Appellate court TROs Lee case vs. Pag-IBIG

CITY OF SAN FERNANDO–Vice President Jejomar C. Binay said the Court of Appeals (CA) stopped a Makati City judge from implementing its earlier rulings favoring Globe Asiatique Realty Holdings Corp. (GA) president Delfin Lee.

Binay said the CA issued a temporary restraining order (TRO) against Makati Regional Trial Court Branch 28 Judge Eugene Paras, who granted the civil suit of Lee against Home Development Mutual Fund (Pag-IBIG Fund).

“We welcome the decision of the court. And we are hopeful that this decision will advance our demand for justice for those who have been victimized by Delfin Lee,” Binay said.

In a Resolution promulgated last March 27, the CA through Justice Stephen C. Cruz ruled that unless restrained, the decisions rendered by Judge Paras will further place PagIBIG Fund “in an unjust and inequitable position, and will cause grave and irreparable injury, not only to the petitioner, but more importantly, to the public general.”

It will be recalled that following the filing of a syndicated estafa case against Delfin Lee and Dexter Lee in relation to GA’s alleged fraudulent transactions with the PagIBIG Fund, GA retaliated by filing a civil case against the Fund before the RTC of Makati.

Judge Paras then summarily decided the case in favor of GA without a formal presentation of evidence.

In issuing the TRO against the summary judgment rendered by Judge Paras, the CA noted that “[r]emarkable is the fact that petitioner (PagIBIG Fund) was defrauded of billions of pesos already, for which numerous other cases, including criminal and civil cases, against private respondents are already pending before the appropriate tribunals.”

The CA granted the TRO upon the application of the PagIBIG Fund which claimed in its Petition that Judge Paras gravely abused his discretion when he summarily rendered the assailed decisions in favor of GA without the benefit of a trial.

The CA noted in its decision that “[u]nder the circumstances, We hold and so rule that petitioner would stand to suffer grave and irreparable injury if the writ of execution of the assailed Resolutions is implemented at this time and pending the resolution of the instant petition.”

Meanwhile, both Delfin Lee and Dexter Lee remain at large despite the outstanding warrants for their arrest issued by the RTC of Pampanga where the syndicated estafa against them is pending. ●Marna Dagumboy-del Rosario

818 farmers graduate in Pampanga Field School

CITY OF SAN FERNANDO – The Farmers’ Field School (FFS) in Pampanga has produced 818 graduates on Wednesday as the provincial government stepped up programs to improve agricultural production.

Gov. Lilia Pineda and officials from the Department of Agriculture (DA) and Department of Agrarian Reform (DAR) graced the mass graduation of farmers from the towns of San Luis, Magalang, Porac, Bacolor, Floridablanca, Mexico, Guagua and Lubao and Mabalacat City.

DA-Central Luzon Administrative Director Rleen Torres, who represented DA regional director Andrew Villacorta, congratulated the graduates and reiterated their agency’s commitment to advance the knowledge and capabilities of Pampanga farmers.

With the assistance of Agricultural Training Institute (ATI), Philippine Rice Research Institute (PhilRice) and Office of the Provincial Agriculturist (OPA), the FFS graduates studied from June 2012 to March 2013 the latest and modern techniques on planting rice, corn, vegetables and high-value crops.
The FFS allowed the farmers coming from 28 barangays to have “hands-on training.” The program encouraged organic farming.

The FFS also touched on Small Scale Irrigation System (SSIS).
In her speech, Pineda lauded the government agencies for their continued support in helping improve the production of the some 32,000 farmers in Pampanga. She added that she will focus more on agriculture if she gets a second term as governor.

Ramon Estanislao, head of the DA office in Pampanga, said there is crops’ insurance to be offered for farmers. He stressed the importance of the insurance as Pampanga “is also affected by climate change and perennial flooding.”

Pineda said that some 53,000 hectares of land are used for rice production in the province.
“With our collective efforts to improve farmers’ yield and considering the vast area for rice production, there is no way that we will be hungry in Pampanga,” said Pineda in the dialect. ●Joey Pavia
