CITY OF SAN FERNANDO–Mayor Arturo “Katoy” Naguit of Minalin has filed criminal charges before the Office of the Ombudsman against his predecessor, former Mayor Edgardo G. Flores, for alleged anomalous construction of a government evacuation center worth P7,975,521 in 2010.
In an interview, Naguit said that as local chief executive, he is duty-bound to protect the interest and properties of the municipal government, so he has no option but to file corresponding charges against the former mayor.
He refused to further comment on the issue telling the local media that he pities the accused but copies of the complaint affidavit had been furnished to the national media after his lawyer filed the case before the Ombudsman.
Based on the complaint affidavit filed last week, Naguit vehemently accused his predecessor of allegedly violating Article 213, Paragraph 1 and Article 217 of the Revised Penal Code; Section 3, Paragraphs (e) and (g) of Republic Act 3019 (Anti-Graft and Corrupt Practices Act); and Section 4, Paragraph (a) of Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
The complaint stated that Flores, when he was still mayor of Minalin, has made a fraudulent and prejudicial transaction.
The complaint also stated that on May 14, 2010, the construction of the Francisco P. Flores Multi-Purpose Center in Santo Rosario, Minalin, Pampanga, was completed.
“The facility was named and dedicated in the memory of the late Francisco P. Flores Sr., the respondent’s father and former municipal mayor of Minalin. The center was constructed using public or government funds from the National Housing Authority which were intended for the purpose of constructing an evacuation center for the constituents of Minalin,” Naguit stated in his complaint.
Citing documents as evidence, the mayor said the construction of the evacuation center, with movable partition and boys’ and girls’ toilets, was awarded to N22 Construction and Trading, owned and managed by Nestor O. Tolentino, for a total of P7,975,521.
However, the complaint stated that the evacuation center was constructed on private lots owned by the following persons: Francisco P. Flores (deceased), married to Anita Galopo, with an area of 1,396 square meters covered by Original Certificate of Title No. 5680; Francisco Nicolas, with an area of 562 square meters covered by Tax Declaration No. 14015-284; and Anita G. Flores, with an area of 560 square meters, covered by Tax Declaration No. 14015-259.
The mayor also stated in his complaint that “On April 20, 2008, Francisco Nicolas and Anita Flores executed a Deed of Donation in favor of the municipality of Minalin, represented by then-Mayor Edgardo G. Flores, for the purpose of donating their lots to the said local government unit and for the construction of the evacuation center….No resolution was passed by the Sangguniang Bayan authorizing then-Mayor Edgardo G. Flores to enter, sign and accept the aforementioned donations nor was the Deed of Donation ratified by the said body.
“No contract or agreement, whether by way of a Deed of Donation, Conveyance or Waiver of Rights, was executed by the heirs of Francisco P. Flores in favor of the municipality of Minalin, covering the area occupied by the evacuation center now multipurpose center and covered by Original Certificate of Title No. 5680,” he added.
It also stated that as of May 15, 2012, the lots where the evacuation center, now multipurpose center, stands are still declared under the names of Francisco Flores, Francisco Nicolas and Anita Flores.
Naguit said, “The construction of the evacuation center, now named Francisco P. Flores Sr. multipurpose center at Sto. Rosario, Minalin, Pampanga…has caused damage and undue injury to the government, specifically since the center is constructed/erected on private properties, and was not properly turned over to the municipality of Minalin”.
He clarified that the fund released to the municipality by the NHA was for the purpose of constructing an evacuation center and not for the purpose of constructing a multipurpose center in memory of the late Mayor Francisco Flores, Sr.
“There was evident fraud, bad faith and deceit on the part of respondent when he caused the construction of the evacuation center on the private lots owned by his parents and appropriated the same in favor of his family by naming the evacuation center as The Francisco P. Flores Sr. Multi-Purpose Center,” the complaint stated.
“As of October 15, 2012,” Naguit said, “the biggest portion of the lot where the evacuation center was constructed, consisting of 1,396 square meters covered by Original Certificate of Title No. 5680, is still registered under the name of the respondent’s parents.” ●HGL Reportorial Team

2 guards arrested for firing gun
About the Philippines, Pampanga, Clark, and Angeles CityCAMP OLIVAS, Pampanga–Two security guards were arrested after firing a shot inside the house of a neighbor in Angeles City last Sunday.
The suspect were identified as Ramiro Dominguez alias Ram, 48, a security guard of the Cavalier Security Agency and resident of Purok 5-B, Saint Vincent, Barangay Pampang, Angeles City; and, Ranier Cartalla, 24, also a security guard of the Cavalier Security Agency and resident of Batibot St. Barangay Anunas, in the same city.
Police said Mario Hernandez reported to the police station that there was someone who fired a gun in his brother’s, Adrian Fernandez, house just adjacent to the Dominguezes’ residence.
When the police arrived at about 12 noon, they saw Dominguez accompanied by friend Cartalla standing in front of the house.
During the investigation, the two suspects yielded one improvised shotgun (sumpak) and assorted ammunitions.
Later police learned that Adrian’s 8-year old daughter was severely traumatized by the incident.
Adrian told police that her daughter Anjanette was very frightened due to the violent incident committed by Ram.
The suspects were brought to the Angeles City Police Station 2 pending filing of cases of violation to the Omnibus Election Code, Illegal discharge of Firearms, Alarm and Scandal, and Grave Threat. ●Froilan E. Magtoto

DENR allots P375-M for CL reforestation
About the Philippines, Pampanga, Clark, and Angeles CityCITY OF SAN FERNANDO–The Department of Environment and Natural Resources 3 (DENR) has allotted at least P357 million to intensify the reforestation of denuded forestlands and watersheds in Central Luzon.
This, after typhoon “Pablo” devastated the provinces of Davao Oriental and Compostella Valley late last year.
In a statement, DENR-3 director Maximo Dichoso, said the P375 million will boost the National Greening Program (NGP) of President Noynoy Aquino and further increase the forest cover of Central Luzon as primary shield against strong typhoons and flooding.
“Our region is vulnerable to strong typhoons and we are bracing for the worst. Increasing our forest cover is one of our best defenses,” he explained, adding that DENR efforts now focus on building climate-resilient communities and implementing climate-smart environmental programs.
About 20,000 hectares of forestlands, watersheds, riverbanks and urban areas are earmarked for reforestation this year, which is double that of last year’s target of 10,204 hectares, Dichoso said.
The province of Tarlac received the biggest chunk of the budget with P67 million covering 3,995 hectares, followed by Nueva Ecija with P52 million covering 2,653 hectares, revealed Dr. Sofio Quintana, DENR deputy forestry director.
He said Bataan also received P51 million for 2,929 hectares; Aurora P50 million for 3,007 hectares; Bulacan P50 million for 2,743 hectares; Zambales P49 million for 2,895 hectares; and Pampanga P35 million for 1,876 hectares.
Barely two years after the NGP was launched in 2011, more than 12,000 hectares of public lands throughout Central Luzon have been planted with 7.5 million seedlings of forest and fruit trees, mangrove propagules, nipa seedlings and bamboo cultivars, Dichoso reported.
The DENR also aims to rehabilitate until 2022 at least 44,000 hectares of denuded forestlands at the Pantabangan-Carranglan Watershed in Nueva Ecija through the 10-year Forest Management Program (FMP) supported by the Japan International Cooperation Agency (JICA), he added.
Last year’s implementation of Executive Order No. 23 declaring a moratorium on the cutting and harvesting of timber in natural and residual forests and creating the regional anti-illegal logging task force (RAILTF) resulted in the confiscation of 258,427 board feet of assorted forest contraband and conveyances worth at least P6 million.
“Our reforestation effort is matched with heightened forest protection and vigorous law enforcement to sustain our gains in conserving the environment,” Quintana explained.
Four individuals were also convicted by the local courts and sent to jail for illegal logging last year, bringing to 22 the number of illegal loggers meted punishments since 2007 for violations of the Revised Forestry Code of the Philippines, or PD 705.
A stepped up campaign against illegal logging also effectively reduced the number of illegal logging “hotspots” in the region, from as high as 13 about a decade ago to only five last year.
These hotspots areas include Sta. Cruz and Botolan in Zambales; Gen. Tinio and Bongabon in Nueva Ecija; and Dona Remedios Trinidad in Bulacan.
NGP is set to rehabilitate 1.5 million hectares of the country’s denuded forest areas and aims to help the country reduce poverty, provide food security, conserve biodiversity, and mitigate and adapt to climate change. ●Marna Dagumboy-del Rosario

As Women’s Month comes near, Capitol intensifies campaign to improve women’s health
About the Philippines, Pampanga, Clark, and Angeles CityLUBAO, Pampanga – The provincial government continues its campaign to improve the health of Kapampangan women through medical missions, free prenatal checkups, and distribution of vitamins for expectant mothers, especially since Women’s Month celebration draws near.
In line with this, Governor Lilia G. Pineda visited yesterday more than 70 pregnant women from Minalin, Mexico, and City of San Fernando who underwent prenatal checkup at the Escholastica Romero District Hospital in this town.
The governor was joined by Board Member Trina Dizon of the Third District, Board Member Fritzie David-Dizon of the Second District, and Minalin Mayor Arturo Naguit.
Governor Pineda reminded the expectant mothers gathered here to live a healthy lifestyle during the duration of their pregnancy which includes attending regular checkups, maintaining a healthy diet, and taking of vitamins.
“These are your responsibilities as guardians of their unborn children,” Pineda stressed.
Also, Pineda urged the attendees to observe their condition regularly and to report any irregularities to their respective barangay health workers (BHW) to immediately receive medical attention if needed.
“Do not hesitate to consult your BHW for any difficulties you may experience during your pregnancy. The Capitol’s doors are always open and ready to assist you with your needs,” the governor instructed.
Meanwhile, the lady governor also called the attention of BHWs present here to observe their selves too, as they are also susceptible to various illnesses due to their occupation.
“It will be ironic if our BHWs are also sick while taking care of other Kapampangans. You should practice what you tell your patients and live healthy lives to be able to extend our service to those in need,” Pineda ended. ● Angelique Tuazon

Workers’ strike hits Subic port
About the Philippines, Pampanga, Clark, and Angeles CitySUBIC FREEPORT–A strike by employees of the Malayan Towage and Salvage Corporation (SALVTUG), led by the Federation of Free Workers (FFW), almost crippled this premier Freeport’s seaport operations this weekend.
Six vessels, including a US naval supply ship, were left at the open sea waiting for their escort tugboats that were docked due to a strike initiated by SALVTUG employees. The loss of service to these vessels would have meant a loss of millions of pesos worth of income for the government.
In a text message, Subic Bay Metropolitan Authority (SBMA) Chairman Roberto Garcia stated, “I hope strike is resolved soon.”
He added that both Hanjin Heavy Industries Corp.-Philippines (Hanjin) and Keppel are helping out with the predicament, ensuring that port operations here are not paralyzed and are normal.
According to an anonymous source, the strike stemmed from employees who want to have the same rate as that of their international counterpart. He added that the average salary of the employees there were more than P40,000.
He said that to them (employees) it was a question of principle, but to him, it was a question of patriotism. He added that if the employees could jeopardize the country’s port operations, the protesting employees will not only succeed in doing so but might also disrupt the country’s economic state.
SALVTUG was established in November 1974 with three ocean-going coastal tugs and four dry cargo and bulk oil barges.
Over the years, the company has kept pace with the development of Asian Ports and has continued its modernization program.
Presently, the fleet has grown to 31 multi-tasked tugs, two specialized crafts, one crew boat, 13 barges of various types and two floating dry docks.

Plans to turn Minalin as center of culture, heritage disclosed
About the Philippines, Pampanga, Clark, and Angeles CityMINALIN, Pampanga – Mayor Arturo Naguit bared the plan of his administration to turn the municipality into a center of culture and heritage preservation in the province.
In August 2011, the 400-year old Sta. Monica Church in this town was declared as National Cultural Treasure (NCT) by the National Museum. According to Naguit, this opened opportunities for them to transform their town into a tourist destination.
The mayor said he is planning to renovate all government establishments starting with the municipal grounds, with architectural design similar to old buildings to create an environment patterned with that of Vigan City in Ilocos.
“We have a very rich culture and tradition here in Minalin in addition to the places that we can consider historical, we just need to enhance and develop it,” Naguit said.
Many students from Catholic schools and bloggers always visit Minalin especially the Sta. Monica Church, prompting Naguit to grab the chance to showcase the other pride of the municipality.
He said putting up floating restaurants in the river is included in the master plan of the cultural-eco- tourism project of Minalin to promote the fishing industry of their town.
“After visiting the historical destinations in our town, we have to make sure that there are available places for them to appreciate the Kapampangan foods and products,” said Naguit.
Further, Naguit stated their plan to create an office that will serve as the center of all activities related to tourism such as itineraries for visitors, tourist guide and promotion. Their target clients are the catholic schools in the country.
“Aside from tourism, we want to create awareness on the preservation of heritage and culture, and we owe it to the future generation,” he said.
Through this cultural-eco-tourism plan of local government, they are optimistic that the fourth class status of the town will be elevated to a first class municipality. ●Jenna Lumbang

Sasmuan wants new firms, public market
About the Philippines, Pampanga, Clark, and Angeles CityCITY OF SAN FERNANDO – An official of a small coastal town in Pampanga is pushing for the creation a public market and manufacturing firms to boost business and employment.
Vice Mayor Tan Luna of Sasmuan, one the smallest and less populated towns in the province with some 28,000 people (2010 census), said they are inviting investors who will process their fish products.
The town is a fourth-class municipality whose six of 12 villages are coastal barangays. Its residents are chiefly dependent on fishing and raising of tilapias, bangus, crabs and shrimps.
Luna said the firms should establish their plants in the coastal villages because “it will be easier to bring the fish products for manufacturing.”
“Those who make fish sauce and other products that need our marine produce should invest in Sasmuan,” said Luna.
He added that the firms will give more employment to the town whose land area is about 92 square kilometers.
Luna said the lot where the public market stands is owned by the local parish church. He added that they want to transfer the market to a property belonging to the municipal government.
He added that “we have a lot but the problem is funding.”

SF council named ‘outstanding’ anew
About the Philippines, Pampanga, Clark, and Angeles CityCITY OF SAN FERNANDO–The City Council of the City of San Fernando has been named “Most Outstanding Sangguniang Panlungsod” at the provincial and regional levels for the third time in a row.
This, according to Vice Mayor Edwin Santiago, is bolstered by its “exemplary performance” and a record of “landmark legislation.”
The Sanggunian has now won the award for consecutive terms 2006, 2009 and 2012 under a merits program of the Department of Interior and Local Government (DILG) and the Philippine Councilors’ League (PCL).
The award made the city council eligible for national-level honors that the DILG will determine in the coming weeks.
Announcing the award on February 11, DILG Regional Director Florida Dijan said the selection was based on a comprehensive criteria that included: effectiveness of the legislative agenda; legislative tracking system; availability of legislative documents; efficiency of performance of the Sanggunian; and quality of office set-up and staff complement.
In particular, the San Fernando Sanggunian was noted for “significant landmark legislations” such as the Annual Investment Incentives Program, Comprehensive Development Plan, Revenue Code, Solid Waste Management Plan, Appropriation Ordinance, and the first-ever City Risk Reduction and Management Code for a local government unit.
The Sanggunian has enacted thus far a total of 202 ordinances and 1,262 resolutions with impact on local communities.
This crop of local legislative measures “shows [the San Fernando Sanggunian’s] exemplary performance,” said Director Dijan, pointing out further that the council “almost got a perfect score” during the assessment of the regional committee.
For his part, Vice Mayor Santiago, who is concurrently the Sanggunian Presiding Officer, said he was elated by the new award. He attributed the council’s outstanding performance to the “harmonious relationship” between the executive and legislative sectors of the San Fernando city government.
“Together with Mayor Oscar Rodriguez, we work hand in hand for our vision for San Fernando to be a Habitat of Human Excellence,” the Vice Mayor said.
“Furthermore, we consult the masses before we pass codes, ordinances and resolutions by conducting public hearings because we know for a fact that they will be affected in such cases,” he said.
The Secretary of the Saggunian, Avelina Lagman, said the award will serve as “an inspiration [for the council and its staff] to continually strive for excellence.” She said legislative measures now under consideration include a Poverty Diagnosis Ordinance, Administrative Code, and Cooperatives Code. ●Marna Dagumboy-del Rosario

Naguit, during the inauguration on Saturday of the Seniors’ Citizens building funded by Vice President Jejomar Binay, disclosed that his government gave medical assistance to some 2,000 people, more than 700 of whom had been given free cataract operations.
Naguit said former Mayor Edgar Flores “is now looking for people with cataract considering they never helped a single one during their nine-year rule.”
Naguit stressed that Gov. Lilia Pineda’s support had been vital in the implementation of various health care programs in the town.
Naguit said he had also supported the scholarships of “poor deserving students.” He added that he had regularly funded the college education of 107 students.
“To have limited funds is not an excuse not to send young people to school. Education should be given priority,” said Naguit.
The Department of Interior and Local Government (DILG) recently cited Naguit for his “child-friendly” administration. It was the first-time for Minalin to get the citation.
Naguit also worked for the declaration of the Sta. Monica Church as a National Cultural Treasure, the second to be declared among the old churches in Pampanga.
Senatorial bet Nancy Binay represented his father, Vice President Binay, in the event attended by Mayors Jerry Pelayo of Candaba, Peter Flores of Masantol and Leonora Wong of San Simon. Dengue cases in CL down by 80%
About the Philippines, Pampanga, Clark, and Angeles CityCITY OF SAN FERNANDO–An 80 percent decrease of dengue cases in Central Luzon from January to February has been noted this year compared to the same period last year.
Department of Health Central Luzon Regional Epidemiologist Jessie Fantone said that 3,300 were reported cases in the region in the first two months of 2012. From January to February this year, the cases were down to 653 cases.
Due to the decrease, Central Luzon dropped to fourth place in the ranking of regions with high cases of dengue, from third spot last year.
“Another good news is Region 3 ranks fourth on most dengue cases tallied for the whole country. Region IVA or Calabarzon places first, followed by the National Capital Region, and third, Region VI or the Western Visayas,” she said.
About 232 cases came from Bulacan, followed by Nueva Ecija with 153; Tarlac, 100; Pampanga, 87; Bataan, 69; Aurora, 8; and Zambales, 4.
Of the said number, DOH has tallied one death each in Pampanga and Nueva Ecija provinces.
“Although the outcome of the joint programs of DOH and local government units along with the other private sectors is impressive, we still needed to work hard to prevent dengue,” he said, however.
DOH suggested that in order to lessen the cases of dengue in the country, “we must do preventive measurements.”
One good example is the program of the department called the “4S” which is search and destroy, self-protection measure, seek early consultation and say no to fogging. ● Joelyn G. Baluyut

Ex-Minalin mayor faces graft charge
About the Philippines, Pampanga, Clark, and Angeles CityCITY OF SAN FERNANDO–Mayor Arturo “Katoy” Naguit of Minalin has filed criminal charges before the Office of the Ombudsman against his predecessor, former Mayor Edgardo G. Flores, for alleged anomalous construction of a government evacuation center worth P7,975,521 in 2010.
In an interview, Naguit said that as local chief executive, he is duty-bound to protect the interest and properties of the municipal government, so he has no option but to file corresponding charges against the former mayor.
He refused to further comment on the issue telling the local media that he pities the accused but copies of the complaint affidavit had been furnished to the national media after his lawyer filed the case before the Ombudsman.
Based on the complaint affidavit filed last week, Naguit vehemently accused his predecessor of allegedly violating Article 213, Paragraph 1 and Article 217 of the Revised Penal Code; Section 3, Paragraphs (e) and (g) of Republic Act 3019 (Anti-Graft and Corrupt Practices Act); and Section 4, Paragraph (a) of Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
The complaint stated that Flores, when he was still mayor of Minalin, has made a fraudulent and prejudicial transaction.
The complaint also stated that on May 14, 2010, the construction of the Francisco P. Flores Multi-Purpose Center in Santo Rosario, Minalin, Pampanga, was completed.
“The facility was named and dedicated in the memory of the late Francisco P. Flores Sr., the respondent’s father and former municipal mayor of Minalin. The center was constructed using public or government funds from the National Housing Authority which were intended for the purpose of constructing an evacuation center for the constituents of Minalin,” Naguit stated in his complaint.
Citing documents as evidence, the mayor said the construction of the evacuation center, with movable partition and boys’ and girls’ toilets, was awarded to N22 Construction and Trading, owned and managed by Nestor O. Tolentino, for a total of P7,975,521.
However, the complaint stated that the evacuation center was constructed on private lots owned by the following persons: Francisco P. Flores (deceased), married to Anita Galopo, with an area of 1,396 square meters covered by Original Certificate of Title No. 5680; Francisco Nicolas, with an area of 562 square meters covered by Tax Declaration No. 14015-284; and Anita G. Flores, with an area of 560 square meters, covered by Tax Declaration No. 14015-259.
The mayor also stated in his complaint that “On April 20, 2008, Francisco Nicolas and Anita Flores executed a Deed of Donation in favor of the municipality of Minalin, represented by then-Mayor Edgardo G. Flores, for the purpose of donating their lots to the said local government unit and for the construction of the evacuation center….No resolution was passed by the Sangguniang Bayan authorizing then-Mayor Edgardo G. Flores to enter, sign and accept the aforementioned donations nor was the Deed of Donation ratified by the said body.
“No contract or agreement, whether by way of a Deed of Donation, Conveyance or Waiver of Rights, was executed by the heirs of Francisco P. Flores in favor of the municipality of Minalin, covering the area occupied by the evacuation center now multipurpose center and covered by Original Certificate of Title No. 5680,” he added.
It also stated that as of May 15, 2012, the lots where the evacuation center, now multipurpose center, stands are still declared under the names of Francisco Flores, Francisco Nicolas and Anita Flores.
Naguit said, “The construction of the evacuation center, now named Francisco P. Flores Sr. multipurpose center at Sto. Rosario, Minalin, Pampanga…has caused damage and undue injury to the government, specifically since the center is constructed/erected on private properties, and was not properly turned over to the municipality of Minalin”.
He clarified that the fund released to the municipality by the NHA was for the purpose of constructing an evacuation center and not for the purpose of constructing a multipurpose center in memory of the late Mayor Francisco Flores, Sr.
“There was evident fraud, bad faith and deceit on the part of respondent when he caused the construction of the evacuation center on the private lots owned by his parents and appropriated the same in favor of his family by naming the evacuation center as The Francisco P. Flores Sr. Multi-Purpose Center,” the complaint stated.
“As of October 15, 2012,” Naguit said, “the biggest portion of the lot where the evacuation center was constructed, consisting of 1,396 square meters covered by Original Certificate of Title No. 5680, is still registered under the name of the respondent’s parents.” ●HGL Reportorial Team
