Internet freedom bill filed to amend Cybercrime Law

MANILA — A party-list lawmaker on Monday proposed an “Internet Freedom” bill in Congress to effectively repeal contentious provisions in Republic Act 10175 or the Cybercrime Prevention Act.
Kabataan party-list Representative Raymond Palatino said his measure will also enumerate the rights of netizens, the supposed target of the controversial Cybercrime law, which penalizes online libel.
“If we analyze the Cybercrime law, it is apparent that it restricts rather than protects netizens. Apart from repealing RA 10175 through the Internet Freedom Bill, we intend to lay down the inalienable rights of Filipino Internet users,” Palatino said. Palatino noted that Internet access and online freedom of expression were recently added by the United Nations Human Rights Council to the list of basic human rights.
“With the Internet Freedom Bill, we seek to assert this right, and ensure that the Internet is free from censorship and totalitarian suppression,” the lawmaker said.
Senator Francis Escudero earlier said he will file a similar measure in the Senate to remove several provisions in the Cybercrime law. Meanwhile, Kabataan party-list also filed on Monday a petition for prohibition on RA 10175 before the Supreme Court.
An initial list of signatories on the said petition includes Palatino, ACT Teachers party-list Representative Antonio Tinio, UP Student Regent Cleve Arguelles, Philippine Collegian editor-in-chief Katherine Elona, and UP College of Mass Communication Dean Roland Tolentino.
Earlier, Justice Secretary Leila de Lima assured that the constitutional rights of netizens will be protected in the implementation of the new law.
As of this posting, five petitions have been filed before the Supreme Court questioning the constitutionality of the Cybercrime Prevention Act of 2012.
Section 19 of RA 10175, authorizes the justice secretary to restrict or block access to computer data found for have prima facie violation of cybercrimes as defined by law.

20 senatoriables file candidacy papers

MANILA — Twenty people trooped to the Commission on Elections (Comelec) head office in Manila to file their certificates of candidacy (COCs) for senator in the first day of the filing on Monday.
The first to officially file his COC was reelectionist Senator Aquilino Pimentel III of the Liberal Party (LP).
Pimentel filed his COC hours ahead of the administration coalition’s formal proclamation of its 12-man full slate at Club Filipino in San Juan City. Eight candidates of the United Nationalist Alliance (UNA) also filed their COCs on Monday.
They are Senator Gregorio Honasan II, San Juan City Representative Joseph Victor “JV” Ejercito, Cagayan Representative Juan “Jackie” Ponce Enrile Jr., Zambales Representative Milagros “Mitos” Magsaysay, former senators Ernesto Maceda, Juan Miguel Zubiri, Richard Gordon, former Tarlac governor Margarita “Tingting” Cojuangco.
The group was accompanied by the party leaders Vice President Jejomar Binay, Senate President Juan Ponce Enrile and former President Joseph Estrada.
UNA is a coalition of Binay’s Partido Demokratiko Pilipino-Laban and Pwersa ng Masang Pilipino of Estrada.
Senator Loren Legarda, who is seeking her last term, filed her COC at 3:50 p.m., citing feng shui of her January birthday as reason for filing at a specific time.
She also declared that this will be her last political campaign “in my life.”
“So it will be my last term,” said Legarda.
Legarda is common candidate of UNA and the LP-led administration coalition.
Comelec spokesperson James Jimenez said the 20 COCs filed Monday represent half of the poll body’s expectation of 50 applications during the five-day filing period.
The period of COC filing ends 5 p.m. of October 5 (Friday).
“We are almost half (the number) and it’s only been one day,” Jimenez said.
Aside from the big and influential names in politics, several other unknown individuals filed their COCs for senator.
Among them was a man claiming to be the husband of presidential sister Kris Aquino, another one who identified himself to be the “owner” of the Philippine archipelago, and a senatorial wannabe who claims to be “most qualified” for being like national hero Dr. Jose Rizal.
Kris Aquino’s “hubby” Daniel Magtira, businessman Salam Lacan Luisong Tagean and Merlito Lagata filed their COCs for senator.
Magtira, the third to file his COC, said in a television interview that he wants to wed first the Queen of All Media and youngest sister of President Benigno Aquino III before concentrating on his Senate run.
He admitted that he was a multiple-time filer for national posts but has never made the final list. He gave out t-shirts to members of the media bearing the words “Happy Birthday Daniel Magtira. Love Kris Aquino, First Lady Imelda Marcos” and even threw out coins before leaving the Comelec premises.
Tagean, for his part, claimed that he is the “legitimate owner” of the whole archipelago, including the Panatag (Scarborough) shoal in the West Philippine Sea., owing back to their forefathers in the 13th century.
He said he wants to run as senator in order to rectify the things such as the issues on Scarborough Shoal and Spratly Islands.
“Nagkakaroon tayo ng problema sa Spratlys at Scarborough Shoal. E kung sabihin ko kung sino ang tunay na may-ari? Buhay ang heir! Hindi pwedeng kunin sa amin ang legality niyan,” said Tagean.
Lagata, the 18th person to file COC, is again seeking a Senate seat. He first tried his luck in the 1992 elections but was declared a nuisance candidate by the Comelec.
Lagata, who claimed that he was like Jose Rizal and is qualified to run for Senate, asked a television reporter for her hand in marriage and joked that he was a good kisser.
Aside from the three, other lesser known COC filers are Anicio Escosura, Aerio Bernardino, and Melchor Chavez.
Marcos loyalist Oliver Lozano and broadcast journalist Melchor Chavez also filed their COCs and will run under the Kilusang Bagong Lipunan, the political party formed by the late strongman Ferdinand Marcos.
Jimenez said the first day of the filing of COCs went smoothly.
“I think the day has been very successful. Except the number of people outside and the volume of activities outside, all of the activities in here went very smoothly. Walang hassle (No hassle),” he said.
Metro Manila police chief Leonardo Espina said the overall situation on the first day of the filing period was “generally peaceful” and that security around the Comelec main office in Intramuros, Manila, has been beefed up.
Espina said the first day of the COC-filing “was accentuated by convoys, caravans, marching bands and festive atmosphere.”
The Comelec, however, criticized the continued practice of some politicians of employing fiesta-like motifs in filing their COCs despite the earlier appeal by the poll body to keep the five-day process dignified.
Comelec Chairman Sixto Brillantes said it was sad that politicians chose to ignore the appeal of the poll body in ridding circus-like environments during the COC filing, which began Monday.
“The filing looks like a circus. This is a very dignified process,” Brillantes said, adding that some group use the event as a venue to campaign early.
Outside the Palacio del Gobernador building in Manila, bus loads of supporters of UNA candidates flocked the vicinity early in the day carrying streamers, tarpaulins and cheering on the names of their candidates.
There were also some groups that featured bands while other camps held picnics in the nearby plaza.
Over the weekend, Brillantes appealed to candidates to avoid having lavish programs for their COC filing by bringing along a throng of supporters.
But the Comelec chair admitted that the candidates are not violating any laws when they organize their supporters since there is no law against premature campaigning.
“As we have said, it may not be unlawful but it is definitely against ethics,” said Brillantes.
In the Iloilo provincial office of Comelec, the candidates of United Nationalist Alliance were first to file their COCs.
In Davao City, it was a quiet day at the Comelec city office on Monday as only two candidates, who can be regarded as serious contenders, filed their candidacy papers.

Bill providing insurance to election workers nears final approval

MANILA — Election workers and officials will soon have insurance coverage once Congress passes House Bill 6528.
The measure recently approved on second reading in the House of Representatives creates a compulsory insurance for election officials and workers during national and local polls.
The compulsory insurance will be for the members of the Board of Election Inspectors (BEI), Special Board of Election Inspectors (SBEI), the Board of Election Tellers (BET) and their support staff for every national and local election.
“The compulsory insurance is one way the State could concretely express its recognition of the crucial role of the members of the BEI, SBEI, the BET and their support staff and the dangers that attend every election,” A-Teacher party-list Representative Juliet Cortuna said.
Under the proposed law, election workers and officials shall be entitled to death benefits amounting to P200,000, and hospitalization and medical expenses until his or her recovery.
The coverage starts from, but not limited to, the acquisition of election paraphernalia and it shall be terminated upon proper turn-over of the same to the appropriate receiving officer or until any election-related risk is no longer present, the bill states.
The House of Representatives is expected to be passed on final reading when Congress resumes session on October 8.

Chiz seeks re-election, shuns campaign sorties

REELECTIONIST Senator Francis Escudero neither confirmed nor denied that the Liberal Party asked him and two other candidates not to join the campaign sorties of the United Nationalist Alliance (UNA).
Escudero, along with Senator Loren Legarda and Movie and Television Review and Classification Board (MTRCB) chair Grace Poe-Llamanzares, are listed as guest candidates of UNA.
“Anumang isyu maaayos din yan, tatlong buwan pa bago magsimula ang kampanya. Pangalawa, hindi naman ako sumasampalataya sa rally kundi sa bagong uri ng pangangampanya gamit ang tradisyunal at lalo na ang bago (social media),” he told reporters.
The senator has been a consistent frontrunner in pre-election surveys, making him attractive to the UNA of Vice President Jejomar Binay and Liberal Party of President Benigno Aquino III.
An official of the administration coalition maintained that it would be awkward for common candidates like Escudero to join campaign rallies of UNA.
“It will be difficult for these three candidates (Senator Escudero, Senator Loren Legarda Legarda, Grace Poe) to appear in the stage of the other side because, in effect, they are junking the other nine candidates of the administration. It will create practical difficulty,” Senator Franklin Drilon, campaign manager of the Liberal Party-led coalition, said.
Drilon however dismissed the possibility of imposing sanctions to the common candidates should they decide to attend any UNA activity.
“We are not talking here about sanctions; we are talking here about cooperation,” he said.
As for its campaign strategy, the administration slate might limit the campaign rallies in major cities in the country to temper expenses. The LP coalition will also try to gain wider support through the use of social media tools such as Facebook and Twitter, according to Drilon.
Reporters covering the poll body were also looking for Escudero’s rumored girlfriend Heart Escudero but she was nowhere to be found.

Villar’s wife: Nothing wrong with early TV ads

MANILA — Former Las Piñas City Representative Cynthia Villar, wife of incumbent Senator Manny Villar, sees nothing wrong with television advertisements promoting the Villar Foundation just months before the 2013 senatorial elections.
“I don’t find anything wrong with it. We offer good projects and through the advertisements, many local government units have already partnered with us,” she told reporters as she filed her certificate of candidacy Tuesday morning.
Villar explained that the television ads was one way to introduce the Villar Foundation, which was also celebrating its 20th year anniversary this year.
Senator Villar, the wealthiest among the presidential candidates in the 2010 polls, was the biggest spender for television advertisements.
Candidates running for senator in the 2013 polls will start campaigning February next year.
Villar, who is running under the Liberal Party-led slate, filed her certificate of candidacy before the Commission on Elections (Comelec), with his husband senator and son, incumbent Las Pinas Representative Mark Villar. She is a member of the Nacionalista Party (NP), one of the political parties the LP will coalesce with for the 2013 midterm polls.
On Monday, Villar and former Senator Jamby Madrigal decided to bury the hatchet after exchanging harsh words over the controversy in the C-5 road project against Senator Villar.
Madrigal, a new member of LP, is also running for senator.
“There is no problem. We have moved on, it’s the secret of our success. We’ve moved on after certain points because there is no use crying over spilled milk,” Mrs. Villar said during the proclamation of LP candidates.
Madrigal also ran against Senator Villar in the 2010 elections but both lost to President Benigno Aquino III.
In an interview with reporters, Mrs. Villar also vowed to support the freedom of information (FOI) bill if she wins in the 2013 senatorial elections.
“I am supportive of the FOI bill,” she told reporters.
Just like his husband, the NP candidate is also against the controversial reproductive health bill.

PNP maintains: P1.2-B pistol deal ‘transparent’

MANILA — Amid the graft charges filed against several of its top officials, the Philippine National Police (PNP) reiterated that there were no irregularities in the recently-signed P1.2-billion pistol deal.
Chief Superintendent Generoso Cerbo Jr., PNP spokesman, assured that the entire procurement process is consistent with government regulations and denied the allegations of two losing bidders who filed a complaint at the Office of the Ombudsman.
“As far as the PNP is concerned this particular contract is most thoroughly transparent and most advantageous for the government such that and unprecedented savings of P200-million was generated from this particular transaction,” Cerbo said.
On Monday, losing bidders Roferma Enterprises and Kolonwel Trading represented by their respective presidents Romulo Maningding and Peter Go Cheng filed several counts of grave misconduct in relation to Republic Act 3019 or the Anti-Graft and Corrupt Practices Act against PNP chief Nicanor Bartolome, Deputy Director General Emelito Sarmiento, and Logistics Director Arnulfo Perez.
Sarmiento and Perez are also the chairman and vice chairman, respectively, of the PNP Bids and Awards Committee (BAC).
Twelve other police officers, mostly BAC members, were also accused.
According to the complaint, the accused PNP officials allegedly abused their authority when each interested bidders were required to buy the bidding documents at P275,000 so that their cost of production would be recovered.
The said excessive amount discouraged most suppliers from participating and reduced the open and competitive nature of the bidding process.
Nevertheless, seven suppliers purchased the bidding documents but then the BAC allegedly altered the bid rules by requiring the contractors to provide extra ammunition for each pistol.
The joint venture of R. Espenile and Israel Weapons Industries was earlier declared as the lowest and winning bidder but was later disqualified by the BAC for lack of certain documents.
The deal was eventually awarded to the joint venture of Trust Trade Philippines and Glock Asia Pacific Ltd., the second lowest bidder.
The PNP still welcomed the complaint, saying the court is the proper venue to end the issue.
“We view this as an opportunity to clarify everything and close this chapter once and for all,” said Cerbo.
The P1.198-billion pistol deal, which was signed by Bartolome on September 20, will provide 59,904 units of 9mm Glock 17 Generation 4 pistols to the police force.
The purchase is seen to fill up the needed short firearms of policemen and would replace their old revolvers.

Government team probing priest over ivory trade barred

The Department of Environment and Natural Resources (DENR) in Central Visayas and the National Bureau of Investigation (NBI) began their investigation on a priest’s ivory collection by visiting his convent and residence in Barangay Cansojong, Talisay City on Friday.
But the investigating team was not allowed to enter the Archdiocesan Shrine of the Black Nazarene, the Society of the Angels of Peace (SAP) and Msgr. Cristobal Garcia’s residence because they were accompanied by news reporters, said DENR information officer Dr. Eddie Llamedo.
DENR Undersecretary Ernesto Adobo said they learned that Garcia was confined in a hospital so they decided to defer interviews with him. A National Geographic article in the magazine’s October issue on the illegal ivory trade mentions Garcia.
Lawyer Bryan Christy, the author of “Ivory Worship,” alleged that the priest gave him pointers on how to smuggle items made of ivory, which has been banned for 22 years.
DENR-Central Visayas executive director Isabelo Montejo said in a press statement that the investigation will not only focus on Church officials but will also include private persons and shops in Central Visayas.
“We will determine if these pieces … have the needed certifications or permits from appropriate agencies,” he added.
Adobo said the DENR has information on other areas and other ivory collectors, but he refused to give names.
He said the owners of items made of ivory should be able to show that they bought these from legal sources.
“If not, they would be liable under the anti-fencing law. They can’t say that they do not know the law,” said Adobo during a press conference at the DENR-Central Visayas office on Friday.
Those who possess raw ivory must be able to present documents certifying that the item comes from a legal source. Owners of finished products need only to show a receipt or proof of purchase from a legitimate source.
The investigation team will involve wildlife research personnel who can determine if the item is made of real ivory.
Since DNA (deoxyribonucleic acid) testing is expensive, investigators will have to resort to applying heat to the item to determine if it is made of ivory and not plastic or resin.
Adobo said they are inviting other organizations to join the investigating team such as the National Museum, which has expertise on heritage items, and the Bureau of Customs and other agencies specified in the Convention on International Trade in Endangered Species of Wild Fauna and Flora (Cites) management team.

Police ‘failure’ blamed for Makati demolition violence

MAKATI Mayor Junjun Binay asked on Monday the Philippine National Police (PNP) for better police efforts during clearing operations to prevent the repeat of last week’s violent demolition in Makati City.
In a letter to PNP chief Nicanor Bartolome, Binay said law enforcers should “heed the lessons” of the recent demolition efforts in Guatemala Street, Barangay San Isidro, wherein 27 people were injured due to the aggressions that erupted.
In the recent incident, residents threw rocks, broken glass bottles, Molotov bombs, and even human waste to the members of the clearing operations team.
Binay said despite reports that the residents and militants have already prepared on the night before the demolition, the Southern Police District (SPD) deployed additional personnel only on the day of the clearing operations.
He added the police force was not enough to deter the residents who were ready to defy the demolition.
“I strongly feel that this information alone would have been sufficient basis for the SPD to act on our request. A strong and overwhelming police presence would have discouraged the very few agitators from sowing violence,” said Binay.
The Makati mayor also criticized the “initial reluctance” of the police to immediately act when the violence erupted.
“The PNP seems to have allowed the agitators to throw Molotov cocktails, stones and other materials for more than three hours before it moved in to stop the violence,” said Binay.
“My belief is that response to criminal acts should be swift in order to prevent further violence and damage to lives and properties,” he added.
Meanwhile, the police said they are reviewing the possible violations and shortcomings allegedly committed by policemen during the recent demolition.

Budget chief: Standing on two platforms is problematic

JOINING the campaign rallies of two different parties would be problematic, a leader of the ruling Liberal Party (LP) said Monday.

Budget Secretary Florencio Abad said the so-called common candidates should comply with the policy of the ruling party not to join campaign rallies of the rival – United Nationalist Alliance (UNA) – to avoid problem with the coalition.
“You know it’s going to be problematic not just for the candidates of all but also for the coalition. That’s why that policy precisely is meant to promote equity, fairness and harmony within the parties’ coalition,” said Abad, an LP stalwart.

Abad said those serving two parties at the same time are making themselves vulnerable to intrigues.
Senators Loren Legarda and Francis Escudero, and Movie and Television Review and Classification Board chairperson Grace Poe-Llamanzares are common candidates of the administration party led by President Benigno Aquino III and UNA of Vice President Jejomar Binay.
Abad said while the three agreed to be adopted by UNA, they still have to campaign under one party.

“You have to make a distinction between being adopted and campaigning with. You can be adopted without necessarily having to join them in their campaigns. You continue to endorse your slate. But the moment you endorse two slates, you’re going to be fodder for intrigues,” he said.
Asked if all three have submitted to the rules of ruling party, he answered: “Common sense dictates that even if you are not informed about it, you would know as a politician that if you stand on two platforms endorsing two sets of candidates, who will believe you? You will just yourself into trouble.”

President Benigno Aquino III on Monday led the proclamation of the final senatorial slate of the administration coalition at Club Filipino in San Juan City.

Aside from the common candidates, also included in the line-up are reelectionists Senators Alan Peter Cayetano, Aquilino “Koko” Pimentel III and Antonio Trillanes IV; former senators Ramon “Jun” Magsaysay Jr. and Jamby Madrigal; Aurora Representative Juan Edgardo “Sonny” Angara; former Las Piñas congresswoman Cynthia Villar; former Akbayan party-list representative Risa Hontiveros; and Aquino’s first cousin, Paolo Benigno “Bam” Aquino IV.

The candidates were drawn from five different parties: LP, Nationalist People’s Coalition led by Aquino’s uncle Danding Cojuangco, Nacionalista Party of Senator Manuel Villar, Laban ng Demokratikong Pilipino led by Senator Edgardo Angara, and Partido Demokratiko Pilipino-Lakas ng Bayan (PDP) founded by Pimentel’s father and former senator Aquilino Pimentel Jr.

Abad said it is normal in Philippine politics to see candidates who are not allies but belong to the same party.

“That happens in Philippine politics, it’s nothing new. What is important is that the head is very clear about what the direction should be and I think that’s most important because that’s where the coalition should be headed,” he said.

He added that even President Aquino is satisfied with the administration slate knowing that they are pushing for one advocacy.

UNA releases 12-man senatorial slate

CURRENT and former senators and scions of political clans are among those who made it to the final senatorial line-up of the United Nationalist Alliance (UNA) of Vice President Jejomar Binay and former President Joseph Estrada for next year’s midterm polls.
They are Senator Gregorio Honasan II, San Juan City Representative Joseph Victor “JV” Ejercito, Cagayan Representative Juan “Jackie” Ponce Enrile Jr., Zambales Representative Milagros “Mitos” Magsaysay, former senators Ernesto Maceda, Juan Miguel Zubiri, Richard Gordon, former Tarlac governor Margarita “Tingting” Cojuangco and businessman Joey de Venecia III.
Senators Francis Escudero and Loren Legarda and Movie and Television Review and Classification Board (MTRCB) Grace Poe-Llamanzares complete the roster as guest candidates. The three are also included in the line-up of the ruling Liberal Party led by President Benigno Aquino III.
In an advisory released by the Office of the Vice President, the coalition will assemble at the Manila Hotel at 11 a.m. Monday before proceeding to the headquarters of the Commission on Elections (Comelec) for the filing of certificate of candidacy (COC) at 1 p.m.
Binay will be joined by Estrada, Senate President Juan Ponce Enrile and the senatorial bets except for the guest candidates. Escudero had said he will file his COC as independent on Tuesday.
President Aquino, for his part, is expected to announce the administration senatorial slate on Monday at Club Filipino in Greenhills, San Juan.
Deputy presidential spokesperson Abigail Valte, in her weekly interview over Radyo ng Bayan, said the President will deliver a speech at the event scheduled at 10 a.m.
Valte does not know if the senatorial candidates of LP will be filing their COCs after the proclamation.
Meanwhile, environmental group Eco Waste Coalition called on politicians to moderate their garbage and keep the vicinities of Comelec offices clean and without litter as they file their COCs from October 1 to 5.
“Enlightened voters will not be pleased to see obsessive candidates holding wasteful gatherings and parades, creating trash and chaotic traffic, as if they have already won the trust of the electorate,” said Von Hernandez, president of Eco Waste.
The EcoWaste Coalition, as in past elections, will provide the public with guidelines on how to identify and select “green” candidates, and will actively promote waste prevention and reduction before, during and after the campaign period.
