well-being.
For their research, scientists from Warwick and Dartmouth College in the US analyzed the eating habits of 80,000 people across Britain and found that well-being peaked at seven portions a day.
Meanwhile, the consumption of fruits and vegetables is dismal at best in the UK, as researchers point out that a quarter of the population eat just one portion or even less per day, while one-tenth of Britons are estimated to consume seven servings daily.
One portion is defined as 80 g.
The full results of their research is to be published in an upcoming issue of Social Indicators Research.
