Aquino names de Lima replacement in JBC

MANILA (2nd Update) — President Benigno Aquino III has designated Undersecretary Michael Frederick Musngi of the Office of the President to replace Justice Secretary Leila De Lima as the Executive department’s representative in the Judicial and Bar Council (JBC).
“I hereby designate Attorney Michael Frederick L. Musngi, Undersecretary of the Office of Special Concerns, Office of the President, as the representative of the Executive Branch, vice Secretary Leila M. De Lima, for the sole purpose of participating in the deliberations of the Judicial and Bar Council for the selection of nominees for the position of Chief Justice,” Aquino said in his letter to the JBC dated July 19.
De Lima inhibited herself as ex-officio member of the JBC from the selection process after she accepted the nomination for the post of Chief Justice.
The JBC has acceded to the request of Executive Secretary Paquito Ochoa Jr. in behalf of the President to assign a substitute for de Lima to ensure that the three branches of government are equally represented in the deliberation of the council.
Following an en banc meeting, the council wrote to the Executive Secretary on July 17, 2012, that it had “agreed to accept the designation of a representative of the Executive Department in the JBC whose rank is not lower than Undersecretary.”
Ochoa earlier declined to confirm the appointment of Musngi in the JBC, the body task to screen qualified applicants for the position of Chief Justice.
“Not privy to it. Legally and technically there is no Palace representative to the JBC,” Ochoa told Sun.Star in a text message.
Musngi, who heads the Office of Special Concerns under the Office of the Executive Secretary, is a graduate of the Ateneo School of Law, and has been in government service since 2002, having worked at the Government Service Insurance System, the Department of Agriculture, the Department of Agrarian Reform and the Subic Bay Metropolitan Authority.
He is the official representative of the Office of the President as ex-officio board member in the Maritime Industry Authority, the Philippine National Railways and the National Housing Authority.

Alternate routes for Aquino’s state address announced

MANILA — The Metropolitan Manila Development Authority (MMDA) has announced alternate routes for private and public utility vehicles for Monday, July 23, when President Benigno Aquino III will deliver his State of the Nation Address (Sona).
Aquino will deliver his third state address at the Batasan Pambansa in Quezon City.

The MMDA rerouting traffic plan advises motorists from Commonwealth-Fairview Edsa to take a right turn to Regalado, right turn to Dahlia, left turn to Chestnut, right turn to Old Sauyo Road, left turn to Mindanao Ave., right turn to Congressional, and right turn to Edsa.
Those coming from Edsa-Congressional will have to make a right turn to Congressional, left turn to Mindanao Ave., right turn to Old Sauyo Road, left turn to Chestnut, right turn to Dahlia, left turn to Regalado, and left turn/right turn to Commonwealth.

Ex-lawmaker slams cops for removing ‘thank you’ signs

Former fourth district lawmaker Juan Pablo Bondoc has assailed the local police for removing the residents’ tarpaulins expressing gratitude to her sister, Congresswoman Ana York Bondoc-Sagum, for various projects implemented in this town.
Bondoc said their supporters informed him that policemen, under the leadership of Chief Inspector Paul Gamido, removed on Thursday morning the sign boards previously placed atop electric posts and house fences.
“Naging tradisyon na ng mga tao sa fourth district ang magpasalamat sa mga proyekto ng mga opisyales. O ngeni pemaklas da na la man reng streamers a kaswelu at paralan para magpasalamat da reng memalen,” Bondoc said.
He described the incident as political harassment considering that he already announced his plan to seek the congressional seat in the next year’s polls.
According to Bondoc, some politicians are probably behind the removal of the tarpaulins and they are only using the local police.
Bondoc claimed that his sister was singled out because the billboards of Mayor Leonora Wong and Candaba Mayor Jerry Pelayo were not removed.
Paul Balingit, chairman of Barangay San Roque, Macabebe town, said they recovered only 14 out of the more than 200 pieces of tarpaulins from the police station.
Balingit said some of the sign boards were used as covers of comfort rooms and backyard at the police station.
“Minta kami pu pulis station at Karin mila ikit reng tarpaulin. Melunus ku pu at me-touch kasi gewa dalang panabing keng cr at paminggalan,”
Balingit said Gamido denied that his men were the ones who removed the thank you signages. “Aliwa kanu reng pulis reng menanggal.”
The barangay chief added that Gamido even said that posting of signages along the highway is prohibited by law.
He said Congresswoman Bondoc deserves due respect because she was elected by constituents in the district’s eight towns. “Bakit hindi siya iginalang. Kung pwedeng nilang gawin yun sa isang opisyal, sa amin pa kayang malilit na mamamayan.
Bondoc said the residents are planning to file charges of abuse of authority, theft, and others against Gamido and his men in connection with the incident.
“Natatakot po ating mga kababayan dahil armado ang mga nagbaklas ng mga pasasalamat nila. Masama ang loob nila kasi wala silang magawa,” Bondoc said.
Board Member Nestor Tolentino said Pampanga Police Director Edgardo Tinio vowed to conduct an investigation on the incident.
“Magtaka ya naman I PD (Tinio). Sabi na pin e’la dapat makialam reng pulis keng politics. Napakatahimik ng San Simon tapos may mangyayaring insidenteng ganyan,” Tolentino said.
Bondoc stressed that he, together with the people, will not allow an environment of fear in his district. “Sigurado may sagot jan ang taong bayan [sa susunod na eleksiyon],” he said.

Bataan Freeport hosts 54 locators

THE P150-million land development project at the Freeport Area of Bataan (FAB) was boosted by the recent opening of a gasoline station catering to locators at the Freeport in Mariveles town.

The on-going development project is one of the 54 locators at the FAB, said the Authority of the Freeport Area of Bataan (AFAB) in a statement on Tuesday. It added that three firms have pending applications.

AFAB Chairman and Administrator Deogracias G.P. Custodio and officials of the One Source Petroleum Marketing Corporation opened the gas station, One Source.

The AFAB said the station is part of the development project that will also bring in a number of restaurants, an atrium and a hotel fronting the magnificent view of the FAB coastline.

Named as the Cosmopolitan of Mariveles, this port side development will also boast a ferry terminal with promenades open to the FAB locators and visitors.

“This is another exciting development at the FAB for it opens much needed employment opportunities as well as answers the needs of our locators,” said Custodio.

“The FAB has been the investment destination of choice of foreign and local companies. These companies created job opportunities for Bataeños while enjoying the superior incentives that the FAB offers,” he added.

The Chinese restaurant Hap Chan opened a branch at the FAB earlier this year.

“There is a good investment climate here. Because this is a Freeport, there’s a lot of tax privilege we can enjoy.

And there’s good support from the congressman of Bataan,” said Samuel Lee, owner of Hap Chan FAB.

He was referring to Second District Rep. Albert Garcia, author of the law that converted the former economic zone into a Freeport in 2009.

Twenty Oaks Duty Free and Hypermart also owned by Lee will soon open at the FAB.

“The FAB is set to define the new model for global freeport Asia,” said Custodio.

Thousands to join Milo marathon-Angeles leg on July 22 Organizers distribute rubber shoes to less fortunate students

ANGELES CITY – More than 6,000 runners, athletes from various sports events and enthusiasts will join this year’s Milo marathon here on Sunday morning.

Rosever Pascua, head of the Angeles City Sports Office (ACSO), said at least 6,093 runners have registered as of yesterday (July 19). “Our target is 6,100 so we only have seven more slots but if there are still participants, I think we can ask for more slots from Milo organizers.”

Records from ACSO showed that at least 243 have registered for the 21k; 150 for the 10k; 4,700 for the 5k and 1,000 for the 3k category.

Most of the participants are varsity players and students from various private and public schools (college, high school and elementary) in this city.

The race (all categories) will start at the main gate of the city hall, near Marquee mall and will also end there. (please see map)

Milo organizers also distributed 500 pairs of brand new rubber shoes to less fortunate students of various elementary schools that include Belen Homesite, Cutud, Teodoro Tinio, Abelardo Tinio, and Pulungbulu.

Mayor Edgardo Pamintuan, Vice Mayor Vicky Vega-Cabigting and city councilors are also expected to grace the event.

Members of the Philippine National Police, Bureau of Fire Protection, medical staff, volunteers and traffic enforcers are on standby for any untoward incident.

Pascua earlier said that proceeds from the event will be used to buy additional sports equipment for various teams who will compete and represent this city in next year’s Central Luzon Regional Athletic Association (CLRAA).

“We could also use the proceeds to buy tree seedlings for Mayor Edgardo Pamintuan’s One Million Tree project,” he said.

Bataan observes 34th NDPR Week PWDs want equal opportunity in employment

BALANGA CITY – Persons with Disabilities (PWDs) started on Wednesday the observance of the 34th National Disability Prevention and Rehabilitation Week with a long motorcade and a lively program at the Bataan People’s Center here.

Marilyn Tigas, provincial social welfare and development officer, said there are 2,348 card-bearing members of the Federation of Persons with Disability in Bataan.

She said that there is an ongoing campaign in barangays to convince other PWDs to register.

The provincial celebration has for its theme “Mainstreaming Persons with Disabilities in Economic Development.”

PWDs in various towns showcased their products like kasuy, kasuy wine, araro cookies and other delicacies.

Gila Garcia, consultant to the Bataan governor and Yay Lasam, provincial director of the Department of Trade, led in the ribbon-cutting for the products display.

Hearing-Impaired students presented a dance number. A woman temporarily shoved her crutches and danced much to the enjoyment of the crowd. A man with impaired hearing joined her later in the dance floor.

Rommel Arellano, marriage counselor and a Psychology graduate, said PWDs are already happy because they are being recognized after the passage of a law.

“Kumpleto ang batas kaya lang may pagkakataon na may diskriminasyon pa rin sa employment. Sana magkaroon kami ng pantay na karapatan,” he said.

He said that they wanted to be dependent on themselves and not on others. He advised other PWDs to have positive attitudes. “Walang dahilan para ma-discourage tayo sa ating kalagayan sapagka’t espesyal tayo sa Panginoon,” he said.

Arellano is focal person for family and community services under the municipal social welfare and development office in Limay, Batan. He said that he has been crawling since he was one after being afflicted with polio until he reached college.

“Natapos ko ang Psychology sa pamamagitan ng paggapang all throughout my life. Nagkaroon lamang ako ng wheelchair nang college na ako,” he said.

Janice Flores of Hermosa, Bataan said she was thankful to government for at least giving them support.

“Pero mas gusto sana namin ang accessibility sa mga mismong munisipyo namin para maka-join kami sa affairs ng community,” the woman with one leg said.

She said she enjoyed her identification card receiving 20 percent discount on theaters, transportation and medicines.

But Flores has not forgotten what happened to her 20 years ago when a car hit her and caused the amputation of her leg. “Sana kumpletuhin ang tulong sa akin ng may ari ng kotseng nakasagasa sa akin,” she appealed.

‘Diwata’ bats for responsible mining

MAKATI CITY – Former Foreign Affairs Sec. Delia Albert led on Wednesday the grand launch here of a non-government organization advocating for the responsible development of the country’s wealth of resources in the field of mining, quarrying, oil and gas.

Albert, first woman foreign affairs secretary, said their group Diwata Women in Resource Development Inc. is an advocate and partner in the campaign for responsible minerals development and “especially committed to the advancement of women’s and indigenous people’s rights.”

She is the spokesperson and prime mover of Diwata which, according to Philippine mythology, are nature spirits and one with Mother Earth.

In her speech at the launching in Ayala Musuem, Albert said Diwata ‘“is protector of the environment.”

She urged the responsible use of Earth’s resources to end poverty, stressing that “all must earn.”

In Central Luzon, active mining is undertaken in Zambales, notably in Botolan town. The area is rich in chromite regarded as the most important material used in making guns, missiles and rockets.

Earlier, legitimate Zambales-based mining operators, including Consolidated Mines Inc. (CMI), complained illegal small-scale miners hauling chromite ore stockpiles, which were shipped to China.

DIWATA incorporator Gie Veloso said their group promotes dialogues among “all stakeholders,” including small-scale miners.

In Pampanga, Gov. Lilia Pineda collected at least P505 million barely on her second year in office from the extraction of sand materials largely used for making houses and buildings. Her collection for two years is the highest-ever recorded in the history of the province.

She had used portions of the funds for her priority projects on health and concerns on women and children.

Rochelle Hilario, marketing and communications manager of Philex Mining Corp., said their company had “certain (mining) tenements” in Central Luzon and other parts of Luzon. But she pointed out that Philex, regarded as the largest mining firm in the country, only operates one mining firm in Benquet province at the Cordillera Administrative Region in North Luzon.

Hilario said she had joined Diwata “as her personal advocacy to promote responsible mining and the welfare of women in the field.”

She added that Philex chaired by Manuel V. Pangilinan is ready to help “in any way” Diwata and its advocacies.

Hilario said that the Philex has more than 2,000 workers. She added that they have women geologists and high-ranking officials.

Hilario is one of at least 50 members of Diwata composed of mining engineers, geologists and other professionals in the field of safety, law, metallurgy, accounting and finance social science and communications.

Diwata also urged a dialogue on Executive Order No. 79, the mining policy recently signed by President Aquino.

The group wants to tackle the EO’s impact and effects on women in mining project areas.

PH outranks US, developed countries in ‘environmental governance’

CITY OF SAN FERNANDO – The Philippines has outranked the United States, Australia, Singapore and South Korea in “environmental governance”, according to the recent 2012 Environmental Performance Index (EPI) of Yale and Columbia universities.

The regional office of the Department of Environment and Natural Resources (DENR) here quoted Environment Sec. Ramon Paje as saying that the Philippines landed 42nd in the list of 132 countries in the EPI list, higher than the US and the other developed countries.

The EPI index placed the US, Australia, Singapore and South Korea in rankings 48, 49, 52, and 61, respectively.

Switzerland was top in the list.

“The Philippines moved up from number 50 two years ago and maintained its 8th position in the Asia-Pacific region,” he revealed. Paje attributed the country’s marked improvement in environmental performance to “concrete programs on environmental protection that mostly involved community participation.”

The EPI studies data to analyze the global community’s performance on certain policy issues against environmental pressures, and it is used to steer countries toward environmental sustainability.

“In Central Luzon, the implementation of a moratorium on logging on natural and residual forests under Executive Order 23, and the continuing implementation of the National Greening Program (NGP) under Executive Order 26 complemented government’s thrusts on environmental protection and restoration,” the DENR said.

It noted that “intensified forest protection and mopping up operations of the DENR here resulted in the confiscation of 212, 517 board feet of assorted forest contraband worth at least P7 million last year.”

“This brought to at least four million board feet the total volume of forest contraband already confiscated by the DENR since it embarked on a massive campaign in 1995 to save the remaining forests of Central Luzon,” the DENR reported.

It said that of the four million board feet, a total of 133,608 board feet of lumber were donated to the Department of Education (DepEd) for the improvement of school buildings and construction of learning facilities in the region.

“More than 85,000 hectares of Central Luzon’s denuded forestlands have also been reforested through various schemes since 1994, topping the annual reforestation average of 6,000 hectares,” DENR regional executive director Maximo Dichoso said.

Dichoso also said about three million indigenous forest and fruit trees, mangrove propagules and bamboo cultivars were planted last year in over 5,000 hectares of protected watersheds, agroforestry, mangrove and urban areas under the NGP.

“NGP aims to rehabilitate 1.5 million hectares of denuded forestlands in six years, from 2011-2016, and is expected to contribute substantially to carbon sequestration and mitigate the adverse impacts of climate change,” said Dr. Sofio Quintana of the regional forest management services.

A total of 3, 887 kilometers of forestlands in the region were also delineated with 8,196 concrete markers to address the issue of squatting and illegal titling in public forests, he added.

The DENR earlier forged a Memorandum of Agreement with Brig. Gen. Alan Luga of the 7th Infantry Division of the Philippine Army based in Fort Magsaysay, Nueva Ecija, to step up the government’s campaign against illegal logging in Central Luzon.

Since the creation of special “Green Courts” four years ago, 18 illegal loggers have already been sent behind bars in the region.

The Supreme Court has designated at least 117 “Green Courts” that exclusively try environmental law offenders in the country in a bid to put more teeth in the implementation of environmental laws and ordinances.

S.O.F.A. PNoy gets ‘ocean-deep’ mark from fisherfolk

ANGELES CITY- In time for Pres. Aquino’s State of the Nation Address (SONA), the country’s biggest fisherfolk’s alliance issued yesterday its own State of the Fisherfolk Address (SOFA) giving the Aquino government an “ocean-deep” failing mark in helping 1.3 million small fishermen nationwide.

“Instead of providing the necessary socio-economic infrastructure for genuine development and increasing fish productivity and incomes, the President, like his predecessors, is hell bent on pursuing projects detrimental to fishing families and the national interest,” said the Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) in its SOFA.

Pamalakaya national chair Fernando Hicap said “President Aquino’s government has been treating 1.3 million small fishermen nationwide like children of lesser gods.”

“Fisherfolk and fishing communities have virtually been under attack from development projects under the ambitious Public Private Partnership (PPP) which offered many fishing areas and villages have been offered to the highest bidders,” he said.

Hicap cited the case of Laguna Lake “where a master plan would be implemented for 54 big ticket projects including the construction of 100-kilometer round dike around the lake and development of high end condominiums that would initially displace 82,000 households or nearly half-a-million people mainly fishermen, farmers and urban poor.”

Hicap also noted that “the National Reclamation Plan of the Philippine Reclamation Authority (PRA) has been authorized to develop 38 major reclamation projects along the bay involving 26, 234 hectares of foreshore land areas.”

“All in all, there are 102 reclamation projects in the country are up under the PPP,” he added.

“The impacts of reclamation include destruction of marine habitats and ecological balance, loss of livelihood and community displacement of fishing villages, diminution and eradication of the natural defense barriers of coastal communities, as well as climate change and storm surges,” he stressed.

Hicap also cited the “sad stories” wrought by widespread magnetite mining in many coastal areas.”

“The Department of Environment and Natural Resources (DENR) and the provincial and local government units in Cagayan refused to recall magnetite mining activities in the towns of Aparri, Buguey, Lallo, Camalaniugan, and Gonzaga from ravaging the marine environment of Cagayan River and its coastal areas.

About 12,000 hectares of Cagayan coastal area is primed for black sand mining at the expense of livelihood and environment,” he noted.

Pamalakaya, in another statement issued together with Anakpawis party list, also cited the controversial Aurora Pacific Economic Zone and Free Port (Apeco) project as one of the anti-poor PPP projects of the administration.

The two groups described Apeco as a result of “the long-running political horse trading between the Aquino and the Angara camps” that started with the support of the Angara clan for his presidential bid in 2010.

The Apeco project, they said, led to the alleged landgrabbing of over 12,000 hectares of agricultural, forestal and foreshore lands in Casiguran, Aurora where the project is located.

PhilHealth denies P2M debts to private hospitals

THE Philippine Health Insurance Corp. (PhilHealth) said Thursday it has no overdue payments to more than 900 private hospitals.
“It is incorrect to say that we have P2-billion debt. We have been asking for details of that — those details have not been provided,” PhilHealth president and chief executive Eduardo Banzon said.
He said PhilHealth has more than P100 billion in reserves.
Rustico Jimenez, Private Hospitals Association of the Philippines president, alleged that PhilHealth’s debts accumulated over the years could be even higher than the estimated P2 billion. He said PhilHealth has been ignoring their pleas to settle their obligations.
“We have improved clinch processing. We have reduced the processing of clinch from more than 60, 70 days to about 48. We are almost updated, so it’s incorrect for them to say that we have unpaid clinch of two billion,” he added.
He said PhilHealth has been constantly communicating with huge private hospitals in Manila and in the provinces and all have committed to continue accepting PhilHealth cards.
Some of these hospitals include Medical City, St. Luke’s Medical Center, Cardinal Santos Medical Center, Cebu Doctors Hospital, Riverside Medical Center in Bacolod City, among others.
“Sometimes statements like that (debt) should be looked into. You know, the hospitals in the Philippines, the private hospitals have been partners of PhilHealth for a long time and will continue to be partners and will continue to accept PhilHealth members,” said Banzon.
He assured the public that private hospitals that are accredited with PhilHealth will accept its members. “If there’s any hospital that won’t you just tell us,” he said.
“They (private hospitals) have signed up with us either warranties of accreditation of performance commitment contract. They are legally obliged to accept our members, I will take the necessary actions,” he added.
To resolve issues on payments, Banzon said starting September 1, PhilHealth will pay hospitals directly and will remove the practice of paying through voucher and check.
“As long as you have a Landbank account, we pay it to hospitals directly. And hopefully that will further improve our processing time,” he said.
Banzon likewise said PhilHealth is willing to sit down with Jimenez and clarify issues regarding its obligations.
“PhilHealth right now is very easy to talk to. We’re very open. We’ll listen to criticisms; we’ll listen to inputs because we acknowledge that the task of the universal healthcare needs inputs from everybody,” he said.
Charity wards
Meantime, the Department of Health (DOH) clarified reports of closing down charity wards in government hospitals, after receiving flaks from the public.
Health Undersecretary Teodoro Herbosa said charity wards will not be dissolved but will only be converted into PhilHealth wards.
“The charity wards will continue. The charity patients will continue because there are still patients out there who may be in and out of the insurance system. So charity wards will not be dissolved. There’s no policy or paper that dissolves the charity wards,” Herbosa said.
He said the government would want charity ward or the dole out concept to eventually be dissolved giving way to universal healthcare where every Filipino is enrolled to PhilHealth.
At present, Herbosa said 80 percent of the population is currently enrolled to PhilHealth.
He said around 5.2 million households or 20 million poorest of the poor people earlier identified by the National Household Targeting System for Poverty Reduction were automatically registered in the PhilHealth program where they can avail free treatment and hospitalization in government-run hospitals.
“All government hospitals are supposed to accept those enrolled in the sponsored program on a ‘no balance billing.’ That means, no additional payment so all they come is with their PhilHealth membership,” he said.
The DOH is looking into the possibility of convincing private hospitals to offer the same no billing policy to PhilHealth beneficiaries.
Herbosa said the government allotted P12 billion for the PhilHealth program.
