\nMexico Mayor Teddy Tumang is a victim as he always had been. He is a favorite of his nemeses, of being harassed and politically distracted. Recently, he has thwarted another (il)legal action against him when the Office of the Ombudsman withdrew the 90-day suspension order issued by the said office. \nIn February 2006, a certain Eduardo Batac and the late Col. Wilfredo Munar filed criminal and administrative cases against Tumang for alleged cases of illegal quarrying on a private farmland, which in fact was not really an act of quarrying. The farmland was a piece of lot made idle by the eruption of Mt. Pinatubo. It was slightly scraped by a private individual (not Tumang) to remove thereat some volcanic debris. It was a private act of a private person on a private land.

\nTumang\u2019s legal team were correct in saying that the scraping \u201cdid not cause undue injury to the complainant\u201d since the lahar deposits came about as a result of the volcanic eruption. The act in fact is beneficial to the land and the owner of the land as it was reverted from its being idle back to its productive state now suitable for farming. What\u2019s wrong with cleaning one\u2019s own private backyard?

\nOn Tumang\u2019s side, he simply invoked the \u201cAguinaldo Doctrine\u201d which automatically declares moot and academic any administrative case filed against an elected official once the latter has been re-elected into office. Legal authorities sometimes call it the \u201cDoctrine of Condonation\u201d wherein the electorates condone or set aside a previous wrong or any alleged wrong by putting again into office the alleged doer of the wrong. The administrative case and its criminal aspect were filed in 2006 and since then, Tumang has been re-elected twice- in 2007 and in 2010.

\nThe case emanated from a doing some years ago. The illegal quarrying issue was not even a case of illegal quarrying. Remember the time of former mayor Ernesto Punzalan who has caused the \u201cscraping\u201d of farmlands? Various tracts of lands were scraped of volcanic materials that rendered the said lots viable now for farming. They were back in their productive state.

\nTumang averred that the Ombudsman\u2019s order was wrongfully rendered against him. He nevertheless gentlemanly acceded to the suspension order when it was served. He respects the law while exercises his right to defend himself the legal way.

\nThe time element of the suspension is likewise suspicious. Although Tumang, a three-termer chief executive, will definitely be not eligible to seek re-election, the repercussion of the suspension from office targets the other Tumang.
