MINALIN, Pampanga\u2013Former Mayor Edgardo Flores has filed criminal and administrative charges against incumbent Mayor Arturo \u201cKatoy\u201d Naguit for alleged \u201cillegal quarrying.\u201d<\/p>\n
Flores\u2019 complaint was filed before the Office of the Ombudsman, accusing Naguit of violating Republic Act 3019, known as the Anti-Graft and Corrupt Practices Act and Republic Act No. 6713, known as Code of Conduct and Ethical Standards for Public Officials and Employees or grave misconduct.<\/p>\n
The complaint stemmed from to alleged quarrying during the Habagat onslaught in August 2012 when
\nthe Sto.Tomas-Minalin taildike was breached causing heavy flooding in the province particularly in the municipalities of Sto. Tomas, Minalin and the City of San Fernando.<\/p>\n
In a Pampanga Regional Development Council meeting held on August 17, 2012, Naguit and local chief executives of flood-affected town offered to assist the Department of Public Works and Highways (DPWH) in the pilot channelling for the San Fernando-Sto. Tomas-Minalin Tail Dike, subject to the guidelines being observed by the agency to regulate the desilting operation and to minimize scouring along the structures.<\/p>\n
The guidelines stressed that an easement distance of 20 meters should be observed pursuant to the provision of the Water Code.<\/p>\n
Naguit, Flores alleged, has issued permit to Rondon Mercado, the mayor\u2019s political ally, to conduct quarrying activities beside the Minalin tail dike.<\/p>\n
Flores claimed that the quarrying activity beside the tail dike was in violation of the DPWH\u2019s guidelines requiring easement distance of 20 meters to prevent the collapse of the structure.<\/p>\n
Flores said the quarrying has exposed the dike to the danger making it vulnerable to water current \u201cand this was committed right after a calamity.\u201d<\/p>\n
Flores also claimed that \u201cthe incumbent mayor clearly gave unwarranted benefits to Mercado as he delivered truckloads of sand to Minalin Poultry and Livestock Multi-Purpose Cooperative (MIPOLCO).\u201d<\/p>\n
Flores stressed in his complaint that the actuation of Naguit has caused undue injury to the government since heavy equipment belonging to the government were utilized for a private purpose.<\/p>\n
Flores stressed that Naguit acted with evident bad faith and gross inexcusable negligence for allowing Mercado to conduct quarrying activity knowing that the guidelines for the same had not been satisfied.<\/p>\n
Engr. Arthur Punsalan, provincial government and environment and natural resources officer (PG-ENRO), clarified during the hearing of the Provincial Joint Committee on Environment and Natural Resources and DPWH on September 10, 2012, that there was a permit issued to Mercado but it was a scraping permit for fishpond development.<\/p>\n
