NDRRMC warns possible tsunami in PH after 7.1 quake rattles Colombia

MANILA, Philippines—The National Disaster Risk Reduction and Management Council warned early Monday all local offices for possible tsunami occurrences after a 7.1-magnitute shook southwestern Colombia Sunday, a report from Radyo Inquirer 990 AM said.
Though no damage or injuries were reported in Colombia, the NDRRMC gave a directive for its provincial offices to prepare for any eventualities.
Associated Press reported the quake struck at 11:31 a.m. local time 30 miles (48 kilometers) from the regional capital of Popayan and was felt in Bogota as well as 10 of Colombia’s 32 states. The U.S. Geological Survey said its epicenter was 94 miles (150 kilometers) beneath the earth’s surface.
The quake was the most powerful to hit Colombia since a 7.2-magnitude temblor shook the same region in 2004, said Patricia Pedraza of Colombia’s geological service.
Security chief Edith Cabeza of Cauca state, of which Popayan is the capital, said the “white city” of 270,000 inhabitants suffered no damage.
Popayan’s historical center was largely reconstructed after a March 1983 quake that killed at least 250 people.

Inquirer Read-Along: Learning early about Naga’s simple hero

MANILA, Philippines—How better to cement Jesse Robredo’s legacy in Philippine history and society than to teach to the next generation his humility as a government official and his passion in serving the public.
Around 80 elementary students in grades one to three from Pasig City learned about the former secretary of the interior and local government when he was mayor of Naga City during a Philippine Daily Inquirer Read Along with Khalil Kaimo and Paolo Valenciano.
They read the children’s book “The Public’s Servant” by Didith Tan Rodrigo, which tells about Robredo’s simple and down-to-earth acts as mayor of Naga. The book is part of Ramon Magsaysay Award Foundation’s “Great Men and Women of Asia – Children’s Series.” Robredo was an awardee for government service in 2000.
“We need more people like [Robredo] and what better way than to start with the kids when they’re very young,” Valenciano said in an interview with Inquirer after the Read Along.
The book is told in simple “Internet chat” style between two friends, Chris or “XtnXtra” played by Kaimo, who is in New York, and Matt or “MattDude2000,” played by Valenciano, who is on vacation in his parents’ hometown of Naga City.
Matt chats with Chris about his personal encounters with “Mayor Jesse.” The first time when Mayor Jesse was playing basketball on the streets with locals and wearing regular T-shirt and shorts.
The second time, Matt goes, was when he saw Mayor Jesse go out to the ricefields in a bicycle to bring back a girl who ran away from her parents. And the third time was when a typhoon hit the city and Mayor Jesse led the rescue team in saving people from the devastation.
Throughout the chat sessions between them Chris and Matt express awe and surprise at Mayor Jesse’s acts and behavior that were contrary to the common perception of a government official.
The biggest surprise that Matt found out about Mayor Jesse was when he saw the latter sweeping the streets on his own after the mess caused by the storm.
Valenciano said he found that part of the story having the most impact on the children. “I could see some of the kids were also like ‘What? He was sweeping the [streets]?’” he said.
“I think subconsciously we’re teaching them humility, and right now it’s what the country needs,” Valenciano said.
Kaimo expressed his wish that there would be more government officials like Robredo. “They [should] lead by example rather than [boast] ‘I built this [and] I built that.’ How many of them do you actually see sweeping streets and cleaning up their city?” Kaimo said.
When asked what significance Mayor Jesse could have on children, Valenciano said, “He wasn’t really doing great things, he wasn’t really building bridges. He was just a simple guy doing honest work. That’s what’s good to teach to children.”
“Its good to let the kids know about people that have [made a significant impact] just by doing what’s right,” he added.
Kaimo said that it was because Mayor Jesse led by example that he became significant to the people of Naga. “The people at the top start it, then the people under them will see it and they’ll start doing it. The domino [effect] doesn’t start at the bottom, it should start at the top.”
During the story-telling, the kids were so engrossed that when Kaimo and Valenciano tried to provide explanations, one kid spoke out and requested that they continue with the story already.
Near the end of the book, Chris expressed disbelief in Matt’s stories about the mayor of Naga. “So this mayor plays basketball with anyone, rides a bike to save a child, and sweeps the streets after a storm? Dude, that’s not a mayor!” Chris said in disbelief.
“That’s… I don’t know what that is,” he told Matt.
Matt replied simply: “Well, that’s Naga’s mayor!”
The 80 students who heard and read the story of Mayor Jesse hopefully have found a new hero to look up to and emulate.

Comelec opens filing of CoCs

MANILA, Philippines—A total of 18, 054 elective positions are up for grabs as the Commission on Elections (Comelec ) officially opened on Monday the filing of certificates of candidacy for national and local posts.
The filing will be open until Friday, from 8 a.m. to 5 p.m. daily, Comelec spokesman James Jimenez said in an interview over Radyo Inquirer 990AM.
“Hangggang 5pm. Walanang extension (Until 5pm. There is no extension),” Jimenez said. In the previous years, the final day’s schedule was always extended up to midnight.
In an earlier interview, Comelec chairman SixtoBrillantes said the new schedule is meant to remind the candidates to be punctual and to serve as an example to their constituents.
Only candidates who are running for the Senate will file at the main office of the Comelec in Intramuros, Manila while those vying for a congressional seat in the National Capital Region will be in the regional office located just near the tribunal’s office.
To pave the way for the filing of the CoC, Jimenez said voters’ registration will be temporarily suspended from Monday to Friday this week.
It will resume on Saturday, October 6, the spokesman added.

Justice chief: Anti-cybercrime law will protect netizens’ rights

MANILA — Justice Secretary Leila de Lima, the only Cabinet secretary who stands to be empowered more under the Cybercrime Prevention Act, gave assurance on Sunday that constitutional rights of netizens will be protected in the implementation of the new law.
Five petitions have been filed last week at the Supreme Court questioning the constitutionality of Republic Act 10175 or the Cybercrime Prevention Act of 2012, the last of which was filed by lawyer Harry Roque on Friday.
De Lima was among the respondents named in the petitions, which are set to be tackled by SC justices on Tuesday.
But de Lima, in a statement, said that she will exercise the powers granted to her by the law judiciously and prudently.
“Any power or authority granted by the law to Department of Justice and secretary of Justice will be exercised judiciously and prudently, within the standards or parameters set forth in the law and with due regard to fundamental, human rights of individuals,” she said.
De Lima, who arrived in the weekend from a forum on human rights in Washington, DC, was chair of the Commission on Human Rights during the Arroyo administration, before she was tapped to head the DOJ by President Aquino in 2010.
Under Section 19 of RA 10175, de Lima will have the authority to restrict or block access to computer data found to have prima facie violation of cybercrimes defined in the same law.
Notwithstanding the mounting legal protests against and the admission of some senators of the flaws of the law, she said her office will implement the anti-cybercrime act.
“As part of the executive branch, the role of DOJ and SOJ is simply to execute the laws of the land. We did not make that law, which should and ought to be deemed constitutional, unless otherwise declared by the SC,” she said.
Aside from Roque, the other petitioners are
businessman Louis Biraogo, the group AlabngMamamahayag (ALAM), cyberlaw experts led by lawyer Jose Jesus Disini, and Senator TeofistoGuingona III, who was the lone senator who had opposed the passage of the cybercrime bill in the Senate.
Petitioners are one in denouncing Sections 4(c), 5, 7, 12, and 19 of the controversial law, saying these infringe the rights to freedom of speech and expression, as well as have vague provisions on libel, which in effect criminalizes an online show of public opinion.
They further assailed the undue delegation of powers to the DOJ Secretary insofar as it violates the constitutional principle of separation of powers between the courts and the executive, as well as violates the citizen’s right against unauthorized searches and seizures.
Outrage over the controversial Cybercrime Prevention Act continues as a youth party-list group will go to the Supreme Court on Monday to file a petition seeking to declare unconstitutional some provisions on the new law that allegedly violate freedom of expression.
Among the early signatories to the petition for prohibition are Kabataan party-list Representative Raymond Palatino, ACT Teachers party-list Representative Antonio Tinio, University of the Philippines (UP) Student Regent Cleve Arguelles, Philippine Collegian editor-in-chief Katherine Elona, and UP College of Mass Communication Dean Roland Tolentino.
Just like other groups, Kabataan is opposing Section 19 of Republic Act 10175, which authorizes the DOJ to impose a total access ban on social networking sites in the future.
Section 19 states, “When a computer data is prima facie found to be in violation of the provisions of this Act, the DOJ shall issue an order to restrict or block access to such computer data.” (ECV/Virgil Lopez/JCV/Sunnex)

Pimentel first to file COC

MANILA — Senator Aquilino “Koko” Pimentel III on Monday morning formalized his re-election bid for the 2013 midterm elections and filed his certificate of candidacy (COC) before the Commission on Elections (Comelec) in Manila.
Although a member of PartidoDemokratiko Pilipino (PDP-Laban). Pimentel is a guest candidate of the ruling Liberal Party (LP).
President Benigno Aquino III will be announcing the complete LP ticket at 10 a.m. Monday at the Club Filipino in San Juan City.
Pimentel is the first candidate to file his COC but said it was just coincidental.
The Commission on Elections (Comelec) officially opened its offices to candidates who will be filing their Certificates of Candidacy (COCs) starting Monday to Friday for the 2013 national and local polls.
A total of 18,022 national and local positions are to be filled up in the May 13, 2013 elections.
Candidates running for senatorial positions should file their COCs at the Project Management Office at the Comelec Main Office in Intramuros, Manila.
For local positions, those who are running for congressional seats, they may file their COCs at the Office of National Capital Region Director for Metro Manila; Office of the Provincial Election Supervisor for provincial officials, including congressmen; Office of the City/Municipal Election Officer for city/municipal officials; Office of the Armm Regional Election Director for Autonomous Region in Muslim Mindanao governor and vice governor; and Office of the Armm Provincial Election Supervisor for Armm legislative assembly members.
“The Certificate of Candidacy shall be filed by the candidate personally or by his duly authorized representative, whose authority shall be in writing, under oath and attached,” the Comelec said.
Positions at stake in next year’s polls are for 12 senators, 229 district members of the House of Representatives, 80 governors, 80 vice governors, 766 members of the Provincial Government, 138 city mayors, 138 city vice mayors, 1,532 members of the City Council, 1,496 municipal mayors, 1,496 municipal vice mayors, and 11,972 members of the Municipal Government.
Other positions available are one regional governor, one regional vice governor, and 24 regional assemblymen for the Armm.
COCs will be accepted from 8 a.m. to 5 p.m. At 4:45 p.m. of October 5, if there are still persons intending to file COCs and present inside the offices, the Comelec has authorized the receiving officers to prepare a complete list containing the names of said persons, consecutively numbered, and the time of listing.(Kathrina Alvarez/Virgil B. Cebu mayor decides to quit LP

CEBU CITY – On the eve of the period for filing certificates of candidacy for the 2013 elections, Cebu City Mayor Michael Rama announced Sunday he is leaving the Liberal Party (LP).
“Starting today, I will declare having severed my ties with the LP. However, it should be emphasized that I and Team Rama will continue to support the agenda of President Benigno Aquino III,” the mayor said in a news conference he called at Rajah Park Hotel on Sunday.
“My ties with the LP will already cease to exist and I would not be any more connecting with the said party,” he added.
The mayor did not provide specific details on what prompted him to make such a decision but pointed out that the media have been reporting about it.
He apparently referred to his letter to Aquino as well as to LP president and Department of Interior and Local Government Secretary Mar Roxas, asking that he and his group be given a certificate of nomination for the 2013 elections.
Rama has not received any response from the LP headquarters in Manila.
LP’s choice
Candidates for the May 2013 election have today until 5 p.m. on Friday, October 5, to file their certificates of candidacy.
The mayor had earlier said he deserves to be given the party nomination, considering that he is a bona fide member of the LP. He is also paying their dues and regularly attends party events.
But the LP already gave a certificate of nomination to Bando OsmeñaPundokKauswagan (BOPK), which is headed by Representative Tomas Osmeña (Cebu City, south district). Osmeña will be Rama’s opponent in next year’s mayoral race. The two used to be political allies for at least six terms straight.
Asked if somebody from the LP recently called informing him that the party will not be supporting him in the 2013 elections, Rama said he doesn’t want to say anything about it.
“It’s better for them (LP) to make their pronouncement before everybody and I will answer it point by point. I don’t want to be their spokesperson,” he said.
A source said that Rama received a call from Roxas in Saturday, informing him that the LP will be supporting a non-LP member instead of the reelectionist.
Expected
Osmeña said he expected the mayor’s move.
“It’s expected because that’s what happens if you don’t give what he wants,” he said.
Also, Osmeña said nothing is unusual with the mayor’s decision, since he is cutting his ties with everyone.
“Remember, he was the one who left BOPK. He also severed ties with the captains who campaigned and voted for him,” he said.
The congressman alleged that some LP members, particularly those in Cebu Province, don’t want to support Rama because he expressed support for Governor Gwendolyn Garcia before she withdrew her plan to run for senator.
Asked if he will also be leaving LP just like Rama, Team Rama’s south district congressional candidate lawyer Aristotle Batuhan said: “I remain liberal but not necessarily part of the LP.”
Batuhan said that in recent political developments, he didn’t see the principles of justice, equity, and fairness being espoused by the LP.
Asked what his plans are now, Rama said he and his group will be independent candidates.
He refused to issue a statement when asked whether or not he will be running under PartidoDemokratiko Pilipino-Lakasng Bayan (PDP-Laban) or join the United Nationalist Alliance (UNA) coalition.
“We just have to take it one at a time. That matter (joining other national party) will be tackled in the days to come because Team Rama has many activities leading toward the filing of the COC. There will be an appropriate time for that,” he said.
New ally?
Reports circulated Sunday, though, that a spokesperson of Vice President JejomarBinay, Joey Salgado, said that Rama will be running under UNA.
Salgado, according to the report, said that Rama accepted the vice president’s invitation to run under the coalition when they met in a wedding last Saturday night.
But the mayor refused to confirm UNA’s statements. He also said he has no ill feelings toward the LP.
“I never consider anger. There is always an abundance of forgiveness, scarcity of anger and never-ending love. What is important for me is serving the people,” he said.
When he made the announcement of leaving LP Sunday, the mayor was joined by all the members of Team Rama.

Panel okays P75-B military upgrade

A BICAMERAL committee has ratified a report seeking to extend the modernization program of the Armed Forces of the Philippines (AFP) by another 15 years.
Both the House of Representatives and the Senate ratified the bicameral conference committee report on House Bill 6410 and Senate Bill 3164, establishing the revised AFP Modernization Program.
The proposed law seeks to amend Republic Act (RA) 7898 or the AFP Modernization Act, enacted by former President Fidel Ramos in 1996.
The 15-year period provided in the law expired last December 2011 with only P33 billion of the earmarked budget allocations of more than P330 billion spent.
The proposed law earmarks P75 billion for the first five years subject to the capacity of the Department of National Defense (DND) to utilize and implement the program in accordance with the Defense System of Management (DSOM).

The Revised AFP Modernization Program Planning and Procurement shall be conducted in accordance with the DSOM, which is a strategy-driven, capability-based multi-year planning and execution process.
The measure exempts certain major defense purchases, such as aircraft, vessels, tanks, armored vehicles, communications equipment and high powered firearms, from the requirement of public bidding.
The proposed law also exempts from value-added tax and customs duties, the sale and importation of weapons, equipment and ammunition to the AFP, which are directly and exclusively used for its programs.
A Congressional Oversight Committee, which will be composed of six members of the Senate and six members of the House with chairmen of the committee on national security of both chambers as chairmen, shall be created to conduct a systematic evaluation of the accomplishment and impact of the measure.
Bayan Muna party-list Representative Neri Colmenares opposed the measure, saying the AFP should explain first the anomalies surrounding the Modernization Fund.

“I believe that available funds should be allotted to social services rather than their (AFP) corruption ridden modernization. With corruption, there will be no modernization,” he said in a text message. (Kathrina Alvarez/Sunnex)

Police chief: PNP now ‘more proactive’

AMID the increased crime rate in the metro and after the dismissal of several erring cops, Philippine National Police (PNP) chief Nicanor Bartolome said the institution has now become “more proactive” in its law enforcement service.
In his performance progress report presented at the 2012 Public Governance Forum this week, Bartolome said the PNP’s mindset has been transformed from the traditional reactive practice to a “more proactive and strategic process.”
Bartolome attributed this “transformation” to the transparency and accountability mechanisms undertaken by the PNP.
He also cited the PNP’s efforts in enhancing the skills of its personnel and the emerging best practices in the organization’s administrative and operational aspects.
Early this month, Bartolome urged Metro Manila police chief Leonardo Espina to “hit hard” on criminal elements for a better police service to the public.
The PNP chief ordered to mobilize the entire 17,000-strong police force under Espina to cover “every square inch” of Metro Manila.
On the other hand, Espina called for a “proactive” police force through intensified police visibility in the field and the deployment of police patrollers in the barangays for round-the-clock and immediate service.
Espina added that law enforcers should be in the streets for 24 hours instead of being “reactive” inside their offices waiting for complaints and reports.
Lately, the PNP faced several controversies that tainted its image. The organization’s law enforcement practice was previously criticized after crime incidence in Metro Manila increased in the first six months of the year.
From January to June, authorities recorded 29,231 crimes in Metro Manila, a 57-percent increase from the 18,671 recorded incidents in the same period in 2011.
The PNP was also assailed in the past weeks after several policemen were dismissed from service due to accusations of extortion including a senior officer who tried to extract money from Espina’s son.

Aquino-backed party-list group ‘a big joke’

A YOUTH group called Saturday on the Commission on Elections to disqualify President Benigno Aquino III’s supposed “favorite” party-list group, Akbayan.
Vencer Crisostomo, national chairperson of Anakbayan, said the Akbayan party-list group, which won two seats in the 2010 elections, is neither marginalized nor underrepresented.
“If the party-list system is a joke, then the biggest joke is Akbayan. They cannot possibly claim that they are marginalized and underrepresented when their leaders hold various positions in government,” he said.

The youth group noted that Akbayan officials are holding various positions in the Aquino government, including the Commission on Human Rights chairperson Loretta Ann Rosales, former Akbayan president and the party-list group’s first representative in the 11th Congress.

Aquino also appointed former Akbayan officials Ronald Llamas as presidential political affairs adviser, Joel Rocamora as head of National Anti-Poverty Commission, and Precival Cendena as National Youth Commission commissioner.

“Allowing Akbayan to run is like allowing Malacanang and the president’s KKK (kaklase, kaibigan, kabarilan) to run for party-list. Comelec’s ‘cleansing’ of the party-list system would be meaningless if it would turn a blind eye to Akbayan,” he said.

One of the administration candidates for the midterm elections in 2013 is former Akbayan Representative Risa Hontiveros, who ran under the Aquino-led Liberal Party in the 2010 polls but failed to make the cut.
During Akbayan’s Fifth Regular Congress in May, the President denied he was being controlled by the party-list group. “We are controlled by the people,” he said.

Crisostomo added that while the poll body allows “Palace-backed party-lists” to run, accreditation of some legitimate groups like Kalikasan and Courage have been rejected.

Akbayan Representative Walden Bello, also the party-list group’s first nominee for the 2013 elections, said the accusation of Crisostomo was “expected.”

“It’s expected from an irrelevant group. Akbayan’s record of public service speaks for itself,” he said in a text message.

Roxas to take leave as Liberal Party president

INTERIOR Secretary Manuel Roxas II said Saturday he will take a leave of absence as president of the ruling Liberal Party (LP) to avoid being accused of conflict of interest amid the upcoming midterm elections next year.

In an interview after President Benigno Aquino III swore him into office in a ceremony in Malacanang, Roxas said on Monday he will submit his letter to Aquino, being the LP chairman, regarding his intention to take a leave of absence.
“The PNP (Philippine National Police) will play a big role (in the elections). The PNP will be a deputized arm of the Comelec (Commission on Elections), so to erase doubts, I decided and I requested the President that I will take a leave of absence, and he accepted it,” he said.

The PNP is under the Department of Interior and Local Government (DILG).
When he starts as DILG chief on Monday, Roxas said he will first assess the needs of the department, one of the local government units and one for peace and security.

The new DILG secretary underscored the importance of making sure that necessary structures are there for the department to function effectively.
Roxas said the primary instruction of the President is to ensure peace and security in the country particularly as the government prepares for the midterm elections in May next year.
“So we will prioritize the fight against criminality. And parallel to this is to strengthen our LGUs because they are on the frontline in bringing the government’s programs (to the people),” he said.

Roxas replaced late Interior Secretary Jesse Robredo who perished in a plane crash last month.
The new DILG chief assured that he will continue Robredo’s programs on LGUs that ensure transparency in their transactions to gain public trust in government at least at the local level.
It is necessary because the National Government allots around P300 billion to local government units each year, and they must be held accountable to the people on how they spend their money, he explained.
