MANILA (Updated 2:48 p.m.) — Party-list lawmakers slammed the Department of Education (DepEd) for implementing the K+12 program without an enabling law from Congress.
“The DepEd has essentially tied the hands of Congress that K+12 must definitely be passed because it had already started its implementation. How can this not be a constitutional infringement of the highest order?” lawyer Terry Ridon, national president and general counsel of Kabataan party-list, said.
Ridon said DepEd preempted the constitutional prerogative of Congress to determine with certainty the type of formal basic education, including its curriculum and years of study that it deems best for the nation’s children.
The proposed legislation on the K+12 education program pushed by the government is still pending before the House Committee on Basic Education and Culture.
For the K+12 law to be passed, the measure would still need the approval of the 285 members of the House of Representatives. The proposed legislation would need to pass second and third reading approval before it is signed by President Benigno Aquino III.
But Sorsogon Representative Salvador Escudero III backed the implementation of the program.
“DepEd can already implement the government’s K to 12 program even without an enabling law. What is pending before the House committee is to ensure that funds will be available even after the term of President Aquino in 2016,” he explained in a telephone interview.
Last month, Education Secretary Armin Luistro issued DepEd Order 31—the guidelines for the implementation of the new curriculum.
Meanwhile, Gabriela Women’s Party Representative Emmi De Jesus said the government is sowing false hopes with its continued persistence in implementing the K+12 program.
De Jesus noted that the implementation of the program will worsen problems in public school facilities with the continuing shortage of 132,483 teachers; 97,685 classrooms; and 153,709 water and sanitation facilities.
“DepEd’s claim that the universal kinder program will prepare the children socially, physically, mentally and emotionally is clearly debunked by this situation, which glaringly exposes our government’s disregard for quality education. The situation from last year has not improved and yet the government continues to banner the K+12 program,” she stressed.
ACT Teachers Representative Antonio Tinio said while the progressive party-list bloc is criticizing the education department, they have no plan to question the K+12 before the courts.
“No, we don’t plan to question the K to 12 before the courts at this time. DepEd can claim that it has authority to implement changes in the curriculum,” he said in a text message.

MANILA – The Department of Trade and Industry (DTI) urged on Monday micro-businesses, particularly “tiangge” and “sari-sari” stores, to register with the Philippine Business Registry (PBR).
DTI Undersecretary Zenaida Maglaya said it would be better for micro, small and medium enterprises (MSMEs) to legalize their business so they can avail themselves of the government’s benefits.
“All kinds of businesses, whether large or small-scale, should register… so they can avail (themselves) of government services, and they can use their registered business name in marketing their business,” she said.
Tiangges and sari-sari stores are classified under the micro-enterprises. Micro-enterprises are defined as any business activity or enterprise engaged in industry, agribusiness, or services, whether single proprietorship, cooperative, partnership or corporation whose total assets amount to P3,000 or less and employs about one to nine persons.
Tiangges and sari-sari stores are considered informally as part of the “underground economy” due to its small business size and lack of business registration with appropriate government agencies.
Maglaya said the DTI has made it easier for entrepreneurs to register their businesses through the PBR, which was launched last March in all DTI field offices, to accommodate transactions for new business registrations.
A transaction will only take 15-30 minutes and will involve only a two-page PBR application form.
Owners of micro-business do not have to spend large amount of money to register their business, Maglaya said.
Maglaya said a micro-business pays only for the business name registration (BN), in which the amount depends on the preferred business scope.
A micro-entrepreneur, for example, who wishes to operate his store within a barangay will pay P200 for business name registration, while those who opt to operate within a town or city will pay P500.
“Registering a business name can provide assurance to the owners that their trade name is protected and cannot be used by other people or businesses,” she said.
According to Republic Act No. 3883 or the Business Name Law, a registered business holds the exclusive right to use its business or trade name in doing transactions.

MANILA – The House of Representatives is considering extending its plenary session until Thursday this week for the approval of the sin tax bill, a proposed law certified as urgent by President Benigno Aquino III.
“Our target here is to finish everything by Wednesday but if we are unable to do that, we will just ask the senators to concur if we hold sessions until Friday… There are number of bills that are (pending), the most important one is the so-called sin tax,” House Speaker Feliciano Belmonte Jr. told reporters in an ambush interview.
Congress is scheduled to adjourn sine die on June 6. It will resume session next month before President Aquino delivers his third State of the Nation Address.
Alcohol and tobacco products will be slapped with higher taxes once the sin tax bill is signed into law.
By 2012, cigarettes, which cost P11.50 or less, will be sold for P23.50; while cigarettes, which cost P11.50 and above, will be sold for P31.80.
“It’s still in period of interpellation and debates. We had a very long interpellation over the last two session days. There are others who want to interpellate so we want everybody to get a chance to do that,” Belmonte said of the proposal.
Zambales Representative Mitos Magsaysay and Cagayan de Oro Representative Rufus Rodriguez are challenging the approval of the bill after it was railroaded in the House Committee on Ways and Means.
The lawmakers said there was no due process because stakeholders were not given an opportunity to signify their position on the amendments introduced by the Department of Finance (DOF).
With the DOF amendments approved, the proposed sin tax law will only contribute P33 billion instead of P60 billion.

MALACAÑANG asked farmers groups on Monday to help the Department of Agrarian Reform (DAR) determine the areas where the Comprehensive Agrarian Reform Program (Carp) are not yet implemented.
Deputy presidential spokesperson Abigail Valte made the appeal to farmers following criticisms of the administration’s apparent “ineffective and snail-paced” implementation of land distribution under Carp with reforms (Carper).
“From our end, what we can do to help is to ask the places where they said the Carp has not yet been implemented,” Valte said.
She said the agrarian reform department should first check if the places fall properly under Carp and what progress has been made so far.
Valte denied allegations of President Benigno Aquino III’s supposed lack of interest in the matter, saying Agrarian Reform Secretary Gil delos Reyes has been constantly updating Malacañang about the land distribution.
“They seem to be making rapid progress,” Valte said on DAR’s performance.
Several farmers groups trooped last Friday to the DAR office to air dismay over the government’s “slow” completion of the agrarian reform program.
At least 5,200 farmers from Negros Island, Mindanao and Luzon planned to have days-long protest from June 1 to June 10, which is the 24th anniversary of Carp.
Save Agrarian Reform Alliance (Sara) said in a statement that agrarian reform, especially land distribution is “languishing” under the administration of Aquino.
The group described the Carp performance as “worst since 1988,” the year Carp took effect.
“Napakabagal ni PNoy at delos Reyes sa pagpapatupad ng repormang agraryo. Usad-pagong ang Caper, dalawang taon na lang ang natitira bago ang deadline ng distribusyon ng lupa sa June 2014 (Aquino and delos Reyes are very slow in implementing agrarian reforms. Caper is moving at turtle pace. There are only two years left before the deadline of the distribution of lands on June 2014),” said Trinidad Domingo, spokesperson of Sara.
Carper primarily extends the land distribution program of Carp by five years.
Domingo said their group’s worry is that Carp is not a priority of the administration.
“It’s (Aquino administration) Carp performance was a mere five-percent share of land distribution output compared with the Ramos administration’s 46 percent, Arroyo’s 23 percent, and Cory Aquino’s 21 percent. The current administration’s performance is even worse than the Estrada administration’s 5.4 percent, which distributed lands for about the same period of two years,” the group said.
Sara questioned whether the lands reported as distributed have been actually given to agrarian reform beneficiaries and that these beneficiaries have the land titles in their hands, and that they are being provided with appropriate support services such as access to socialized credit, irrigation, among others.
“Time is running out, but before it does, the farmers from Sara will not be found merely waiting for what will not happen under this government. The farmers have vowed to claim what is theirs under Carper, under the Philippine Constitution,” the group said.
Valte said the Palace will let the farmers groups conduct their protests.

THE government will spend P87.1 million for President Benigno Aquino III’s official trips to the United Kingdom (UK) and the United States (US), Executive Secretary Paquito Ochoa Jr. said Monday.
Aquino left Monday afternoon for London via a chartered Philippine Airlines flight along with an 89-member delegation.
The President’s trip to UK is from June 4 to 6. This is his first since he became President in 2010.
After UK, he will proceed to the US for a working visit from June 6 to 8 on the invitation of US President Barack Obama.
Aquino leads a lean delegation that includes Foreign Secretary Albert Del Rosario, Transportation and Communications Secretary Manuel Roxas, Finance Secretary Cesar Purisima, Defense Secretary Voltaire Gazmin, Trade Secretary Gregory Domingo, Tourism Secretary Ramon Jimenez, Energy Secretary Rene Almendras and Presidential Communications Development and Strategic Planning Office Secretary Ramon Carandang.
Philippine Ambassador to Washington Jose Cuisia Jr., Philippine Ambassador to London Enrique Manalo and Presidential Protocol Chief and Presidential Assistant on Foreign Affairs Miguel Perez-Rubio are also included in the presidential entourage.
Ochoa said the expenses cover accommodation, telecommunications, transportation, food and equipment, among others, for the President and his official party.
The Department of Foreign Affairs (DFA) said Aquino will hold a bilateral meeting with Prime Minister David Cameron to discuss the Philippines-UK political and economic cooperation, Britain’s participation in the International Contact Group for the peace process, anti-corruption and good governance practices of both countries, and other regional and international concerns.
The DFA also said the President will likewise meet with several major British investors, take part in the Philippine fun tourism campaign and dialogue with the Filipino community in the UK, which is the largest in Europe.
From the UK, Aquino will fly to Washington D.C. for a one-on-one meeting with Obama at the Oval Office, their fourth since 2010.
On top of the agenda of the two leaders is discussion on a broad range of bilateral, regional and global issues that reflect the multifaceted nature of the two countries’ strategic partnership.
The DFA said Secretary of State Hillary Clinton will host a luncheon in honor of Aquino and his delegation at the Benjamin Franklin State Dining Room of the State Department in the US capital.
The President is also scheduled to meet with leaders of the US Senate at a reception organized by Senate President Pro Tempore Daniel Inouye on Capitol Hill and will be guest of honor at the launch of the US-Philippines Society.
Before heading home to Manila, Aquino will stop by Los Angeles to meet with the Filipino-American community, which represents about 3.1 percent of the city’s population.
Presidential spokesperson Edwin Lacierda said the President has a huge chance to meet in person American Idol runner-up Filipina-Mexican Jessica Sanchez.
