Gatdula co-accused ask court to stop DOJ probe

TWO suspects tagged in the kidnapping and extortion of a Japanese national asked the Court of Appeals (CA) to stop the Department of Justice (DOJ) from proceeding with its preliminary investigation against them.
Virgelito Gutierrez and Jay Ducusin, the alleged cohorts of former National Bureau of Investigation (NBI) director Magtanggol Gatdula, petitioned the CA to issue an injunction enjoining the DOJ from investigating them for lack of jurisdiction.
Gutierrez, an NBI asset, and Ducusin, a security volunteer, were among those charged with the kidnapping of Japanese Noriyo Ohara in Pangasinan last year.
The controversy over the Ohara kidnapping prompted President Benigno Aquino III to dismiss Gatdula from service.
Named respondents in the petition were Justice Secretary Leila de Lima, Prosecutor General Claro Arellano and panel members Assistant State Prosecutors Juan Pedro Navera, Irwin Maraya, Hazel Decena-Valdez and Ohara.
Petitioners said the Manila Regional Trial Court branch 8, which conducted hearings on a petition filed by Gatdula, already issued a writ of preliminary injunction against the investigation conducted by a separate fact-finding panel formed by de Lima.
They insisted that during the conduct of such fact-finding investigation, “the legal and constitutional rights of the respondents, more particularly their right to counsel and against self-incrimination were wantonly violated.”
Gutierrez and Ducusin said the respondents and the panel of prosecutors committed grave abuse of discretion amounting to lack of jurisdiction on the ground that the present preliminary investigation violates and circumvents the preliminary injunction order issued by the Manila RTC on February 20, 2011.
They also said that DOJ’s Omnibus Order dated June 20, 2012, was issued with grave abuse of discretion when the DOJ denied the second ground of their motion to dismiss the Ohara complaint as these do not show that a violation of law has been committed by the respondents, and in the light of the fact that she has not presented any independent, relevant and material evidence to back up her accusations.
Aside from Gatdula, Gutierrez and Ducusin, also recommended for preliminary investigation were Mario Garcia, special investigator and former chief of the NBI-Security Management Division (SMD); NBI asset Chona Ellen Esplana; Raul Dimaano, special assistant director for Gatdula; and Jose Odelon Cabillan, former executive officer of the NBI-SMD.
Also recommended for investigation were other “security volunteers” who participated in the alleged kidnapping were Eduardo Romeo, Arman Alumisen, Fritz Gerald Argente, Marvin del Prado, a certain former M/Sgt Dela Cruz, Donald Dela Cruz, Ricee Marquez, Rinee Marquez, Carl Plantado, a certain Mags, and John and Jane Does.
Meanwhile, chief prosecutor Arellano created a panel of prosecutors that would conduct a separate preliminary investigation on Gatdula and several others who were implicated in the foiled ambush of NBI deputy director Reynaldo Esmeralda last February 21.
Assistant State Prosecutors Gino Paolo Santiago and Rassendell Rex Gingoyon, as well as Prosecution Attorney Gerard Gaerlan were designated to determine probable cause in the frustrated murder charges filed against Gatdula and 12 others.
The case was based on the arrest two weeks ago of retired police officer Perfecto Villanueva, who confessed that he was the one asked to lead the ambush of Esmeralda, on orders of Gatdula and his friend, businessman Tyrone Ng.
Corroborating the testimony of Villanueva was Jose Maglalang who confessed that the group wanted Esmeralda dead because the NBI official was the reason why Ong was not yet being paid the P150 million that the NBI owed him as service provider of the NBI clearance project.
