MANILA (Updated, 9:04 a.m.) — The first day of implementation of the controversial Cybercrime Prevention Act of 2012 will be met with another petition questioning its constitutionality before the Supreme Court.
Set to be filed by the National Union of Journalists of the Philippines (NUJP) at 1 p.m. Wednesday, the petition was signed online by at least 211 individuals and 12 different media outfits and watchdogs.
These are the Philippine Center for Investigative Journalism, Center for Community Journalism and Development, Peace and Conflict Journalism Network Philippines, Philippine Center for Photojournalism; ABS-CBN/ABS-CBNNews.com, GMA-7/GMA News Online, Rappler.com, Mindanews, Philippine Daily Inquirer, Interaksyon.com, Sun.Star, Daily Tribune, Malaya/Business Insight, VERA Files, and Far Eastern Broadcasting Corporation, among others.
“The media organizations leading this initiative believe that through this petition, the Philippine media are taking a collective stand and asserting their voice against Republlic Act 10175, using the very medium the law seeks to constrict,” the NUJP said.
On Tuesday, the SC said it has deferred the deliberation of the petitions to next week, sparking disappointment among those who are pushing for a restraining order prior to the law’s implementation.
The petitions specifically challenged the constitutionality of Sections 4, 5, 6, 7, 19 and 20 of the law, which were seen as violations of freedom of speech, right to privacy, illegal searches and seizures and double jeopardy.
The insertion of provisions regarding online libel and vague sections on data collection and sanctions were also slammed by media groups for leaning towards censorship.

MANILA — The lone senatorial candidate of the Makabayan Coalition, a new political party, seeks to “break the rules” of the campaign as he vowed to give the electorate a “real choice” in the 2013 midterm polls.
Representative Teddy Casiňo of the Bayan Muna party-list filed his certificate of candidacy (COC) for senator at the main office of the Commission on Elections (Comelec) Wednesday morning.
Clad in a jogging suit, Casiňo went with his family and fellow Bayan Muna Representative NeriColmenares. He jogged with his supporters from the San Agustin Church to the Palacio de Gobernador in Intramuros, Manila.“Yung pagtakbo ay simbolonaangtakbongitosaSenado ay isangbagaynakailangangpagpawisan, kailangangpaghandaan. Hindi birongbagay at kasamakosapagtakbongitoangsambayanang Pilipino,” he said.
Casiňo admits that it is a big challenge to run for the Senate without the political machinery of the United Nationalist Alliance nor the the Liberal Party-led coalition.
“On the other hand, kailanganggawinitodahilnakitanamannatinyung UNA at LP coalition ay pare-parehongmgapangalanna, pare-parehongmgapamilya, mgasenador at dating mgaseandor at mgakamag-anak,” he said.
“PanahonnaparamagkaroonngibasaSenado…We really aim to break the rules of the campaign,” the lawmaker stressed.
The coalition, accredited as a political party in January this year, will tap its grassroots machinery to campaign on “platforms of issues and not so much on personalities and guns, goons and gold”.
In the 2010 national elections, Casiňo’s fellow Makabayan Coalition members—Liza Maza and SaturOcampo—ran under the Nacionalista Party of Senator Manny Villar. Both of them lost with only close to four million votes each.
If he wins in the 2013 polls, Casiňo said he will push for the reduction of the value-added tax (VAT) on basic commodities. He proposes to slash the VAT by six percent.

CITY OF SAN FERNANDO — Board Member Ricardo Yabut said Tuesday for “unity’s sake and the welfare of his constituents” in Sto. Tomas, San Luis, Candaba, San Simon ,Minalin, Macabebe and Masantol he is setting aside bid for a seat in the Lower House, as he gives way to Candaba Mayor Jerry Pelayo.
Yabut told Sun.Star Pampanga he instead will aspire to finish his term as a provincial lawmaker where he is bound to become a senior board member if re-elected to the august body in 2013.

“First, it is for unity’s sake that I would give way to Mayor Pelayo who has similarly professed his desire to run for congress. The second reason of his dropping out of the supposed race with Pelayo and comebacking former Congressman RimpyBondoc in next year’s polls, Yabut noted , was in respect to the request of Governor Lilia Pineda to continue his work at the Provincial Board, much that he, together with colleague Board Member Nestor Tolentino, are still very much needed there.

CITY OF SAN FERNANDO — A 50-year-old medical doctor and lawyer is running for the gubernatorial post of Pampanga.
Jose Cabrera Montemayor Jr. of Purok Magsaysay, Barangay Sto. Tomas in Sasmuan town filed his certificate of candidacy at the Commission on Elections (Comelec) Monday at exactly 5 p.m.
Reportedly the son of Judge Jose Montemayor, the younger Jose (alias “Joey”) was born on February 17, 1962 and is a registered voter in Sto. Tomas, Sasmuan.
His is not affiliated with any political party based on his certificate of candidacy. No certificate of nomination was attached to his COC and was presented to the Comelec.
Comelec officials reached by Sun.Star Pampanga Tuesday said Montemayor told them he was an alternate candidate of former Governor Ed Panlilio.
“He told us that he was one of the choices of the party of Among Ed,” the Comelec officials said.

BACOLOR — Pampanga’s Best matriarch Lolita Hizon filed her certificate of candidacy (COC) for vice mayor of this town and disclosed she will not support former governor Eddie Panlilio who is set to stage a comeback in the gubernatorial race.
Her son, incumbent Mayor Jose Maria “Jomar” Hizon who also filed his COC Tuesday, is seeking for a re-election.
According to councilorable Bong San Pedro, Hizon said she would support the candidacy of Governor Lilia Pineda rather than Panlilio, whom she had supported and later became a staunch critic of the former governor.
The mother and son tandem will be running under an independent party.
Mayor Hizon said he will continue his programs and projects for the town. He added that much has already been accomplished under his term and he would not be distracted by the political noise of the coming 2013 midterm elections.
The Hizons will be running against former Mayor Romeo “Buddy” Dungca and incumbent Vice Mayor Ananias “Jun” Canlas, who are aiming for mayor and vice mayor respectively.

ANGELES CITY — An environmentalist group has vowed to support the “Meatless Mondays” campaign in the country by promoting tofu sisig, which it claims is as good as the real pork sisig.
In fact, a tofu sisig cooking event was held at the Verman Car Park along Miranda Street here last Monday, according to former Councilor Louie Reyes who heads the Green Youth Brigade.
The “veggie sisig” cooking, he said, was their way of contributing to the efforts of Dr. Custer Deocaris, a molecular biologist who now chairs the LuntiangLunes (literally, Green Monday) movement, which launched the “Meatless Mondays” campaign in the Philippines.
“We have tapped vegetarian cook Paul Dizon whose tofu sisig is as delicious as the pork sisig,” Reyes said.
Since the original pork sisig was conceptualized at the crossing in Angeles City, it has evolved into many varieties like sisigbangus and sisigmanok, according to Reyes.
“We are excited about the tofu sisig since this is the second time Green Youth Brigade has featured food in its activities,” Reyes said.
“It looks very promising since our audience really enjoyed the tofu sisig. They were really surprised that it tastes like the real classic and original pork sisig. It has big market potential for health conscious people,” he added.
Congressman Teddy Casiño filed House Bill 6311 which seeks to require both private and public schools to provide meatless lunches every Monday for their students.
The Green Youth Brigade responded to Deocaris’s call to join the campaign, Reyes said.
The Green Youth Brigade is a network of youth-based, non-government organizations and environmental advocates.
It is also working on issues that promote a healthy environment and sustainable development.
With the help of media and social networking, the Green Youth Brigade will continue to promote tofu sisig especially to Kapampangans who are known for their cooking and love of food, Reyes said.

MANILA — A party-list lawmaker on Monday proposed an “Internet Freedom” bill in Congress to effectively repeal contentious provisions in Republic Act 10175 or the Cybercrime Prevention Act.
Kabataan party-list Representative Raymond Palatino said his measure will also enumerate the rights of netizens, the supposed target of the controversial Cybercrime law, which penalizes online libel.
“If we analyze the Cybercrime law, it is apparent that it restricts rather than protects netizens. Apart from repealing RA 10175 through the Internet Freedom Bill, we intend to lay down the inalienable rights of Filipino Internet users,” Palatino said. Palatino noted that Internet access and online freedom of expression were recently added by the United Nations Human Rights Council to the list of basic human rights.
“With the Internet Freedom Bill, we seek to assert this right, and ensure that the Internet is free from censorship and totalitarian suppression,” the lawmaker said.
Senator Francis Escudero earlier said he will file a similar measure in the Senate to remove several provisions in the Cybercrime law. Meanwhile, Kabataan party-list also filed on Monday a petition for prohibition on RA 10175 before the Supreme Court.
An initial list of signatories on the said petition includes Palatino, ACT Teachers party-list Representative Antonio Tinio, UP Student Regent Cleve Arguelles, Philippine Collegian editor-in-chief Katherine Elona, and UP College of Mass Communication Dean Roland Tolentino.
Earlier, Justice Secretary Leila de Lima assured that the constitutional rights of netizens will be protected in the implementation of the new law.
As of this posting, five petitions have been filed before the Supreme Court questioning the constitutionality of the Cybercrime Prevention Act of 2012.
Section 19 of RA 10175, authorizes the justice secretary to restrict or block access to computer data found for have prima facie violation of cybercrimes as defined by law.

MANILA — Twenty people trooped to the Commission on Elections (Comelec) head office in Manila to file their certificates of candidacy (COCs) for senator in the first day of the filing on Monday.
The first to officially file his COC was reelectionist Senator Aquilino Pimentel III of the Liberal Party (LP).
Pimentel filed his COC hours ahead of the administration coalition’s formal proclamation of its 12-man full slate at Club Filipino in San Juan City. Eight candidates of the United Nationalist Alliance (UNA) also filed their COCs on Monday.
They are Senator Gregorio Honasan II, San Juan City Representative Joseph Victor “JV” Ejercito, Cagayan Representative Juan “Jackie” Ponce Enrile Jr., Zambales Representative Milagros “Mitos” Magsaysay, former senators Ernesto Maceda, Juan Miguel Zubiri, Richard Gordon, former Tarlac governor Margarita “Tingting” Cojuangco.
The group was accompanied by the party leaders Vice President Jejomar Binay, Senate President Juan Ponce Enrile and former President Joseph Estrada.
UNA is a coalition of Binay’s Partido Demokratiko Pilipino-Laban and Pwersa ng Masang Pilipino of Estrada.
Senator Loren Legarda, who is seeking her last term, filed her COC at 3:50 p.m., citing feng shui of her January birthday as reason for filing at a specific time.
She also declared that this will be her last political campaign “in my life.”
“So it will be my last term,” said Legarda.
Legarda is common candidate of UNA and the LP-led administration coalition.
Comelec spokesperson James Jimenez said the 20 COCs filed Monday represent half of the poll body’s expectation of 50 applications during the five-day filing period.
The period of COC filing ends 5 p.m. of October 5 (Friday).
“We are almost half (the number) and it’s only been one day,” Jimenez said.
Aside from the big and influential names in politics, several other unknown individuals filed their COCs for senator.
Among them was a man claiming to be the husband of presidential sister Kris Aquino, another one who identified himself to be the “owner” of the Philippine archipelago, and a senatorial wannabe who claims to be “most qualified” for being like national hero Dr. Jose Rizal.
Kris Aquino’s “hubby” Daniel Magtira, businessman Salam Lacan Luisong Tagean and Merlito Lagata filed their COCs for senator.
Magtira, the third to file his COC, said in a television interview that he wants to wed first the Queen of All Media and youngest sister of President Benigno Aquino III before concentrating on his Senate run.
He admitted that he was a multiple-time filer for national posts but has never made the final list. He gave out t-shirts to members of the media bearing the words “Happy Birthday Daniel Magtira. Love Kris Aquino, First Lady Imelda Marcos” and even threw out coins before leaving the Comelec premises.
Tagean, for his part, claimed that he is the “legitimate owner” of the whole archipelago, including the Panatag (Scarborough) shoal in the West Philippine Sea., owing back to their forefathers in the 13th century.
He said he wants to run as senator in order to rectify the things such as the issues on Scarborough Shoal and Spratly Islands.
“Nagkakaroon tayo ng problema sa Spratlys at Scarborough Shoal. E kung sabihin ko kung sino ang tunay na may-ari? Buhay ang heir! Hindi pwedeng kunin sa amin ang legality niyan,” said Tagean.
Lagata, the 18th person to file COC, is again seeking a Senate seat. He first tried his luck in the 1992 elections but was declared a nuisance candidate by the Comelec.
Lagata, who claimed that he was like Jose Rizal and is qualified to run for Senate, asked a television reporter for her hand in marriage and joked that he was a good kisser.
Aside from the three, other lesser known COC filers are Anicio Escosura, Aerio Bernardino, and Melchor Chavez.
Marcos loyalist Oliver Lozano and broadcast journalist Melchor Chavez also filed their COCs and will run under the Kilusang Bagong Lipunan, the political party formed by the late strongman Ferdinand Marcos.
Jimenez said the first day of the filing of COCs went smoothly.
“I think the day has been very successful. Except the number of people outside and the volume of activities outside, all of the activities in here went very smoothly. Walang hassle (No hassle),” he said.
Metro Manila police chief Leonardo Espina said the overall situation on the first day of the filing period was “generally peaceful” and that security around the Comelec main office in Intramuros, Manila, has been beefed up.
Espina said the first day of the COC-filing “was accentuated by convoys, caravans, marching bands and festive atmosphere.”
The Comelec, however, criticized the continued practice of some politicians of employing fiesta-like motifs in filing their COCs despite the earlier appeal by the poll body to keep the five-day process dignified.
Comelec Chairman Sixto Brillantes said it was sad that politicians chose to ignore the appeal of the poll body in ridding circus-like environments during the COC filing, which began Monday.
“The filing looks like a circus. This is a very dignified process,” Brillantes said, adding that some group use the event as a venue to campaign early.
Outside the Palacio del Gobernador building in Manila, bus loads of supporters of UNA candidates flocked the vicinity early in the day carrying streamers, tarpaulins and cheering on the names of their candidates.
There were also some groups that featured bands while other camps held picnics in the nearby plaza.
Over the weekend, Brillantes appealed to candidates to avoid having lavish programs for their COC filing by bringing along a throng of supporters.
But the Comelec chair admitted that the candidates are not violating any laws when they organize their supporters since there is no law against premature campaigning.
“As we have said, it may not be unlawful but it is definitely against ethics,” said Brillantes.
In the Iloilo provincial office of Comelec, the candidates of United Nationalist Alliance were first to file their COCs.
In Davao City, it was a quiet day at the Comelec city office on Monday as only two candidates, who can be regarded as serious contenders, filed their candidacy papers.
