ANGELES CITY—A judge here extended the temporary environmental protection order (Tepo) that another judge issued last week against a permit by Executive Secretary Paquito Ochoa Jr. allowing the cutting of 486 trees to widen the stretch of Manila North Road here and Mabalacat City.
In a Dec. 14 order released here on Monday, Judge Ma. Angelica Paras-Quiambao extended the Tepo while the case is pending in her sala, Branch 59 of the Regional Trial Court here.
The defendants are Ochoa, Public Works Secretary Rogelio Singson, Environment Secretary Ramon Paje and Lormelyn Claudio, Environmental Management Bureau director in Central Luzon.
“A Tepo is issued in favor of the plaintiffs enjoining the defendants, their subordinates and personnel, and all persons acting under their authority or instructions from cutting, harming, injuring, earth-balling or transferring the subject trees that will result in the prejudice of the subject trees along the stretch of MacArthur Highway [MNR] until the termination of the case,” Paras-Quiambao said.
She also ordered the branch sheriff to “periodically monitor the existence of acts that are the subject matter of this Tepo until further order from the court.”
Paras-Quiambao extended the Tepo because of the “unrebutted evidence” by Save the Trees Coalition (STC) leader, Cecile Yumul. Ochoa, Singson, Paje and Claudio did not submit any oral or written statement that their agencies had canceled a plan to cut the trees, as Antonio Molano, Department of Public Works and Highways (DPWH) director in Central Luzon, told the Inquirer last week.
Francisco Yabut, STC lawyer, said the order secured the survival of the 486 trees, mostly old acacia, and recognized the right of his clients to a clean environment from the benefits provided by the trees.
The first Tepo, good for 72 hours, was issued by Executive Judge Omar Viola.

In Bataan, campers get quick lessons on care of environment

Some 80 Girl Scouts and Boy Scouts camping on their school grounds in the upland village of Tala in Orani, Bataan, last week got what a mother remarked aloud as a “bonus” to the outdoor activity.
The bonus was an Inquirer Read-along session where “Si Emang Engkantada at ang Tatlong Haragan (Emang the Fairy and the Three Bullies),” written by the late Rene Villanueva and illustrated by R. Jordan Santos, was read to them.
Judging from the faces and reactions of these pupils and their parents, the session engaged them alternately in awe, silence, surprise and joy.
Thanks to the animated reading by Felicito Payumo, chair of the Bases Conversion and Development Authority, and four Teatro Fernandino artists who acted the characters and spoke their lines in the story.
Aside from the mix of reading and performance, Payumo offered visual experience by flashing on a wide screen photographs of scenes of destruction wrought by Tropical Storm “Sendong” in December 2011, by the monsoon-induced rains and floods in August, and by Typhoon “Pablo” this month.
The pictures were his way of telling the children that Mother Nature, personified by Emang, can be harsh at times.
Payumo, who lives in a farm-resort in the village, believed that children play a big role in saving the forests of Orani and the rest of the Bataan National Park against illegal logging and destructive farming practices.
“The future is theirs, and so they must help take care of the forests even at a young age,” he said.
The children turned out to be rapt listeners.
“The story tells us to take care of our environment, to save on water and to plant many trees,” Johan, a Grade 4 pupil, said. He remembered the antagonists well—Pat Kalat (Pat the litterbug), Pol Putol (Pol the tree cutter) and Paz Waldas (Paz the extravagant).
“Reading is fun,” said another pupil, Jenna, of the experience. Toward the end of the program, she was engrossed in a book the Inquirer gave to the group. Tonette Orejas

‘Modern’ Christmas For Subic Aetas

SUBIC BAY FREEPORT – The sweet aroma of tomato sauce fills the whole house as a bowl of spaghetti is served in the table, along with it is a loaf of bread and roast chicken.
You would think that this is a typical home in the suburbs celebrating Christmas, but it is not.
It is in the house of Bonifacio Abraham, the former chieftain of the Aeta village in Pastolan, celebrating last year’s Christmas Eve.
Back in the old days, our indigenous brethren here at the Subic Freeport used to celebrate Christmas with food that was gathered on either planted or wild-growing crops.
Back then, the usual feast for the Pastolan Aetas were halayang ube, cooked gabi, the traditional pansit, and chicken that was cooked in bamboo.
But ever since they widened their trade and started mingling with “flatland” residents, the Aetas have modernized their celebration of Christmas.
Most of them don’t have Christmas ornaments as they would rather spend their money on food rather than decorations.
They do, however, buy Christmas gifts for their children.
Many of them have changed their religions, becoming born-again Christians, while some became Baptists.
A small and open church was also constructed in the village where the traditional “Misa de Gallo” or “Simbang Gabi” is held.
These Aetas are a far cry from their ancestors who used to believe in power of nature, folklore, and in deities such as “Apo Mallari.”
Currently, a Joint Management Agreement between the Subic Bay Metropolitan Authority (SBMA), National Commission on Indigenous People (NCIP), and GMA will give the Aetas of Pastolan some P100,000 as a Christmas grant.
The money will be equally divided to some 300 families residing in the community.
Subic investors are also conducting Christmas outreach programs as their way of spreading the Yuletide spirit.
The Kanawan Aeta village, on the other hand, has only 120 families and is not part of the SBMA, but also receives goods coming from outreach programs by Subic investors.

Pampanga Court Saves 486 Trees

ANGELES CITY, Pampanga – The Regional Trial Court (RTC) here, designated as an environmental court, has ordered the extension of a Temporary Environmental Protection Order (TEPO) that will suspend the plan of the Department of Public Works and Highways (DPWH) to cut at least 486 trees along the Mac Arthur Highway traversing Mabalacat and this city.
RTC Branch 59 Presiding Judge Angelica Quiambao said in her December 14 decision that was released Wednesday that there is a need to extend the TEPO as its non-issuance will render nugatory or moot the petition filed by a group of environmentalists under the umbrella Save The Trees Coalition (STC).
“Judicial discretion dictates the propriety of extending TEPO, it being a matter of extreme urgency involving plaintiffs’ (the groups composing the STC) constitutional right to a balanced and healthful ecology in accord with the rhythm and harmony of nature,” the Court explained.

CITY OF SAN FERNANDO, Pampanga — Some 42 vegetable farmers here received “Nego Karts” from the Department of Labor and Employment (Dole) and the Butil Farmers Partylist as part of their “Gulayan sa Barangay” program in Pampanga. The carts are part of the 100 “Nego Karts” to be distributed to indigent beneficiaries as part of the efforts to uplift the living conditions of poor farmers in the province. “This is an initiative to assist the farmers to sell their produce and other by-products from their farms by providing them with greater mobility,” Butil Representative Agapito Guanlao said. Bizman: ‘Prepare for calamities this 2013’

CITY OF SAN FERNANDO — Pampanga Chamber of Commerce and Industry (PamCham) vice chairman Rene Romero has called on the National Government agencies to set into motion disaster preparedness programs for 2013.
He said this is to minimize damage to lives and properties that might offset the financial gains achieved in the last quarter of the year.
He said most businessmen are bullish of the good performance of the country’s local economy, good performance that would still be felt until election season in 2013 that would be marked by fierce political spending.
However, Romero said natural disasters and even the result of the 2013 elections would surely have an effect on the financial gains achieved by the country.
“Natural calamities that are of the scale of recent typhoons that hit Luzon and Mindanao would surely be felt on an economic and social level,” Romero said. But Romero remains optimistic that that current economic performance of the country will still go up.
Romero said the projection was based on the country’s July to September economic performance where the country’s gross domestic product (GDP) accelerated by 7.1 percent from 3.2 percent a year ago.
He said the benefits of the good performance would reverberate until the first quarter of 2013.
Romero also said the economic benefits would in turn benefit medium and micro-entrepreneurs and a host of industries catering to yuletide products and election paraphernalia.
Earlier, Socioeconomic Planning Secretary Arsenio Balisacan said the country posted the fastest economic growth within the 10-member countries of the Association of Southeast Asian Nations (Asean).
“It is at these times that ample preparations should be taken not just to maintain the economic gains of the country but also to ensure cushion programs for worst possible scenarios,” Romero added.

AC Council okays P1.3-B budget

ANGELES CITY — The City Council has approved the City Government’s 2013 budget amounting to P1.311 billion.
Councilor Maricel Morales made assurance that the budget was scrutinized to prevent over declaration of expenditures and irregularities.
Morales, chairwoman of the city’s finance and appropriations committee, said the P1.311-billion city budget for 2013 was thoroughly studied.
“So it doesn’t appear that the council is a puppet of the mayor, the budget was scrutinized. We saw some irregularities and we corrected them,” Morales said.
She said some of the irregularities discovered during a three-day hearing were funds for gas and other vehicle maintenance products in some department, which do not have government-issued vehicles.
“When departments create their budget, they anticipate what will they be needing. We decided that we cannot program budgets for vehicle maintenance materials if we do not have the vehicle yet,” Morales said.
Morales said they also found out irregularities including typographical errors on entries.
“There was an overestimated budget of P115 million but we have corrected that,” Morales said.

Patient Care Corporation donates to typhoon victims in Mindanao

CITY OF SAN FERNANDO – Patient Care Corporation, a health service-based company here, donated some P100,000 for the victims of Typhoon Pablo in Mindanao through the Philippine National Red Cross (PNRC).
Patient Care Corporation president Alfrito Mah turned over the check donation for the victims of Pablo to Red Cross officials in simple ceremonies. The move is part of the Corporate Social Responsibility (CSR) program of the company to its local communities.
Mah said that they are also urging private companies to pool in their resources and help the disaster victims. He said that private companies have the responsibility to give back to their local communities through charity work and other social service programs.
Earlier, PNRC chairman Richard Gordon said they opted for cash donations since it would be easier to manage rather than food and non-food items.
“Kasi kapag mga gamit or pagkain ire-repack pa… mas matatagalan tayo,” Gordon said.
The PNRC said cash donations would augur well for the humanitarian organization to provide more help to typhoon victims.
“We are appealing for your support to be able to continue to provide food, non-food items and our services to the most vulnerable in the hardest hit cities and provinces,” PNRC said.

Tugade is new CDC president

CLARK FREEPORT, Pampanga – President Benigno Simeon Aquino III has appointed Atty. Arthur Tugade as the new president of the state-run Clark Development Corporation (CDC).
Tugade, a lawyer-businessman, will take over the post vacated by Former Armed Forces chief of staff Eduardo Oban who was appointed as undersecretary of the Department of Transportation and Communications (DoTC).

A native of Claveria, Quezon, Atty. Tugade is the president and chief executive officer of the Perry’s Group of Companies, a holding corporation consisting of ten corporate entities engaging in clothing, logistics, trucking, equipment leasing, fuel distribution, and retail industries. Court stops cutting of trees

ANGELES CITY, Pampanga – The Regional Trial Court (RTC) here, designated as an environmental court, has ordered the extension of a Temporary Environmental Protection Order (TEPO) that will suspend the plan of the Department of Public Works and Highways (DPWH) to cut at least 486 trees along the Mac Arthur Highway traversing Mabalacat and this city.

RTC Branch 59 Presiding Judge Angelica Quiambao said in her December 14 decision that was released Wednesday that there is a need to extend the TEPO as its non-issuance will render nugatory or moot the petition filed by a group of environmentalists under the umbrella Save The Trees Coalition (STC).
